RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
R. W. DUNTEMAN CO. FOR KIMBALL STREET BRIDGE PROJECT
WHEREAS, the City of Elgin has heretofore entered into a
contract with R. W. Dunteman Co. for the Kimball Street bridge
project; and
WHEREAS, it is necessary and desirable to modify the terms
of the contract as is described in Change Order No. 1, attached
hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Robert 0. Malm, Interim City
Manager, be and is hereby authorized and directed to execute
Change Order No. 1, a copy of which is attached hereto and made
a part hereof by reference.

CHANGE ORDER No. 1
SCOPE: This Change Order No. 1 will provide additional items necessary to complete the
handrail and parapet wall enhancements for the Kimball Street Bridge.
The general contractor for this project is R.W. Dunteman Co. of Addison, IL.
REASONS FOR CHANGE: This Change Order No. 1 will add additional quantities to the
contract for enhancement of the parapet walls and handrails on the Kimball Street Bridge.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount the contract will be
revised is as follows:

The original contract with R.W. Dunteman Co. is $5,422,038.75. By reason of Change Order
No. 1, the contract for the Kimball Street Improvements Project will be increased in the amount
of two hundred fifty-four thousand five and 07/100 dollars ($254,005.07). The new contract
amount, inclusive of Change Order No. 1 is five million six hundred seventy-six thousand forty-
three and 82/100 dollars ($5,676,043.82).

SUBJECT: Change Order No. 1 to the Contract with
R.W. Dunteman Co. for the Kimball Street
Improvements Project
PURPOSE
The purpose of the memorandum is to provide the Mayor and
members of the City Council with information to consider
Change Order No. 1 for the subject project.
BACKGROUND
elk The City Council, at its February 26, 1997 meeting, awarded
to R.W. Dunteman Co. the contract for the Kimball Street
Improvements Project (Agenda Memo attached as Exhibit A) . At
the City Council 's April 9, 1997 meeting, a handrail
enhancement alternative was selected (Agenda Memo attached as
Exhibit B) for the Kimball Street Bridge, and the engineer
for the project, RUST E&I, was directed to proceed with
design of the selected alternative.
After completion of the handrail design, RUST E&I submitted
this information to R.W. Dunteman Co. for unit pricing. R.W.
Dunteman then submitted a overall price of approximately
$320,000 for the handrail enhancement. Rust E&I then
reviewed the submitted unit prices and determined that some
items were high as compared to contract unit prices. After
further negotiation, this price was lowered to approximately
$254,000. RUST E&I 's original estimate for this work was
$220,000. RUST E&I is recommending that the City accept the
negotiated unit prices with R.W. Dunteman & Co. for the
handrail enhancements (Recommendation attached as Exhibit C) .

FINANCIAL IMPACT

To date $19,442 and $220, 000 in Riverboat Lease and Riverboat
Funds has been set aside for railing design and construction,
respectively. ,Additional moneys totaling $34,005 are
available from unprogrammed 1996 Riverboat Lease funds to
finance the total construction change order of $254,005 . 07 .

None.
ALTERNATIVES
Option 1 : Construct the handrail and parapet wall as
originally designed resulting in no additional
costs to the contract.
Option 2 : Accept the negotiated unit prices for the handrail
and parapet wall enhancements and authorize Change
Order No. 1 in the amount of $254,005. 07 (copy
attached as Exhibit D) .
Option 3 : Authorize the handrail and parapet wall
enhancements under a force account (time and
material) basis. This option is not recommended by
the engineer because it could potentially result in
a final price much higher than the negotiated
change order price.
RECOMMENDATION
It is recommended that City Council authorize execution of
Change Order No. 1 to the contract with R.W. Dunteman Co. in
the amount of $254,005 . 07 and direct staff to instruct R.W.
Dunteman & Co. to proceed with the handrail and parapet wall
enhancements.

Bridge Improvements-Change Order No. 1
Dear Steve:
Attached please find a summary of the changes associated with the modifications to the bridge parapets on the
Kimball Street Bridge. The attached table reflects adjustments to existing wuLr ct ill=s and the addition of new
items necessary for the designed modifications.
r. Utilizing R.W. Dunteman's supplied agreed unit prices the amount of this proposed change order is S
254,005.07. Rust's engineers'estimate for this work was approximately$220,000. We are recommending the
. City accept R.W. Dtmteman's proposal for said improvements. Reasons for the contractor's prices being
• different than Rust's estimate arc as follows;
Our estimate for installing the relief pattern did not fully take into account the substantial
amount of extra work required to install this work and as such our estimated unit price for this
work was much lower.
Because the City is uudca w111.1 ua:t with W.Duntcman we cannot go out for competitive bids
for this additional work. Therefore the revised price is ncotiatcd with the contractor. The
contractor originally submitted a price of 5320.000 for this work and we have negotiated it to
the S 254,005.07 we are recommending.
The only other alternate to accepting the attached agreed unit prices would be to perform the work on a force
account(tiruc and mratcri d)basis. We would not recommend this option since it does have the potential to put
the final price for the work much higher than the 5251,005.07. Accepting the agreed unit prices guarantees the
City a maximum not-to-exceed dollar amount for the work
