RESOLUTION
AUTHORIZING EXECUTION OF AN AGREEMENT WITH
BECKLEY BUNNELL PARTNERSHIP FOR A PERFORMANCE BY AMERICA
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Robert 0. Malm, Interim City Manager, be and is
hereby authorized and directed to execute an agreement on
behalf of the City of Elgin with Beckley Bunnell Partnership,
for a performance by America, a copy of which is attached
hereto and made a part hereof by reference.

Producer is Headliner; other acts are also part of Festival.
3. Producer shall receive std star billing in
all advertising and publicity, including, but' not limited to, air time,
newspaper and trade ads, fliers, posters, billboards, marquees, etc.
4. Producer-shall have exclusive control over the production, presentation
and performance of the entertainment-unit in connection with the
engagement hereunder, including, but: not #iffted to, the details, means
and methods of the perfomnance of said engagernent.unit hereunder and
each ffwxd er thereof, and the persons:to be employed by Producer in
performing the provisions herein on -Producer's part to be performed.
All of Purchaser's personnel will be under Purchaser.'s direction.
S. Purchaser shall, at it;s expense, provide the Producer with a rsu
number of security guards for the-Producer's protecd ; A security
arrangements being subject to the Producer's management and personnel.
All of Purchaser's personnel will be under Purchaser's direction.
6. Purchaser shall provide and pay for Producer's internal'%%*Ortation
from the hotel to the venue and return to the hotel:

herein are subject to the detention or prevention by sickness, inability to
perform, accident, means of transportation, Act of God, riots, s *es,
labor difficulties, epidemics and any act or order of any public authority

8. Artist may cancel this engagement without liability by giving Producer
at least thirty (30) days written notice. Any monies received by Producer, Kerry
Management, APA or Bunnell, shall be refunded and Purchaser shall be under no further
obligation:

consent of Producer.
1-4. Producer shall have the sole and exclusive right to sell :souvenir
programs in connectiDn with and at the place of engagement hereunder,,
and the receipts therefrom shall belong exclusively to Producer. Purchaser
agrees that no other program souvenir or phonograph recordings *&ew.
shah- be sold-,or-distributed on connections with
this performance (Subject to house .policy). Purchaser receives 20% of the
gross sale of show related concessions.
15. Purchaser agrees that there shall be no signs, placards, banner's, or
other advertising materials on or near the stage during the entire
performance, and that Producer's appearance shat! not be sponsored by or
in any manner tied in with any commercial product or company.
16. No announcer, master of ceremonies, acts) or persons(s) other than
those indicated by Producer, shall appear w fhout prior written approval
of Producer. In the event Producer does give hls approval for other
elements to appear at this performance, then Producer reserves the right
to determine the length of such performance.
17. No-part, portion, or segment of Producers performance is to be
reproduced, either audio or visually, without the express written
permission of Producer.

employees, contractors, etc., reproduce or cause to be reproduced
Producer's performance In the form of film, tapes, or any other means of
audio or visual reproductions, Purchaser shah pay to Producer the sure of

addition to all other legal remedies which Producer may have.

24. Producer shall have first right of set=up for all instruments and
properties used in the presentation, and the'aforesaid
instruments/properties shall not be moved or relocated without the
express permission of the Production Manager or Producer.
25. Purchaser warrants that he has the right to enter into this contract
and is of legal age.
26. This agreement shall be governed by the laws of the State of Illinois.
27. Admission to the engagement hereunder must not be restricted due to
race, religion, color, creed or elements thereof.

ADDENDUM A - Staging and Technical Requirements
1, AMERICA shall have the first right of set-up for all instruments, properties, scenery, and
other equipment required for the proper presentation of the production. These
aforementioned materials may not be used, moved or relocated withot,.-V the consent of
AMERICA's Production Manager.
II, Purchaser shall furnish and make-available all of the physical equipment that is part of
the permanent equipment of the place of engagement, including the stage and adjacent
work areas, dressing rooms, catering area and related facilities, In addition to all sound,
lighting and band gear as required by AMERICA that may or may not be part of the
permanent equipment of the venue. A minimum of four (4) hours will be required after
the completion of sound and lighting load-ins for complete set-up of AMERICA's
production. Purchaser will also furnish tickets, ticket sellers and takers, ushers,
stagehands, electricians, and security personnel, as well as any required licenses and/or
permits, advertising and publicity for each and every performance of the engagement
hereunder. Purchaser will comply with any and all requirements and regulations of any
labor union(s) having jurisdiction over the materials, facilities and personnel required for
the proper and professional presentation of said performance(s). Purchaser will furnish
and pay for all necessary load-in, set. focus, sound check, rehearsal, performance, strike
and load-out time, as determined by AMERICA.
Ill. The Purchaser will fumish at it's own expense all materials, equipment, personnel,
services and other Items necessary for the presentation of the AMERICA production, -
including, but not limited to, the following: _
A. STAGE: a minimum of 32' wide x 20' deep x 4' high
ROOF (outdoor shows): a minimum of 40' wide x 24' deep x 20' high
SOUND WINGS: 16' wide by 8' deep x 4' high
DRUM RISER: 8' X 8' X 2' high, carpeted, with black skirting.
Stage and wings must be capable of supporting a.load of 2000 lbs. per 4' x 8' section.
Two sets of steps or ramps will be provided, location to be determined by AMERICA's
Production Manager.
NOTE: We understand that these requirements may not always be possible. Please
discuss any limitations of your venue with the Production Manager.
B. POWER -Three (3) completely separate AC services are required:
1. Lighting: 30 208V, 400 amps per leg.
2. Sound: 30 208V, 200 amps per leg.
3. Shore Power 10 220V, 60 amps per leg.
An absolute zero ground potential is imperative. The house electrician must be
present at all times from the stated stage call until all power is disconnected..

III. C. MIXING LOCATION: A 16' wide x 8' deep x 2' high mixing area is to be provided,
located between 75' and 100' from the stage, in the center of the audience area.
For outdoor shows, a weatherproof roof and two (2).20' x 100' rolls of 4-mi!
visquene (plastic) will be provided.
D. SECURITY: A total of ten (10) uniformed security guards are norrhally required.
Two (2) will be posted on each side of the stage.and two (2) at the house mix
position from the time the doors open until the house is cleared after the
performance. Four (4) guards will be posted in the backstage area. All security
personnel will be under the direction of AMERICA's Production Manager.
Reasonable security to be provided.
E. SPOTLIGHTS: Purchaser will provide and pay for two (2) Strong Super Trouper
foilowspots (Xenon or carbon-arc) In good working order.
F. STAGE CALL: A.1:00 PM stage call is normal, but may be changed at the direction
of AMERICA's Production Manager.
G. RUNNER: Purchaser will provide and pay for a runner with a vehicle and valid
driver's license. Said individual will be of legal age to purchase alcohol and
tobacco, and will be made available to Producer from stage call until Producer's
departure after the show.
H. LABOR CALL- Four (4) stagehands will be provided for load-In and set of
AMERICA's production equipment. They will also be required for teardown and
load-out after the show. Callback time will be determined by AMERICA's
Production Manager. These four are in addition to stagehands required by sound
and lighting contractors.
Show call will consist of two (2) deck hands. two (2) followspot operators, one (1)
house light operator, and department heads as may be required.
I. PRODUCTION OFFICE: The Purchaser shall provide a room with a large table, 4
chairs and a telephone with a private line. Said room will be as dose as possible
to the stage.
J. DRESSING ROOM: The Purchaser will provide one (1) large lockable dressing
room, to accommodate nine (9) people. Dressing room should be well lit and have
restroom and shower facilities. Clean and comfortable furnishings (sofa. tables.
chairs, lamps, etc.) are required. AMERICA will not be required to shard this
dressing room.with any other performers or crew. AMERICA's Production Manager
will be provided with the key. See Addendum B for dressing room catering
requirements.
K. PARKING: The Purchaser will be provide parking space for one (1) 45' tour bus.
Shore power will be provided as shown In Ill. B. above.

ADDENDUM B - Catering Rgquirements
1. At stage call - for six (6) people:
A. Hot coffee.
B. Assorted cold sodas.
C. Bottled water. .

NOTE: Drinks must be kept chilled and replenished all day.
Ili. At 6:00 PM, a hot catered dinner for ten (10) people. PLEASE NOTE: to avoid the tedium
of repetitious meals and to provide for a balanced diet, the Purchaser will provide the hot
meals specified for the day of the week of this engagement. Meals will be served from
hot chafing trays with proper silverware and china Styrofoam, paper plates, plastic
utensils, etc. are NOT ACCEPTABLE. Dinner will be a sit-down catered affair and will not
consist of take-out or convenience foods.
SUNDAY: Roasted turkey. mashed potatoes with gravy, candied yams, creamed
spinach. stuffing, cranberry sauce.
MONDAY: BBQ chicken or ribs, baked potatoes, vegetables.
TUESDAY: Charbroiled New York strip steak (12 o2.), baked potatoes with sour
cream and chives, asparagus-,,broccoli,A11 sauce, Worcestershire
and ketchup. -
WEDNESDAY: Fried or barbecued chicken, mashed potatoes with gravy, cm-on-
the-cob, green beans.
THURSDAY: Same as Tuesday.
FRIDAY: Pork chops, mashed potatoes with gravy, com-on-the-cob, broccoli.
SATURDAY: .

IV. Ninety (90) minutes prior to showtime the following items are required in dressing room:

4. One case of 12-o7- bottles Evian.
S. One case of bottled iced tea-Upton or Snapple.
6. One gallon of whole milk.
7. One quart of fresh orange juice.
8. One liter of Jack Daniels- black label.
9. One bottle of California Chardonnay wine.
10. Two cases of Budweiser beer.
11. One six-pack of non-alcoholic beer.
12. Set-up for hot water.
13. 16 tea bags, 1 jar of instant coffee.
14. Two lemons.
15. Honey, sugar, cream.
If dinner is to be served at 6:00 P.M.paragraph B is not applicable

ADDENDUM C - Sound. Lighting & Band Gear Requirements
AMERICA 1995 RENTAL GEAR REQUIREMENTS
I. Per the advance of•AMERICA's Production Manager, Purchaser will turVsh and pay'for
the backiine equipment required by Producer. Said equipment Is for the We use of
AMERICA, and will be setup on stage at the time of.stage call.
A. Amplifiers
1. Two (2) Roland JC-120 Jazz Chorus Guitar Amplifier.
2. One (1) Fender Twin Reverb Guitar Amplifier.
3. One (1) SW R Bass Amplifier with Goliath 4 x 10" Speaker Cabinet.
B. Keyboards
1. One (1) Roland RD-300 Digital Piano with 26" stand and 21" bench.
NOTE: This piano is very heavy- no X-stands, no multi-tier stands. Also, a
bench, please- not a drum throne.
2. One (1) Roland D-50 with single-tier stand (X-stand OK here).
C. Drums
1. One 9" Kinta and one 12" Conga Drums w/low stands for seated playing.
2. Complete Ludwig Drum Set with new heads, including:
a. One (1) 22" kick drum. NOTE, Prefer Remo Pin-
b. Two (2) 6-1/2" x 14" chrome snare drum. stripe on toms. Ambassador
c. One.(1) 8' x 12" mounted tom. or Black Dot on kick and
d. One (1) 9- x 13" mounted tom. snare.

AMERICA 1995 SOUND REQUIREMENTS J �'
I. MAIN SYSTEM
A. House Speaker system will consist of three- or four-way stacks in sufficient quantity to
provide a minimum level of 110 dB at the rear of the audience area, from 50 Hz to 16
kHz. Preferred systems are EAW KF-850 or Meyer MSL-3. Crest, Crown or QSC
amplifiers will be provided in appropriate sizes and quantities to fully power system.
Main system will be configured In stereo.
B. House Console will be 40-Input Yamaha PM3000 or Ramsa W R-S852.
C. House Processing:
1- Appropriate Crossover/Processor for main system.
1- Klark-Teknik DN360 stereo 1/3-octave EQ or equivalent

11. Monitor System
A. Monitor Speakers will be two-way bi-amped, capable of producing 115 dB at 6' on
axis, from 80 Hz to 12 kHz. A total of 8 matched wedges are required Passive
wedges aM=acceptable !B. Monitor Console will be 24.input with 8 discreet mixes and Post-EQ,EUeing.
C. Graphic Equalizers will be 1/3-octave, one for each monitor mix.
D. Crossovers and Amplifiers will be supplied as required.

B. A CD player will be provided for use at the house console.
C. A professional-quality intercom system is required between house and monitor desks.

SUBJECT: 1997 Fine Arts Festival Saturday Concert
PURPOSE
The purpose of this memorandum is to provide the Mayor and
members of the City Council with information to consider an
agreement with America to perform a free-to-the-public con-
cert as the main entertainment at the Fine Arts Festival
Saturday evening, August 23, 1997 .
BACKGROUND
This year will mark the sixth annual Elgin Fine Arts Festi-
val . The event will again include the A.A.U.W. Art Showcase
and other enjoyable cultural activities for our citizens and
others from the region. The Fine Arts Festival Committee
chose the renowned soft-rock group America, known for such
hits as "Horse With No Name" , as the main entertainment at
8 : 00 p.m. Saturday. The committee also recommends that the
concert be held inside The Hemmens theatre because of the
severe problem with insects that occurs outside even with
massive spraying. The river bugs are attracted by the bright
stage lights and swarm over performers and the audience.
Parks and Recreation personnel and members of the Fine Arts
Committee will be handing out free tickets on Saturday after-
noon during the Festival on a first-come-first-served basis
for that evening' s performance.

This year, $65,000 has been budgeted for the Fine Arts Festi-
val . America ' s fee is $15,000 . Adequate funds for this
