RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
RON BAKER PAINTING, INC. FOR 1995 TRAFFIC SIGNAL PAINTING
WHEREAS, the City of Elgin has heretofore entered into a
contract with Ron Baker Painting, Inc . for 1995 traffic signal
painting; and
WHEREAS, it is necessary and desirable to modify the terms
of the contract as is described in Change Order No. 1, attached
hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Robert 0. Malm, Interim City
Manager, be and is hereby authorized and directed to execute
Change Order No. 1, a copy of which is attached hereto and made
a part hereof by reference.

TRAFFIC SIGNAL PAINTING- 1995
CHANGE ORDER NO. 1
October 9, 1995
SCOPE: This Change Order No. 1 will include the adjustment in quantities and additions
to the awarded quantities to complete the project in a satisfactory and acceptable manner.
The contractor for this project was Ron Baker Painting, Inc., 40W731 Plank Road,
Hampshire, IL 60140.
REASONS FOR CHANGE: This Change Order No. 1 is necessary due to adjustment in
quantities and additions of some items not in the original contract on an agreed price basis.
The agreed price was considered reasonable by the staff.
The contract called for all traffic signal equipment to be painted Imperial Bronze. The
work was already in progress when it was determined that several traffic signal controllers
were damaged by a combination of high internal cabinet temperatures in aluminum
cabinets.
For several years the Illinois Department of Transportation(IDOT) has not painted their
aluminum traffic signal controller cabinets, preferring to retain the heat reflective
characteristics of the cabinets' natural aluminum finish.
Accordingly, this year's traffic signal painting contract was changed and the contractor
was required to remove all existing paint form the aluminum cabinets. There was one steel
cabinet which was painted with two coats of aluminum paint.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original bid price from
Ron Baker Painting, Inc. was $22,000.00. Due to the adjustments in quantities and
additions, the total project cost was$24,800.00 or$2,800.00 more than the bid price.
The adjusted quantities and the prices are as shown in the table below:

The total approved amount for this project is$22,000.00. By reason of this Change Order
No. 1, the total cost of the Traffic Signal Painting- 1995,with Ron Baker Painting, Inc.
will be increased by Two Thousand and Eight Hundred 00/100 Dollars($2,800.00).
OTHER CONTRACT PROVISIONS:All other contract provisions will remain the
same.

SUBJECT: Change Order No. 1, Final Payment and Acceptance
1995 Traffic Signal Painting
PURPOSE
The purpose of this memorandum is to provide the Mayor and
members of the City Council with information to consider the
approval of Change Order No. 1 to accept the completed work
and to authorize the final payment for the 1995 Traffic Signal
Painting Project.
BACKGROUND
The City Council awarded the contract for this project to Ron
Baker Painting, Inc. of Hampshire, Illinois at their meeting
of July 27, 1995 . The project consisted of painting fourteen
traffic signals .
The original contract approved by the City Council was for
$22, 000 . 00 . Due to some adjustment in quantities and addi-
tions of some items not in the original contract, the total
value of the completed project amounted to $24, 800 . 00 .
This change order was originally submitted to the City Council
for approval at the Committee of the Whole Meeting on October
25, 1995. An objection was presented at that meeting regard-
ing the quality of work performed by Ron Baker Painting, Inc .
As a result, the City Council tabled payment when it appeared
on the Regular agenda.
Testing Services Corporation was contracted to test the
thickness of the new paint applied at all of the sites in-
volved in this contract. The results of this testing indicat-
ed that the paint thickness at four intersections did not meet
the manufacturer' s recommended thickness for two coats of
paint. It was not possible to determine if only one thick
coat of paint or two thin coats of paint had been applied.
Regardless, because the paint thickness did not meet the paint
manufacturer' s recommended thickness for two coats, Ron Baker
Painting was required to repaint the four intersections
involved. The repainting has been completed. The four
rift intersections were retested and the paint thickness met or
exceeded the recommended thickness .

The funding for the 1995 Traffic Signal Painting project was
included within Account 010-3322-753. 92-85, Project No.
339543, budgeted in the amount of $24, 000 . 00 . The total
project cost, including additions and deductions, is
$24,800 . 00, or $800 . 00 over the budgeted amount. Payouts
totaling $22 ,000 . 00 have been completed. The remaining amount
of $2,800 . 00 is available in Account No. 010-3321-753 . 40-09
which is designated for traffic signal painting.

RECOMMENDATION
it is recommended that City Council authorize execution of
Change Order No. 1 in the amount of $2,800 . 00 and direct staff
to execute the change order document. It is further recom-

authorize the final payment of $2 , 800 . 00 to Ran Baker Paint-
ing, Inc.
