Malm, Interim City Manager SUBJECT : Amendment No. 2 and Final Payment to HNTB Corporation for Engineering Services in Conjunction with the Construction of the Randall Road Elevated Tower PURPOSE The purpose of this memorandum is to provide the Mayor and eik members of the City Council with information to consider awarding Amendment No. 2 and final payment to the agreement for engineering services with the consulting firm of HNTB Corporation, Chicago. BACKGROUND On May 25, 1994, a contract was awarded to HNTB for prepara- tion of engineering plans and specifications for the one million gallon Randall Road elevated tower. The project was released for construction on March 7 , 1996. Amendment No. 2 to the contract with HNTB is warranted due to the additional services provided based on the following: 1 . Time associated with the delay in paint application to the elevated water tank due to weather conditions in April and May 1997 . 2 . A manufacturer' s defect in the transmitter located at the water tank resulted in a delay in the final testing of the electrical and telemetry equipment . Due to the above time extension, HNTB provided additional construction engineering services after May 6, 1997, in the low amount of $4, 500 . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None . Amendment No. 1 was paid through the Water Fund' s portion of the 1996 bond sale, account number 396-4000-795 . 92-36, project number 409517 . The amount of Amendment No. 2 is $4, 500 and will' be funded from account number 396-4000-795 . 92-36, project number 409517 (Randall Road Tower) , where sufficient money is available for this expenditure . LEGAL IMPACT ANone. ALTERNATIVES None. RECOMMENDATION It is recommended that the City Council authorize the execu- tion of Amendment No. 2 to the agreement for engineering services with HNTB Corporation and final payment for $4, 500 . We have, under separate cover, provided the final completion and final payment documents for the construction phase of the project. By this letter and attached amendment we are submitting the final change order for the /A�► engineering services agreement between Elgin and HNTB. As we agreed, the amount of this amendment is $4,500. As background in support of this amendment, we offer the following information. Due to the timing of the award of the construction contract and the schedule for steel fabrication and erection, by the time the tank was ready for painting,the ambient temperature was too low to apply the specified coatings. An unusually cool and wet spring forced the contractor to delay painting until the end of May. Additionally, a defective transmitter at the tank delayed the final testing of the telemetry and electrical equipment. As a result,the projected date for final completion slipped approximately 17 weeks. The additional fee requested represents the added cost in labor and expenses incurred by HNTB for construction supervision during this time.
