HomeMy WebLinkAbout97-258 Resolution No. 97-258 RESOLUTION AUTHORIZING EXECUTION OF AN EMPLOYMENT AGREEMENT WITH JOYCE PARKER BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Kevin Kelly, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an employment contract on behalf of the City of Elgin with Joyce Parker for employment as City Manager, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: October 22, 1997 Adopted: October 22, 1997 Omnibus Vote: Yeas 7 Nays 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk EMPLOYMENT CONTRACT In consideration of the compensation and other considerations made by the City of Elgin, Joyce Parker agrees to act as City Manager for the City of Elgin and to carry out to the best of her ability all the duties imposed upon that office by the statutes of the State of Illinois and the ordinances of the City of Elgin. 1 . This agreement is for an indefinite term and may be terminated by Joyce Parker upon written notice, to the Mayor and Members of Council at least twenty-eight (28) days before, but not more than forty-five (45) days before the effective date of said notice of termination, unless otherwise agreed by City of Elgin. This contract may be terminated by the City acting through its corporate authorities . 2 . Joyce Parker shall commence employment on or before January 1, 1998 at an annual salary of $116,000 .00 . A salary review shall be conducted based upon Joyce Parker's performance on January 1, 1999 and annually thereafter. 3. The City of Elgin shall, in addition to employer contributions to the Illinois Municipal Retirement Fund, provide for and contribute the sum of $7,500. 00 annually, as deferred compensation allocated as directed by Joyce Parker to qualified retirement plans . 4 . In addition to the employer's required contribution to the Illinois Municipal Retirement Fund, City of Elgin shall pay employee's required contribution to the Illinois Municipal Retirement Fund; however City of Elgin's payment of such employee's contribution shall be limited to two percent (2%) of Joyce Parker's earnings subject to such contribution until January 1, 1999; thereafter such payment shall be limited to four and one-half percent (41%) of Joyce Parker's earnings subject to such contribution. 5. The City of Elgin shall lease a mid-sized automobile for use by Joyce Parker and shall pay all expenses related to its use by Joyce Parker. 6 . The City of Elgin shall pay all expenses associated with moving Joyce Parker' s furniture, . household goods, and personal possessions to Elgin; Joyce Parker shall obtain three estimates of moving expenses from reputable experienced movers and employ the lowest qualified bidder for such purposes. 7 . City shall pay Joyce Parker the sum of $1,000. 00 per month as a temporary housing allowance for a period not to exceed six months following her commencement of employment; additionally Joyce Parker shall be credited with a bank of ten ( 10) days for her personal use associated with relocation from the State of Michigan. 8. Upon termination of employment from the Office of City Manager by City of Elgin, Joyce Parker shall receive as severance pay an amount equal to three quarters of her annual salary; if terminated prior to January 1, 2000, thereafter upon termination severance pay equal to one half of Joyce Parker's annual salary shall be paid. 9 . Joyce Parker shall be entitled to four weeks of vacation. 10. City of Elgin shall obtain dental insurance with coverage for Joyce Parker's family and shall pay the cost of such insurance. 11 . City of Elgin shall pay the costs not to exceed the sum of five hundred dollars ($500. 00) of a physical examination of Joyce Parker biennially. 12 . To the extent it may lawfully do so, City of Elgin shall defend, save harmless and indemnify the City Manager from any tort, professional liability claim or other legal action, whether groundless or otherwise, arising out of an alleged act or omission occurring in the performance of the City Manager's duties as City Manager. 13. Except as modified by the terms and provisions contained herein, Joyce Parker shall be entitled to all other 2 r benefits and privileges afforded to Class A management level employees under applicable ordinances of the City of Elgin. IN WITNESS WHEREOF, the City of Elgin has caused this agreement to be executed by its Mayor and duly attested by its City Clerk; Joyce Parker has executed this agreement, and it shall be in full force and effect upon its execution.
