Parker, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an employment agreement on behalf of the City of Elgin with James Vogt as head golf professional, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: December 16 , 1998 Adopted: December 16 , 1998 Vote: Yeas 6 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk , J� EMPLOYMENT AGREEMENT THIS AGREEMENT is made and entered into this ,Z?. day of 1998, by and between the City of Elgin, Illinois, a municipal corporation (hereinafter referred to as "City" ) , and James Vogt (hereinafter referred to as "Vogt" ) WHEREAS, City has determined it to be in City' s best interests to employ Vogt in the position of Head Golf Professional during the term of this agreement; and WHEREAS, Vogt desires to accept appointment to the position of Head Golf Professional of City upon certain terms and conditions . NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby acknowledged, the parties hereby agree as follows : 1 . Vogt shall be employed by City and shall act in the position of Head Golf Professional for City. 2 . Vogt shall reasonably and to the best of his abilities, perform those duties enumerated on Attachment "A" , which is attached hereto and made a part hereof . 3 . City shall pay to Vogt a salary of Twenty-seven Thousand Five Hundred Eighty-Three Dollars ($27, 583) in equal biweekly installments for his services during the term of this agreement which shall consist of a period of fifty-two (52) weeks, including two (2) weeks paid vacation time . In addition, cost of living raises will be given in accordance with that given to Management C employees . An incentive pay will be given to Vogt for reaching merchandise sales goals over bench mark of $60 , 000 . The ROI (return on investment) must be at 36% over cost of goods sold to receive the incentive of $ . 12/per dollar for every dollar over the bench mark. 4 . Vogt shall be entitled to retain any funds received by Vogt for providing golf lessons to members of the general public (both individual and groups) including junior lessons . Such retained lesson funds shall not be construed to constitute payment of salary or other benefit by City for any purpose . 5 . City shall provide a benefit package to Vogt which shall consist of enrollment in the Illinois Municipal Retirement Fund (including Social Security and Medical Insurance) upon such terms as are customary for other City employees in similar employment positions; one day off of work each week; and vehicle mileage reimbursement upon such terms as are customary for all other City employees. City shall also pay annual membership dues of $700 for Vogt for the Illinois Professional Golf Association. 110 6 . Vogt shall be governed by City' s personnel rules and regulations to the extent such rules and regulations do not conflict with the terms of this agreement . In the event of such conflict, the terms of this agreement shall control . 7 . This agreement shall expire on December 30 , 1999, unless otherwise terminated by law or as provided herein. This agreement may be terminated by either party hereto for any reason upon fourteen (14) days written notice . Nothing contained herein shall be construed as to create anything other than at-will employment agreement . 8 . This agreement shall not be construed as to create a joint venture or other partnership relationship between the parties hereto . 9 . This agreement shall be subject to and governed by the laws of the State of Illinois . In the event either party attempts to enforce any of the provisions of this agreement , it is agreed between the parties hereto that venue for the resolution of any such enforcement attempt or other resolution shall be in the Circuit Court of Kane County, Illinois . 10 . Vogt shall hold harmless and indemnify City from and against any and all causes of action, claims for damages, suits and any and all other liability, including but not limited to reasonable attorney' s fees, arising out of, or in connection with, or alleged to arise out of our in connection with, Vogt ' s negligent performance of the terms of this agreement . 11 . The terms of this agreement shall be severable . In the event that any of the terms or provisions of this agreement are deemed to be void or otherwise unenforceable for any reason, the remainder of this agreement shall remain in full force and effect . SPARTAN MEADOWS HEAD GOLF .PROFESSIONAL JOB DESCRIPTION SUMMARY OF POSITION Under the direction and supervision of the Golf Administrator. This annual contracted position will be held accountable for the daily operations and programming of the Spartan Meadows Clubhouse and course play. TYPICAL TASKS * Will be responsible to the City of Elgin's Golf Administrator. * Supervises, markets and develops specific goals for the merchandising operation at Spartan Meadows Golf Course. * Responsible for implementing training program for part-time clubhouse and course staff. * Will be responsible for scheduling and monitoring of all employees. • * Will be responsible for Assistant Professional at Wing Park. * Will be required to work 8 hours per day 6 days per week. Weekends and holidays are mandatory work days. * will be responsible for doing daily reports and bank deposit, with the exception of day off when another employee, as agreed upon with Golf Administrator, will complete daily report. * Develops, promotes and supervises concession operation at Spartan Meadows. * Supervises and schedules individual and group lessons with the appropriate instruction as agreed to by Golf Administrator. * Assists Golf Administrator with developing promotions for the golf course. * Develops, promotes and supervises leagues, tournaments and programs at Spartan Meadows. Will be responsible for working and assisting with leagues and tournaments at Wing Park Golf Course. * Will be responsible for attending a monthly Golf Committee meeting and submitting a written report to Golf Committee for Spartan Meadows and Wing Parks Clubhouse activity. Parker, City Manager SUBJECT: Golf Professional Employment Agreement Renewal PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider the renewal of the employment agreement for the Parks and Recrea- tion head golf professional at Spartan Meadows for 1999 . BACKGROUND The City has employed Mr. Jim Vogt as head golf professional since March 1, 1996 . Since that time, Mr. Vogt has been under the supervision of the golf administrator. The golf profes- r sional plans the golf course tournament schedules, initiates our retail merchandising plan, administers the expanded junior golf and lesson programs, and works closely with the golf administrator, running the operation and maintaining specific service levels for outings and daily play. The current contract with the golf professional will expire on December 31, 1998 . The proposed contract for 1999 includes a base salary of $27, 583 , an increase from the 1998 base of $26 , 523 and a salary increase equivalent to that received by City employees in the "Management C" category. The proposed base salary amount is comparable to salaries at five other public courses in the region (see attached memorandum) . The salaries at these courses range from $22 , 000 to $39 , 348 per year, with an average starting salary of $28, 222 . In addition to the base pay, the proposed contract includes a performance-based, incentive element tied to the sales and profitability of the retail golf merchandise operation. The golf professional would receive additional incentive pay only by meeting and/or exceeding 1998 results for sales ($60, 000) and profitability (36% return on investment (ROI) . For each dollar of sales over the sales benchmark of $60, 000, the golf professional would receive a $ . 12 commission. The incentive pay would only be received if the year-end return on rm. investment of the retail operation met or exceeded 36% . For example, if 1999 retail sales were $70, 000 with a ROI of at least 360, the golf professional would receive an incentive pay of $1, 200 ($10 , 000 above 1998 sales multiplied by 12%) . In contrast, if the golf retail sales were $100, 000 but failed to meet or exceed profitability goals (36% ROI) , no incentive would be paid. Our base salary proposal of$27,583 for Jim's employment contract is below the average starting wage($28,222)of these similar operations and the median salary($29,000)of this sample.
