RESOLUTION
AUTHORIZING EXECUTION OF A CERTIFICATE OF ABROGATION
OF BUILDING SETBACK LINE, CONSTRUCTION EASEMENTS AND
BUILDING RESTRICTIONS
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Kevin Kelly, Mayor, and Dolonna Mecum, City
Clerk, be and are hereby authorized and directed to execute a
Certificate of Abrogation of Building Setback Line,
Construction Easements and Building Restrictions on behalf of
the City of Elgin for property located in the Fox Bluff
Corporate Center, a copy of which is attached hereto and made
a part hereof by reference.

CONSTRUCTION EASEMENTS AND BUILDING RESTRICTIONS
WHEREAS, the CITY OF ELGIN, a municipal corporation
(hereinafter referred to as "City' ) , did cause a plat of
subdivision to be recorded August 19, 1992 in the Office of
the Recorder of Kane County, Illinois, as Document No. 92 K
59007 ( "Plat" ) , of property commonly known as the "Fox Bluff
Corporate Center" ; and
WHEREAS, the Federal Aviation Administration is the
owner of the real estate legally described as :
Lot 15 of Fox Bluff Corporate Center, being a
subdivision of part of Section 27, Township 41
North, Range 8 East of the Third Principal Meridian,
in the City of Elgin, Kane County, Illinois; and
WHEREAS, Olive Can Company is the owner of the real
estate legally described as :
Lots 12, 13, 14 , 6, 7, 9 , 10, 11, that part of
Lot 8 of Fox Bluff Corporate Center, being a
subdivision of part of Section 27 , Township 41
North, Range 8 East of the Third Principal Meridian,
lying Easterly of a line described as follows :
Commencing at the most Northerly corner of said Lot
8; thence South 50 degrees 46 minutes 57 seconds
East, along the Northeasterly line of said Lot 8, a
distance of 64 . 25 feet to a point that is 195. 80

situated in the City of Elgin, Kane County, Illinois
and containing 104,576 . 91 square feet more or less .
WHEREAS, the City owns the remainder of all real
estate described by the Plat; and
WHEREAS, the Plat, and more specifically Lots 22,
23, 24, 25, 26 and 27 of the Plat, contains a building setback
line running easterly and westerly through said Lots 22, 23,
24, 25, 26 and 27, which building setback line is 100 feet
from the northerly lot lines of said lots ( "the Restriction
Line" ) ; and
WHEREAS, the Plat, and more specifically Lots 22,
23, 24, 25, 26 and 27 of the Plat, contains a City of Elgin
and public utility easement, encompassing 25 feet of the
northerly 75 feet running easterly and westerly through said
Lots 22, 23, 24, 25, 26 and 27; and
WHEREAS, the Plat, and more specifically Lots 22 ,
23, 24, 25, 26 and 27 of the Plat, contains a landscape
easement encompassing the northerly fifty (50) feet running
easterly and westerly through said Lots 22, 23, 24 , 25, 26 and
27; and
WHEREAS, City and the above described owners of all
of the real estate affected by the Plat desire to remove the
aforementioned building setback and easements and have
provided consent to such relocation as indicated by Exhibits
A, B, C, D, E, F and G, attached hereto and made a part hereof .
NOW, THEREFORE, for and in consideration of the
premises and of other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, the
City and the above described owners, as owners of all of the
real estate included in the Plat, hereby certify that the
northerly building setback Restriction Line and the easement
areas, as shown on the Plat and described herein on Lots 22,
23, 24, 25, 26 and 27 are hereby abrogated and annulled, it
being the intention of the City and the undersigned owners
that there be no further such restrictions as to the location
of buildings from the northerly lot lines of Lots 22, 23, 24 ,
25, 26 and 27 contained in the Plat, except as otherwise
required by applicable laws and ordinances, and except that a
drainage easement shall be retained by City, which shall be

located in the northerly thirty ( 30) feet of Lots 22, 23, 24 ,
25, 26 and 27, and which drain easement shall run in an
easterly and westerly direction.

TO: Mayor and Members of the City Council

SUBJECT: Plat Amendment Fox Bluff Corporate Center
PURPOSE
The purpose of this memorandum is to present to the Mayor and
members of the City Council changes in the subdivision plat
for Fox Bluff Corporate Center (FBCC) .
BACKGROUND
The subdivision plat for the Fox Bluff Corporate Center that
was recorded on August 19, 1992 contained the following
easements and restrictions on the north boundary of Lots 22,
23, 24, 25, 26 and 27 .
1 . 100 foot building line.
2 . 25 foot public utility easement.
3 . 50 foot landscape easement.
The utility easement and landscape easement are all contained
within the 100 foot rear building line setback. The 100 foot
building setback and the 50 foot landscape easement were
originally established because it was anticipated that the
land use around the northern boundary with Fox Bluff Corpo-
rate Center would be residential .
The property to the north of Lots 22 through 27 is currently
zoned ORI .
Prospective buyers of property at the FBCC have expressed
concern about the limitations that the current plat require-
ments place on possible development of Lots 22 through 27 .
The sale of Lots 23 and 24 is contingent on the abrogation of
the easements and setback lines .

Setbacks for the north boundary of the property would be
""` governed by the requirements of the zoning ordinance. The
minimum building setback would become 30 feet.
In addition to the abrogation of the above-referenced ease-
ments, the construction of Crispin Drive and related modifica-
tions to the wetlands located north of Lots 18, 19, 20 and
21, a 30-foot drainage easement must be retained on the north
boundary of Lots 22 through 27 when such lots are sold.
The current property owners have agreed to the proposed
changes.
