RESOLUTION
EXPRESSING OPPOSITION TO VILLAGE OF GILBERTS
FACILITY PLANNING AREA AMENDMENTS
WHEREAS, the Village of Gilberts has requested an
amendment to the Illinois Water Quality Management Plan to
transfer 152 .57 acres from non-FPA areas into the Gilberts
FPA; and
WHEREAS, the proposed Facility Planning Area Amendment is
inconsistent with the Northeastern Illinois Planning
Commission' s adopted Strategic Plan for Land Resource
Management; and
WHEREAS, the proposed Facility Planning Area Amendment is
inconsistent with Kane County' s proposed 2020 Land Resource
Management Plan; and
WHEREAS, the proposed Facility Planning Area Amendment is
inconsistent with the City of Elgin' s proposed Far West Area
Plan.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that it hereby expresses its
opposition and objection to the requested amendment to the
Illinois Water Quality Management Plan as proposed by the
Village of Gilberts .
BE IT FURTHER RESOLVED that the Mayor is hereby
authorized and directed to submit written comments to the
Northeastern Illinois Planning Commission which reflect the
opposition of the City of Elgin to the proposed amendment.

Village of Gilberts
PURPOSE
To provide the Mayor and Members of the City Council with
comments and a recommendation concerning the City of Elgin' s
position relative to the Village - of Gilberts ' proposed
facilities planning area (FPA) amendment.
BACKGROUND
The Village of Gilberts has requested an amendment of state
and areawide water quality management plans to reflect the
transfer of 152 .57 acres from non-FPA areas in unincorporated
Kane County into the Gilberts FPA so that wastewater service
can be provided to a proposed residential development (see
enclosed notice and application for water quality amendment) .
The enclosed letter addressed to Ms . Deborah L. Washington,
Director of Project Review for the Northeastern Illinois
Planning Commission (NIPC) forwards initial comments and a
recommendation regarding the City of Elgin' s position relative
to the proposed FPA amendment. The Village of Gilberts
secured approval for a major addition of land to their
facility planning area in 1993 . The Northeastern Illinois
Planning Commission conditioned their support on the
initiation of construction of a sanitary treatment plant and a
local collection system within five (5) years . To date, the
staff is unaware of any actions by the Village to initiate
construction of the required facilities . In short, it is the
staff ' s opinion that it is premature to permit an expansion of
' a facilities planning area which is not yet served by any
sanitary sewer or collection system.

The purpose of this letter is to forward comments and a
recommendation regarding the City of Elgin' s position relative
to the referenced facility planning area (FPA) amendment. The
following is a summary of our initial comments and
recommendation:
COMMENTS
1. Property Description
The subject property includes approximately 152 . 57 acres,
located near the northwest corner of the intersection of Big
Timber Road and Tyrell Road. The property is bisected by
Tyler Creek and the Chicago and Northwestern Railroad right
of way. Land cover includes woodlands, wetlands, and
croplands .
2 . Surrounding Land Use and Zoning
The areas located to the north and west of the subject
property are located within the corporate limits of the
Village of Gilberts . These areas are developed or will be
developed with residential subdivisions .
The areas located to the south and east of the subject
property are located in unincorporated Kane County. These
areas are developed with county forest preserves, a boy
scout camp, estate residences, and cropland. The areas
located to the immediate east and southeast of the subject

property are within the Fox River Water Reclamation District
(FRWRD) FPA.
3 . Regional Plans
The Strategic Plan for Land Resource Management was adopted
by the Northeastern Illinois Planning Commission (NIPC) in
1992 . The two basic objectives of the plan are to improve
the stewardship of environmental resources and to achieve a
more balanced development pattern throughout the six county
metropolitan area. This can only be achieved through
intergovernmental coordination.
The plan addresses two strategies to shape the form of the
region. The first strategy involves the completion of the
regional greenways network. The second strategy involves
the development of Diversified Regional Centers (DRC) .
Opportunities to establish a regional greenways network are
identified in the Northeastern Illinois Regional Greenways
Plan adopted by NIPC in 1992 . Greenways establish a buffer
area which protects natural and cultural resources, provides
recreation opportunities, and enhances the quality of life
and the aesthetic appeal of neighborhoods and communities.
Both Tyler Creek and the Chicago .and Northwestern Railroad
right of way are identified in the plan as potential
greenway and trail system corridors .
The properties located in close proximity to the I-90
Tollway/Randall Road interchange will develop as a DRC.
This DRC will have a regional impact beyond the boundaries
of the Elgin corporate limits . The manner in which
development occurs within this larger geographic area - the
impacts on land use decisions, housing demand,
transportation, utility service, stormwater management, open
space, the environment; will involve issues of regional
concern. The solutions will require intergovernmental
coordination and cooperation.
4 . County Plan
The Kane County Regional Planning Commission is nearing
completion of a public hearing draft of the 2020 Land
Resource Management Plan for Kane County. The cover letter
included with the public review draft of the plan states
that "Kane County is rapidly approaching a crossroads due to
increasing growth, expanding municipal boundaries, and
renewed pressure on open space and natural resources . At
this crossroads are two basic choices : Balanced, managed
growth or conventional suburban sprawl . The choice is ours !

elected officials, and citizens throughout Kane County can
take the initiative and move into the 21st century by
forging ahead to support the cooperation, coordination, and

rift formation of partnerships needed to achieve the desired
future character of Kane County" .
The proposed plan recommends the creation of eight planning
partnership areas (PPA) in Kane County. The "Greater Elgin
PPA" includes Elgin and the Villages of Gilberts, Sleepy
Hollow, and Pingree Grove. One of the implementation
strategies in the proposed plan calls for the various
planning jurisdictions to develop land resource management
plans for all or parts of each of the eight PPAs, and to
adopt those plans through intergovernmental agreements based
on the provisions of the Local Land Resource Management
Planning Act.
The 2020 Land Use Plan included with the public review draft
of the Land Resource Management Plan designates the majority
of the subject property as "proposed open space,
conservation, recreation, drainage area" . The remainder of
the property is designated "resource management area" . The
open space designation recognizes the greenway/trail system
potential along the stream course and rail line, and the
value of the adjoining wetlands and woodlands . The proposed
open space on the subject property, in combination with
existing and proposed open space areas adjoining the
property, create a critical mass for a large bio-reserve
located central to the Greater Elgin PPA.
5 . Elgin Plan
The Elgin Planning Department and the Elgin Planning and
Development Commission are considering a number of revisions
to be incorporated into a public hearing draft of the
proposed Far West Area Plan for the City of Elgin. The
objective is to see the plan adopted during the first half
of this year and to negotiate the primary elements of an
intergovernmental agreement between the City, Kane County,
and other interested planning jurisdictions by the end of
the year.
The proposed plan endorses NIPC' s Strategic Plan for Land
Resource Management. The proposed plan includes many of the
same basc goals and objectives found in Kane County' s draft
2020 Land Resource Management Plan. The Far West Area Plan
represents a commitment by the City of Elgin to quality land
resource management - directing a balance among the need for
development, the cost of development, and the conservation
of the natural environment.
6 . Tyler Creek Demonstration Project
rft The City of Elgin, Village of Gilberts, Kane County
Development Department, Kane Forest Preserve District, and
Openlands Project, with the support of the Illinois
Department of Natural Resources and other interested

parties have participated in the development of a plan to
protect and restore Tyler Creek. In a report just released
by the Openlands Project, Protecting and Restoring Tyler
Creek: Creating an Ecological Greenway in a Watershed
Context, the portion of Tyler Creek which bisects the
subject property is identified as one of three existing high
quality reaches where protection of critical stream and
stream corridor areas is recommended as the primary goal .
It is suggested that the Kane County Forest Preserve
District is the most appropriate agency to lead in
protecting the high quality areas of the Tyler Creek
watershed.
7 . NIPC Water Quality Review Number 93-WQ-005, Village of
Gilberts
The Water Resources Committee of the Northeastern Planning
Commission viewed its support of the transfer of 440 acres
from non-FPA areas in Kane County into the Gilberts FPA in
1993 as a short-term, interim response to area wastewater
needs . The committee recognized the Village of Gilberts '
intent to secure sewer service with the construction of an
IEPA permitted treatment facility through a partnership with
a local developer. Support was, in part, focused on the
provision of sewers to the Village of Gilberts to address
•rowin• se•tic s stem •roblems. Su• •ort was conditioned on
the initiation of construction of the sanitary treatment
plant and local collection system for problem septic areas
within five years, or the Commission would rescind its
support and petition the IEPA to reverse any related FPA
amendment.
No construction has been initiated to date and, as the
current petition indicates, the Village of Gilberts is still
in the process of siting a new waste water treatment
facility. Now the Village of Gilberts is requesting to add
157 acres to the FPA in support of a development forecasted
to include an additional 323 households and 1100 persons.
RECOMMENDATION
The City of Elgin objects to the proposed change to the Gilberts
FPA until such time that Kane County, Elgin, the Village of
Gilberts, and the other planning jurisdictions in the area have
had an opportunity discuss land resource management issues which
will impact upon the region.

This shall serve as public notice that a proposed amendment to state and areawide
water quality management plans will be considered by the Commission's Water
r► Resources Committee at its Thursday, February 1 ,: 1996 meeting. This meeting will
begin at 9:00 a.m. in the Commission Chambers at 222 South Riverside Plaza, Suite
1800, Chicago, Illinois 60606.
• Comments regarding amendment requests before the Commission must be
received at the Commission's offices no later than ten working days prior to the
meeting - January 18 - if they are to be considered in formulating the staff
recommendation. Comments received after this date will be processed per the
Commission's May 1989 "Procedures for Receipt of Lake Comments."
Comments should be directed to the attention of Ms. Deborah L. Washington.
Please include the NIPC Water Quality Review Number on all correspondence;
and,

lek 2. Relationship to Adopted Water Quality Management Plans
Gilberts Facilities Planning Area
The Village of Gilberts is the designated management agency for the Gilberts FPA.
The 1979 Area wide Water Quality Management Plan for Northeastern Illinois, stated
the following for the Gilberts FPA.
Gilberts FPA
There are no municipal type plants in the Gilberts FPA. The Gilberts Needs
Analysis report noted that the Village would probably to unable to afford a
sewage collection and treatment system. Unfortunately, Gilberts also faces the
problem of soils unsuitable for on-site disposal for septics. The recommended
plan calls for the continued decentralized treatment of wastewater within the
Gilberts FPA. Treatment would be provided by septic systems in areas where
they work properly. Nontraditional alternatives, such as mounded sand
absorption fields, the partial sewering of problems areas to a community
absorption field, or the partial sewering to holding tanks with trucking of
sewage to a treatment plant would be considered in areas unsuitable for
septics.
The following amendments have been approved by I'EPA since the adoption of the
AWQMP and the Illinois Water Quality Management Plan.
• Village of Gilberts request to reflect the following: 1) Phase I construction and
operation of a new 0.75 mgd mechanical wastewater treatment facility to serve
the existing Gilberts FPA with discharge to Tyler Creek; and, 2) termination of
Village of Gilberts' NPDES permit for its proposed aerated lagoon system
treatment facility (NIPC WQ No. 94-WQ-005). NPDES Permit was modified by
IEPA on June 6, 1994 to reflect new facility.
• Transfer of 440 acres from non-FPA areas in Kane County into the Gilberts FPA
(NIPC WQ No. 93-WQ-005).
• Village of Gilberts request for construction and operation of a new 0.25 mgd
aerated lagoon treatment plant. IEPA granted NPDES permit on 12-31-91 (NIPC
WQ No. 91-WQ-017).
■ Holiday Park request for new treatment plant to service 411-unit mobile home
park. IEPA granted NPDES permit on 7-22-85 after public hearing (NIPC WQ
No. 84-WQ-034). Plant has not been constructed as of 2-1-93.

3. Review Considerations
The staff review and subsequent Water Resources Committee consideration of the
requested amendment will be based on the "Recommended Criteria for Facilities
Amendments to the Areawide Water Quality Management Plan for Northeastern
Illinois." These criteria delineate five conditions which must be met as necessary
prerequisites for any amendment and an additional four conditions also of concern to
the Commission. The Commission welcomes any and all comments regarding the
relationship of the requested amendment to these criteria.
Prerequisite Criteria:,
These conditions are a necessary prerequisite of any amendment.
1 . Any proposed facility amendment must be designed to meet State of Illinois
water quality standards for the receiving waters and the appropriate discharge
standards, or must receive a variance from the Illinois Pollution Control Board.
2. The population and employment for which the proposed amendment is designed
must fall within the twenty-year forecasts for the facility planning area most
recently adopted by the Commission, or the Commission may agree to
adjustments within the regional forecast total:
3. The applicant must demonstrate that the unit of local government granting
zoning to the project has formally accepted financial responsibility for the
wastewater treatment system in event of system malfunction or failure. Such
acceptance must be in the form of a resolution from the unit of local
government granting zoning.
4 The proposed amendment should not reduce the effectiveness of the water
quality improvement strategy contained in the original plan, either point for
• nonpoint source control.
5. The proposed amendment should not adversely affect the cost effectiveness of
the Areawide Water Quality Management Plan for meeting water quality
standards in the facility planning area as a whole.
Supporting Criteria
The following conditions will be considered as amendment requests are reviewed. The
Commission and/or the areawide Water Resources Committee will judge the
importance of each criterion on a case-by-case basis.
rik 6. The proposed amendment should have the endorsement of the designated
management agency for wastewater treatment and substantial support by the
municipalities within the affected facility planning area.

7. The proposed amendment should not adversely affect adjoining units of
government.
8. The proposed amendment should be consistent with other county and regional
plans or state policies, such as the Governor's Executive Order #4 on the
preservation of agricultural land. Likewise, provisions of Illinois Senate Bill 172
(Public Act 82-682) should be met. If the proposal would require the
amendment of another regional plan, the Commission will consider the wisdom
of that amendment at the same time.
9. Consideration will be given to evidence of municipal or county zoning approval
and commencement of development activity prior to Areawide Water Quality
Management Plan adoption in January, 1979.

The nearest existing sewer to the subject property would be located
at the Safety Clean Building located at Randall Road at Tyler Creek which
is over 1 mile from the subject property. The existing sewer is a 30" that
goes to the North Treatment plant.

Anticipated environmental impacts associated with each alternative should also be

The only alternative to becoming a part of the Village of Gilberts FPA
would be to become a part of the Fox River Water Reclamation District
FPA. That would mean that the existing 30" sewer at the Safety Clean site
would have to be extended over 1 mile to service our site.
