S. Parker, City Manager SUBJECT: Safety-Kleen Corporation Acceptance of Sanitary Sewer, Recapture Ordinance and Easement PURPOSE The purpose of the memorandum is to provide the Mayor and members of the City Council with information to consider the acceptance of a sanitary sewer, an easement for the sewer and a recapture ordinance. BACKGROUND In 1985, the City authorized Safety-Kleen Corporation to extend a public sanitary sewer through their property located at 1500 Villa Street (northeast corner of Shales Parkway and U.S . 20) . The sewer is depicted on Attachment A. Upon its satisfactory completion, the sanitary sewer was to be accepted and a recapture ordinance adopted by the City of Elgin. The construction of the sanitary sewer was completed in 1986 . However, Safety- Kleen, the sole user of the sewer until 1998, did not provide an easement as required by the City and they also did not prepare a recapture ordinance . Because a portion of the Safety-Kleen property may be sold off for development purposes, Safety-Kleen could recapture some of their cost from the construction of the sanitary sewer. In order to receive the moneys, Safety- Kleen has provided the necessary easements and recapture ordinance for the sanitary sewer. Safety-Kleen has also included a sanitary sewer easement along their eastern property line to help facilitate the extension of the sanitary sewer. There are no additional costs associated with the acceptance of the sanitary sewer or the easement . Annual maintenance of the improvements will be included within future budgets . The recapture ordinance will allow Safety-Kleen to share the cost ($102, 580 . 25) of the Sanitary Sewer with the develop- ers/owners of 13 benefitting parcels totaling 239 .49 gross acres . The cost per acre for benefitting parcels wishing to connect will be $428 . 33 per gross acre plus interest at a rate of 7% per annum. LEGAL IMPACT Acceptance of the subject improvements and the easements will `I result in the transfer of ownership and control of the im- provements to the City. The City will enforce the recapture ordinance and collect funds from benefitting parcels wishing to connect . Said funds shall be forwarded to Safety-Kleen Corp. or its successors . ALTERNATIVES None . RECOMMENDATION It is recommended that the City Council accept the Safety- Kleen sanitary sewer and easement and direct staff to execute the necessary documents . It is further recommended that City Council adopt an ordinance whereby Safety-Kleen Corp. may recover the construction costs of the sanitary sewer from benefitting parcels . spectfully submitted, J+Ice A .
