Malm, Interim City Manager SUBJECT: Acceptance of a Grant from the Bureau of Justice Assistance PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information for the accep- tance of a grant from the U.S . Department of Justice, author- ization of matching funds and formation of an advisory board. BACKGROUND The United States Department of Justice, Bureau of Justice Assistance, has authorized a grant award to the City of Elgin for $83,521 to reduce crime and improve public safety. The Grant is issued as a result of a Federal Local Law Enforcement Grant program and has specific requirements for the use of this money. The requirements are: 1) A local match of $9,280 2 ) Formation of an advisory board to consider how the money should be spent. The board must be comprised of repre- sentations from the following groups : a) the Police Department b) the Local Prosecutor' s office c) the Local Court System d) the Local Public School e) a local nonprofit,educational, religious or community group active crime prevention or drug use prevention or treatment 3) Audit requirements This grant was originally awarded in September of 1996 but was not received until a second copy was requested and delivered in December of 1996 . FINANCIAL IMPACT The local match of $9,280 is available within the overall 1997 Police Department budget. The grant requires that a separate fund and account be established. Additional audit work would need to be performed by the City' s independent auditors at an estimated cost of $500 . LEGAL IMPACT The Grant proposal has been reviewed and confirmed that the City is in compliance with all federal anti-discrimination laws . ALTERNATIVES The Mayor and members of the City Council may choose not to accept this grant. RECOMMENDATION it is recommended that the City Council authorize the Mayor to A7) accept this grant and approve the necessary matching funds . The recipient agrees to submit, at a minimum, semi-annual reports on its programmatic activities . The first programmatic report will be due on January 30, 1997, covering the period of October - December, 1996. The next report will be due on July 31, 1997 and cover the period of January - June, 1997 . The next report should cover the next six month period and is due thirty (30) days after the end of the six month period for the life of the grant. A final report on the programmatic activities is due 120 days following the end of the grant period. 8 . . The recipient agrees to establish a trust fund in which the Bureau of Justice Assistance will deposit all payments received under this award. For the purposes of this grant, a trust fund is an interest bearing account that is specifically designated for this Program. This fund may not be utilized to pay debts incurred by other activities beyond the scope of the Local Law Enforcement Block Grants Program. The recipient agrees to submit quarterly financial reports. The financial report is due 45 days after the end of each calendar quarter. The recipient acknowledges that failure to submit an acceptable Equal Employment Opportunity Plan (if recipient is required to submit one pursuant to 28 CFR 42 .302) , that is approved by the Office for Civil Rights, is a violation of its Certified Assurances and may result in the suspension of the drawdown of funds . 12 . The recipient agrees, if the funds are used for the hiring and employing of new, additional law enforcement officers and support personnel, as described in the applicable purpose area of Subpart A section 101 (a) (2) , that the recipient and/or unit of local government will achieve a net gain in the number of law enforcement officers who perform nonadministrative public safety service. 13 . The recipient agrees, if the funds are used for the hiring and employing of new, additional law enforcement officers and support personnel, that the recipient or units of local government will establish procedures to give members of the Armed Forces who, on or after October 1, 1990, were or are selected for involuntary separation (as described in section 1141 of title 10, United States Code) , approved for separation under section 1174a or 1175 of such title, or retired pursuant to the authority provided under section 4403 of the Defense Conversion, Reinvestment, and Transition Assistance Act of 1992 (division D of Public Law 102-484; 10 U.S.C. 1923 note) , a suitable preference in the employment of persons as additional law enforcement officers or support personnel using funds made available under this Program. 0.71, FORM 4000/2 (REV. 5-87) PREVIOUS EDITIONS ARE OBSOLETE. The recipient agrees if funds are used for enhancing security or crime prevention, that the unit of local government -- (a) has an adequate process to assess the impact of any enhancement of a school security measure that is undertaken under subparagraph (B) of section 101 (a) (2) , or any crime prevention programs that are established under subparagraphs (C) and (E) of section 101 (a) (2) , on the incidence of crime in the geographic area where the enhancement is undertaken or the program is established; (b) will conduct such an assessment with respect to each such enhancement or program; and (c) will submit to the Bureau of Justice Assistance an annual written assessment report. 15. The recipient agrees that prior to the obligation of funds at least one (1) public hearing will be held regarding the proposed use of the payment under the Local Law Enforcement Block Grant in relation to its entire budget. At the hearing, persons shall be -given an opportunity to provide written and oral views to the unit of local government about the entire budget and the relation of the Grant to the entire budget. The recipient will hold the public hearing at a time and place that allows and encourages public attendance and participation. 16 . The recipient agrees that prior to the obligation of any funds received under the Local Law Enforcement Block Grants Program, it shall establish or designate an advisory board. While membership on the advisory board may be broader, it must include a representative from -- (a) the local police department or local sheriff ' s department; (b) the local prosecutor' s office; (c) the local court system; (d) the local public school system; and (e) a local nonprofit, educational, religious or community group active in crime prevention or drug use prevention or treatment. Enclosed in this package are a number of materials which need your attention, in order that we might be able to provide you with a full measure of service and further to ensure that you receive your grant funds in as timely a fashion as is practical. To that end, we ask that, within 30 days of receipt, the Chief Executive Officer of your jurisdiction counter-sign both the enclosed award document as appropriate in box number 19, and the special conditions at the bottom of page six, and return a copy to the LLEBG Control Desk, Room 304-C, Financial Management Division, Office of the Comptroller. Office of Justice Programs, 633 Indiana Avenue, NW, Washington, DC 20531. Execution of these documents denotes the official grantee acceptance of the award, and the grantee's agreement to comply with the attached special conditions. You will also note we've included a separate, one-page form titled, "Request for Payment". The form is on colored paper. In order for the Office of Justice Programs, Office of the Comptroller to release LLEBG funds for deposit into your Trust Account, the Chief Executive Officer of your jurisdiction must sign and return this form to the same address noted above. Payment will be made within 30-days of our receipt of the signed, returned form. In addition to your award document and special conditions, and Request for Payment form, we have included the following program-related materials: • An LLEBG Division Bulletin (goldenrod) which includes our mailing address, the main Division phone and fax lines, and an LLEBG Division Organization Chart which delineates our regional alignment and staff deployment. Any questions about your particular grant should be directed to the staff person assigned to your state as indicated in the LLEBG Bulletin; • An LLEBG Application Evaluation Form (blue) containing a number of questions about which medium you chose to use in applying for funds. This information will be particularly helpful to us in future years' LLEBG application and award processes, as well as in the Bureau of Justice Assistance's (BJA) overall efforts to improve and automate these processes. We as that you complete the Application Evaluation Form and submit it at the time that you submit the signed Award and Special Conditions to the LLEBG Control Desk; and, • The one-page, "Follow-up Information Form," which is to be completed and returned to the LLEBG Control Desk, once your jurisdiction has complied with Special Conditions 15 and 16, Advisory Board and Public Hearing, respectively. It is only upon compliance with both of these conditions that your jurisdiction may obligate and expend funds. We have included an instructions package to guide you in completing the Follow-up Information Form. Within the next 30 days you can expect to receive a variety of additional materials from us, aimed to assist you as you implement your LLEBG-supported programs. Among these are a • "Program Guidance Document." which will describe eligibility and program requirements in some detail, and a preliminary "Technical Assistance Compendium and Resource Guide." Currently arranged by Legislative Program Purpose Area, the Compendium is meant to provide an overview of technical assistance and training resources and publications available through the Bureau of Justice Assistance and other sources. We are developing a matrix which will provide another level of detail in terms of the actual source(s) of the assistance, e.g. BJA. the Community Oriented Policing Services Office; which resources are at no cost to the requestor vs. those which are fee-for-service; and the process for requesting the technical assistance. In addition, we are completing the requisite reporting forms which will be submitted to BJA by each grantee semi-annually, and will enable us to report back to you, the Attorney General, the Congress, and the public-at-large, on the successful implementation of this program nationally.
