RESOLUTION
AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT WITH
THE KANE COUNTY FOREST PRESERVE DISTRICT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Robert O. Malm, Interim City Manager, and
Dolonna Mecum, City Clerk, be and are hereby authorized and
directed to execute an Intergovernmental Agreement on behalf of
the City of Elgin with the Kane County Forest Preserve District
for the Otter Creek Lift Station and Far West Area Development,
a copy of which is attached hereto and made a part hereof by
reference.

INTERGOVERNMENTAL AGREEMENT
City of Elgin and the
Kane County Forest Preserve District
This Agreement made and entered into this /7A. day
of De-cEm Ben. , 1997, by and between the City of` Elgin, a
Municipal Corporation of the Counties of Cook and Kane, in the
State of Illinois, hereinafter referred to as the "CITY" and
the Kane County Forest Preserve District, in the State of
Illinois, hereinafter referred to as the "DISTRICT" . The
agreement is a local government property transfer (50 ILCS
6/5-10 .01 et seq. ) .
WHEREAS, the CITY and the DISTRICT want to preserve
and enhance natural areas, encompassing woodlands, ponds,
wetlands, flood plains, watercourses, and areas of steep slope
as natural systems for stormwater control, soil erosion
control, wildlife habitats, passive and recreation and scenic
vistas;
WHEREAS, the CITY and the DISTRICT want to provide
for the introduction of other open spaces and parkways linking
the natural areas for passive and active recreation;
WHEREAS, as partial consideration for this agreement
the CITY has proposed to the DISTRICT the implementation of
various open space preservation measures and setbacks; and
WHEREAS, to the extent the CITY may lawfully do so
the various open space preservation measures and setbacks
provided for in this agreement shall be negotiated for by the
CITY in annexation agreements annexing the various properties
encompassed by this agreement.
NOW, THEREFORE, in consideration of the mutual
covenants contained herein; the CITY and the DISTRICT agree as
follows :
1. The foregoing recitals are hereby incorporated
into this agreement in their entirety.
2 . Land Area Encompassed. The CITY and the
DISTRICT agree that the land area encompassed in this agreement
shall be the land area which is located within both the Otter
Creek watershed and within the Elgin Planning Area, as defined
by the Far West Area Plan, An Amendment to the Official
Comprehensive Plan of Elgin, Illinois, ( 1983) , as amended; and
as illustrated on Exhibit 1 .
3 . Open Space - Generally. To the extent it may
lawfully do so, the CITY agrees to require the preservation and
enhancement of natural areas through dedication of lands as
open space to the CITY or to the DISTRICT, encompassing
woodlands, ponds, wetlands, flood plains, watercourses, and

areas of steep slope as natural systems for stormwater control,
soil erosion control, wildlife habitats, passive recreation,
and scenic vistas; and to require the introduction of other
open spaces and parkways, linking the natural areas for passive
and active recreation.
4 . Open Space Adjoining Watercourses - Generally.
The CITY and the DISTRICT agree that the minimum amount of open
space to be preserved and maintained along watercourses shall
be the flood plain as identified on the current Flood Insurance
Rate Map or Floodway Boundary Map prepared by the Federal
Emergency. Management Administration; plus an additional fifty
(50) feet of open space to be used exclusively for pedestrian
access and related improvements, indigenous landscaping,
approved stormwater management facilities, or approved
underground facilities, such as sanitary sewers and watermains;
or the minimum amount of open space shall be that land area
bounded by lines that are located one hundred twenty-five ( 125)
feet from and on both sides of the center line of the
watercourses; whichever is greater.
5 . Building Setbacks .
a. The CITY shall require a one hundred (100)
foot building setback from all woodlands, ponds, and . wetlands
with the first fifty (50) feet adjoining such natural features
to be used exclusively for pedestrian access, indigenous
landscaping, or approved stormwater management facilities .
b. The CITY shall require a fifty (50) foot
building setback from the open spaces adjoining all
watercourses referenced in section 4, above.
6 . Pathways . The CITY will extend sanitary sewer
lines in selected open space areas along watercourses as
generally illustrated on Exhibit 2 . The CITY agrees to build
and pay for the construction of a paved, public pathway system
following the sanitary sewer lines in order to provide
maintenance access and to provide public access linking the
various elements of the CITY' s planned open space system.
Paved pathways shall be constructed within one ( 1) year of the
completion of sanitary sewer construction and conveyed to the
DISTRICT in fee simple title. After conveyance to the DISTRICT
the pathways shall be maintained and operated by the DISTRICT.
7 . Land Transfers and Land Use.
a. The DISTRICT shall transfer title to the real
estate legally described in Exhibit 3 to the CITY within one
hundred twenty (120) days following the execution of this
Memorandum of Agreement. Prior to closing the CITY shall
obtain at its own cost a survey of the real estate property
being conveyed to the CITY confirming the legal description and

a title commitment showing title to the real estate being held
by the DISTRICT.
b. The CITY and the DISTRICT agree that the CITY
shall use the real estate referenced above in paragraph 7 .a as
a site for sanitary sewer pump station. Further, the CITY
agrees that activities on the site shall be limited to those
traditionally and customarily associated with a sanitary sewer
pump station, and that the site shall not be used for general
storage of vehicles and equipment.
c . The CITY and the DISTRICT agree that the CITY
shall have the sanitary sewer pump station designed and
constructed in general conformance with the building elevation
attached as Exhibit 4 .
d. The CITY agrees to transfer title to the
DISTRICT in fee simple of all wetland and watercourse open
space areas dedicated to the CITY, including the pathways, and
not planned for use as CITY parks .
8 . The CITY shall indemnify and hold harmless the
DISTRICT from and against any and all claims, causes of action,
liabilities, costs and damages of every kind that may be
asserted against the DISTRICT as a result of the various open
space preservation measures and setbacks to be imposed by the
CITY pursuant to this agreement. The DISTRICT shall provide
prompt notice to the CITY of any such claims and shall tender
same to the CITY for defense.
This agreement shall be binding upon and insure to
the benefit of the parties hereto, their successor, and assigns
for a term of forty (40) years .

SUBJECT: Intergovernmental Agreement with Kane County for
Otter Creek Lift Station and Far West Area
Development
PURPOSE
The purpose of this memorandum is to provide the Mayor and
Members of the City Council with information regarding a
proposed intergovernmental agreement between the city and Kane
County.
BACKGROUND
On August 14 , 1996, the Elgin City Council adopted the Far
West Area Plan, an amendment to the Elgin Comprehensive Plan.
The Far West Area Plan and Kane County' s 2020 Land Resource
Management Plan include many common objectives . Principal
among these similarities is a desire to pursue development
patterns that differ from the typical suburban sprawl form of
development .
The Far West Area Plan reflects the city' s intention to
encourage more sensitive and balanced development through the
extension of municipal water and sanitary sewer systems,
thereby permitting higher localized densities for prime
development sites while discouraging development of any kind
on sensitive lands . The Land Design section of the Far West
Area Plan in general and the open space policies in particular
set the basic guidelines for development .
The Far West Area Plan open space guidelines have formed the
conceptual basis for a proposed intergovernmental agreement
between the City of Elgin and Kane County (copy attached) . An
element of this agreement would include the dedication of an
approximately four (4) acre portion of property owned by Kane
County (the former Blume Property) as a location for the Otter
Creek sanitary sewer pump station. The City would commit to

following the open space policies embodied in the Far West
Area Plan and providing for a paved pathway system along
creekside open space corridors .
Adherence to the adopted open space policies could result in a
pedestrian/bike path linkage system throughout the Otter Creek
drainage basin. Based on existing city policy and past
experience, it is likely that most land developers will seek
to dedicate these linear open space areas to the Kane County
Forest Preserve District on a voluntary basis .
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
Elgin area members of the Kane County Board have been apprised
of the status of the proposed agreement throughout the course
�" of its negotiation and review.
X if�'� FINANCIAL IMPACT
(�� The agreement provides that the City (or developers as the
City is able to negotiate) be responsible for costs associated
with the construction of a paved pathway system paralleling
sanitary sewer lines to be installed in open space areas
III adjacent to watercourses throughout the Otter Creek watershed
(Exhibit 1 of the agreement) and for costs of obtaining a
survey and title commitment for the parcel of land that the
County will convey to the City for the sanitary sewer pump
station.
The Five-Year Financial Plan anticipates that the majority of
the Bowes Road Interceptor Sewer system (Otter Creek area)
will be constructed by the private sector as land development
demand dictates . The paved pathway system would serve as an
open space linkage and as a maintenance access road for
sanitary sewers . As such, the majority of the pathway system
could be installed by land developers as they extend elements
of the sanitary sewer system in the Otter Creek drainage
basin. If this policy is pursued, most of the costs for the
pathway system would be borne by land developers . The city' s
costs for a survey and title commitment should be approximate-
ly $2, 500 . 00 . The approved Otter Creek pump station project
budget (Account #396-4200-795 . 92-32, Project #339505) contains
sufficient funds to cover the survey and title costs .
LEGAL IMPACT
The Intergovernmental Agreement has been reviewed by the Legal
Department .

ALTERNATIVES
The City Council could choose to reject the intergovernmental
agreement and attempt to purchase the county land or some
other site for the Otter Creek pump station.
RECOMMENDATION
With respect to provisions regarding land use development, the
proposed agreement commits the city to following already
adopted policies incorporated in the Far West Area Plan.
Provisions of the agreement regarding transfer of certain open
space areas to the County reflect the City' s limited ability
to manage wetlands and linear open space connecting several
municipalities . The staff recommends approval of the proposed
agreement.
