RESOLUTION
AUTHORIZING EXECUTION OF AN AGREEMENT WITH RENZ ADDICTION
COUNSELING CENTER FOR COMMUNITY AWAR NESS CAMPAIGN
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City M4nager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute an agreement on behalf of the; City of Elgin with
the Renz Addiction Counseling Center for a community awareness
campaign, a copy of which is attached hereto and made a part
hereof by reference.

AGREEMENT
COMMUNITY AWARENESSAIGN
BENZ ADDICTION COUNSELIN CENTER
This agreement is made and entered into the 54h day of March, 1999,by and between the RENZ
ADDICTION COUNSELING CENTER of Elgin,and Illinois riot-for-profit organization
(hereinafter referred to as the"Grantee")and the CITY OF ELGIN,Illinois,a municipal
corporation(hereinafter referred to as the"Grantor").
WHEREAS,the parties hereto have each determinedi to be in their best interests enter
into this agreement to facilitate a Community Awareness C gn. The purpose of this
program is to create a web site and develop and distribute a
alai
newsletter to the
community. The goals of this project are to increase referrals prevention programming,and
increase community knowledge of crime prevention. Thus,th program directly contributes to
the reduction of crime and the improvement of public safety d welfare.
THEREFORE, in consideration of the mutual promises and covenants contained herein,
the sufficiency is which hereby acknowledged,the parties hereto hereby agree as follows:
1. The Grantee will provide a monthly newsletter, fro April, 1999 to March, 2000,
highlighting prevention programming available to Elgin resi nts. This newsletter will include a
monthly calendar of programs available to residents. It will distributed to drop off locations
such as the school district U-46, Elgin Police Department,the ibrary, city hall,and social
service agencies and mailed to selective parties on the Elgin ang&Drug Task Force mailing
list.
2. The Grantee will work with the Elgin Gang&Drug ask Force and Neighborhood
Watch to create a web site that will display the monthly cal ,as well as crime prevention
information and referral information for Elgin residents.
3. The Grantor shall provide the Grantee with upto $2,260.00 payable on a one time
basis through billing by the Grantee.
4. Funding provided to the Grantee shall be utilized to upport the costs of printing and
mailing the newsletter and costs associated with building a weo site.
5. Grantee will provide Grantor with an end of the year report,which reports shall
contain statistical data on distribution numbers.
6. The terms of thisagreem ent shall be severable. In e event any of the terms
or
conditions of this agreement are deemed to be void or otherwi unenforceable for any reason,
the remainder of this agreement shall remain in full force and ffect.
7. Grantee warrants that it shall conform to all requients of law,including but not
limited to any and all applicable federal or state statutes and r gulations. In the event Grantee
fails to conform to such regulations and statutes,Grantee shal refund all payments made to
Grantee upon 30 days written notice. Such refund shall not c nstitute or be construed as a

waiver of any right otherwise available to Grantor by law.
8. Grantee shall hold harmless and indemnify Grantorm and against any and all suits,
claims for damages, causes of action,and any and all other li ility, including but not limited to
reasonable attorney's fees,arising out of or resulting from tor's negligent performance of
this agreement or failure to conform to any requirement of law or regulation applicable to the
subject matter of this agreement or payment of funds associated therewith.
9. This agreement shall not be construed as creating a jp int venture,partnership,
employment or other agency relationship between the parties ljereto.
10. This agreement shall terminate on February 28,2000 or upon 30 days written notice
of a desire to terminate by either party.

They stated that it may not be desirable for the City to provide
flood proofing because of the possible liability if flood
proofing fails, and it sets a precedent for other parts of the
City.
Because much of the work included in the various options involves
pavement, storm sewer, and roadway modifications, it is
recommended that this work coincide with street rehabilitation
projects instead of Tyler Creek projects . Councilmembers
expressed interest in proceeding with an option regarding the
Eagle Heights flooding sooner rather than waiting for street
rehabilitation, which might not be schedyled for 10 years .
Various concerns were raised by Councilmembers, and they
requested that they be furnished with additional information,
including analysis and cost comparison for the various funding
options .
Grant Proposal for Elgin Gang/Drug Task Force
Councilman Gilliam made a motion, seconded by Councilman Schock,
to fund the following proposed projects and to develop a Purchase
of Service Agreement with Renz Center for the Delinquency
Prevention Program:
City Watch, Community Message System $33,450 . 00

Hostage Negotiator Telephone (rescue phone) 4,500. 00

Renewal of Kane County Auto Theft Task Force Grant and
Agreement
Councilman Gavin made a motion, seconded,' by Councilman Walters,
to approve the renewal of the Kane Country Auto Theft Task Force
Grant and to approve the interagency agreement between the
participating agencies. Yeas: Councilmembers Gavin, Gilliam,
Schock, Walters, Yearman and Mayor Kelly. Nays : None.
Change Order No. 1 to Aboveground Storage Tank Contract with
Metro Environmental
Councilman Walters made a motion, seconded by Councilman Schock,
to approve Change Order No. 1 with Metro Environmental in the
amount of $84, 711 . Yeas: Councilmembers Gavin, Gilliam, Schock,
Walters, Yearman and Mayor Kelly. Nays: None.
