HomeMy WebLinkAbout98-1 Resolution No. 98-1 RESOLUTION AUTHORIZING EXECUTION OF AN EMPLOYMENT AGREEMENT WITH JOEL PEREZ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an employment agreement on behalf of the City of Elgin with Joel Perez for gang intervention services, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: January 14, 1998 Adopted: January 14 , 1998 Omnibus Vote: Yeas 4 Nays 1 Attest: S/ Dolonna Mecum Dolonna Mecum, City Clerk EMPLOYMENT AGREEMENT This agreement is hereby made and entered into this 15th day of January, 1998, by and between the City of Elgin, Illinois, a municipal corporation (hereinafter referred to as "City" ) , and Joel Perez (hereinafter referred to as "Perez" ) . WHEREAS, City desires to employ Joel Perez as a Gang Intervention Supervisor during the term of this agreement; and WHEREAS, Joel Perez is willing and able to accept appointment as City' s Gang Intervention Supervisor upon certain terms and conditions; and NOW THEREFORE, in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby acknowledged, the parties hereto hereby agree as follows : 1) Perez shall be employed by City during the term of this agreement as a Gang Intervention Supervisor under the terms and conditions contained herein. 2) Perez shall coordinate gang intervention and prevention programs and various youth and teen activities, and shall perform such other duties as directed by City' s Parks and Recreation Director in such manner and during such times as City' s Parks and Recreation Director shall designate. Perez ' s duties shall include, but not be limited to: a. Be responsible to the Recreation Superintendent. b. Manage and coordinate youth and teen programs for the Elgin Parks and Recreation Department. c. Prepares budgets and administers programs within the adopted budget guidelines of the Recreation Division. d. Keep accurate financial records and demonstrate sound fiscal control of all recreation programs. e. Plans, organizes, promotes, supervises and evaluates year round recreation programs specific to youth and teens. Make recommendations and introduces new activities and events . f. Develops specific goals and objectives relating to program content. g. Prepares and maintains records and accounts of attendance, inventory, financial charges, receipts, personnel evaluations, accidents and other related data. h. Works closely with schools, the public, business organizations, public housing and other recreation organizations in coordinating cooperative programming, and generating interest and participation by youth and teens . i . Promotes recreation programs in the community by preparing flyers, news releases, posters, photographs and brochures . j . Maintains inter-departmental communications within the department' s organizational structure. k. Perform other related work as assigned by the Recreation Superintendent. 3) The following goals shall be reviewed on a quarterly basis with City' s Recreation Superintendent: a. 100% of work time shall be spent coordinating programs for the Elgin Parks and Recreation Department with 50% of those programs coordinated through the Elgin Recreation Center. b. Work with the City Youth and Teen Program Supervisor to establish contact with the U46 school district and coordinate cooperative programming with a minimum of the middle schools . c. Establish a minimum of two cooperative programs with each youth/teen recreation agency in Elgin; Boys and Girls Club, YWCA, Salvation Army, etc. d. Establish contact with Housing Authority and public housing projects to coordinate cooperative programming, transportation to programs, etc. e. Coordinate a minimum of six (6) cooperative youth/teen programs with the Elgin Parks and Recreation Department at the Elgin Recreation Center. 4 ) City shall provide Perez with the following during the term of this agreement: a. Per annum base rate of $32,462 effective on January 1, 1998, to be paid in equal biweekly installments throughout 1998. In addition, a salary increase equivalent to Management Class C employees will be issued at such time that manage- ment increases are approved by City Council . b. Class C benefit package which shall include fully paid comprehensive group major medical insurance for the Supervisor and dependents; but shall not include 401 retirement plan participation. 5) Perez shall be subject to and governed by City' s personnel rules and regulations . 6 ) Perez hereby warrants and represents that his relationship with ERC shall not interfere or in any way otherwise preclude or prevent him from fully performing his obligations and duties to City pursuant to this agreement. He will not receive payment from ERC. 7 ) This agreement may be terminated by either party hereto for any reason upon ninety (90) days written notice. 8) The term of this agreement shall commence on January 1, 1998, and shall terminate on December 31, 1998 . 9 ) This agreement shall be subject to and governed by the laws of the State of Illinois. 10) The terms and provisions of this agreement shall be severable. In the event that any of the terms or provisions of this agreement shall be deemed to be void or otherwise unenforceable for any reason, the remainder of this agreement shall remain in full force and effect. 11) This agreement constitutes the entire agreement between the parties hereto. There are no other verbal or written understandings or agreements between the parties hereto. Any modification or amendment to this agreement shall be written and signed by the parties hereto, or shall be ineffective. Malm, Interim City Manager SUBJECT: Employment Agreement with Gang Intervention Program Supervisor PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider the renewal of the employment agreement for the Parks and Recrea- tion Department ' s Gang Intervention Program Supervisor for 1998 . BACKGROUND e'" The City has employed a Gang Intervention Program Supervisor € since January 24, 1996. Since that time, Joel Perez has been under the supervision of the Recreation and Facilities Super- intendent working closely with the Recreation Division staff . Joel plans cooperative programs with other youth-serving agencies, the schools, business organizations, and the public. Joel ' s association with the City has helped him build a stronger, more successful relationship with many youth-serving agencies and expanded program offerings for Elgin' s youth and teens . Moreover, Joel works with several members of the Police Department in dealing with serious gang issues . Mr. Perez ' s current employment agreement expires on December 31, 1997 . A renewal of an agreement for 1998 would include a salary of $32, 462, which is the same as this year when the bonus incentive is added to base earnings . This agreement would also include a salary increase equivalent to Management Class C employees when increases for exempt positions are approved by the City Council . ALTERNATIVES The alternative for this proposal would be to not renew the contract of the Gang Intervention Program Supervisor. RECOMMENDATION It is recommended that the Gang Intervention Program Supervi- sor contract for Joel Perez be renewed for 1998 .
