RESOLUTION
AUTHORIZING EXECUTION OF AN AMENDMENT TO THE CONTRACT
WITH ENVIRONMENTAL SCIENCE AND ENGINEERING, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard B. Helwig, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute an amendment to the contract dated June 9, 1993, on
behalf of the City of Elgin with Environmental Science and
Engineering, Inc . , for the design of a groundwater treatment
system of city' s police facility site, a copy of which is
attached hereto and made a part hereof by reference.

CONTRACT AMENDMENT
This contract amendment is entered into this
day of Anus t" , 1995, by and between the City of Elgin,
Illinois, a municipal corporation (hereinafter referred to as
"City" ) , and Environmental Science and Engineering, a Delaware
corporation (hereinafter referred to as "ESE" ) .
Whereas, City and ESE have previously entered into
an agreement for the design of a groundwater treatment system
of City's police Facility Site, dated June 9, 1993; and
Whereas, the aforementioned agreement has been
amended on two prior occasions; and
Whereas, the required scope of additional
engineering work was not known by the parties hereto prior to
the completion of preliminary engineering work, which has now
been completed; and
Whereas, City and ESE have each determined it to be
in their best interests to modify and amend the aforementioned
contract for treatment system design,
Now therefore, in consideration of the mutual
promises and covenants contained herein, the sufficiency of
which is hereby acknowledged, the parties hereto agree to
amend the agreement for design of a ground water treatment
system dated June 9, 1993, as follows :
1 . TASK 1- NPDES Compliance and Monitoring
Activity. ESE shall collect stormwater and groundwater
discharge samples from the construction site in accordance
with the requirements of the applicable NPDES General Permit.
Samples shall be analyzed for BTEX, PNAs and Oil and Grease.
ESE shall provide consultation services to the City and its
Construction Manager (Gilbane Company) regarding the
implementation of the NPDES discharge permit. Monthly
Discharge Monitoring Reports shall be prepared and submitted
in accordance with the terms of the permit to the IPEA.
2 . TASK 2 - Final Design and Remedial
Specifications - Groundwater Remediation System. ESE shall
prepare a set of final plans and specifications for the
groundwater remediation equipment based on the conceptual
design approved by the IEPA. The technical specifications
shall provide details of equipment selection, pump sizes,
piping arrangements, etc. The specifications shall be used to
obtain bids from pre-qualified equipment vendors and
installation contractors .
ESE shall meet with the City' s architect and/or
Construction Manager to coordinate details related to location
of the treatment unit and piping arrangements .
Major components of the remediation system include a
free standing package treatment unit with carbon absorption,
air compressor, bag filter, groundwater pumps, equipment
enclosure and appurtenances . The system shall also include
three (3) groundwater recovery wells (PVC construction) and
four (4) additional monitoring wells (stainless steel
construction) .
3. TASK 3- Construction Oversight Services . ESE
shall provide full-time construction oversight, health and
safety monitoring, construction management, and contract

administration services relate to the construction of the
groundwater remediation system. No more than a total of ten
( 10) days of field oversight time shall be used.
ESE shall monitor the contractor' s work to ensure
general conformance with the plans and specifications and
coordinate the installation with the City' s Construction
Manager, Gilbane, and other interested parties .
Upon completion of the installation work, ESE shall
provide start-up services of the treatment system. Start-up
services shall include balancing of flow rates among various
recovery points, determination of treatment efficiency, and
determination of permit compliance. No more than five (5)
days of start up time shall be used.
4 . TASK 4 - First Quarter Monitoring Services.
Operational services shall be provided for the first quarter
( 3 months) following successful start-up of the system.
During the first quarter, site visits shall be made on a
regular basis to check system operation. A total of eight (8)
visits are anticipated. ESE shall collect a round of
groundwater samples prior to start-up to establish current
conditions of the groundwater contaminants at each existing
monitoring well at the site. In addition, four (4) samples
shall be collected at monthly intervals for the first three
months following start up. The samples shall be analyzed for
BTEX, acetone and 2-butanone to determine treatment system
efficiency and monitor system performance. Samples of water
discharged from the treatment unit shall also be collected to
comply with the conditions of the permit. It is anticipated

that six samples shall be collected and analyzed for BTEX,
PNAs and Oil and Grease.
Operational services provided by ESE shall be
performed under the direction of a certified industrial
treatment plant operator.
At the conclusion of the first quarter of operation,
ESE shall prepare a monitoring report to be submitted to the
City of Elgin and the IEPA to document the performance of the
remediation system.
5 . SUMMARY OF CHANGES IN CONTRACT AMOUNT: The
original amount of the contract between the parties hereto is
hereby revised to increase payments from City to ESE as
follows :
Task 1 - NPDES Compliance and
Monitoring Activity $ 7,000 .00
Task 2 - Final Design & Specifications-
Groundwater Remediation
System $ 8, 150 . 00
Task 3 - Construction Oversight Services $19,700 . 00
Task 4 - First Quarter Monitoring $ 4, 100 .00
TOTAL NOT-TO-EXCEED COST $38,950.00
6 . City shall pay ESE a total sum of $151,010.00,
which sum shall represent an additional payment from City to
ESE of the sum of $38,950, in addition to the prior sum of
$112,060 which was agreed to by the parties hereto prior to
this amendment of the original agreement.

SUBJECT: Elgin Police Facility Site Final Remediation Design
and Oversight Services Contract Amendment No. 3
PURPOSE
The purpose of this memorandum is to submit to the Mayor and
members of the City Council Contract Amendment No. 3 with
Environmental Science & Engineering, Inc. for final
remediation design and oversight services at the new police
facility site.
BACKGROUND
The site environmental remediation program developed for the
new police facility site which was approved by the Illinois
Environmental Protection Agency (IEPA) involved soil removal
and the installation of a groundwater treatment system. The
required removal of contaminated soils from the site is com-
plete. The groundwater treatment system must be designed,
bid and installed.
The attached Contract Amendment includes final design and
construction oversight for the groundwater remediation sys-
tem. The groundwater system will be designed in accordance
with the conceptual design as presented by Environmental
Science & Engineering, Inc. in the Corrective Action Plan, as
approved by the IEPA.
-'The subject Contract Amendment includes final design of the
package treatment system, piping and appurtenances, and the
.!groundwater recovery and monitoring wells. The completion of
the plans and specifications will allow the City to obtain
competitive bids for the treatment equipment and its installa-
tion. Also included is construction oversight, system start-
up, and monitoring services for the first quarter of opera-
tion in the proposed scope of services.

FINANCIAL IMPACT
Expenses related to the Contract Amendment will be charged to
fund 395-1000-795.92-31, project number 395004. The 1995
bond sale included $600,000 for expenses such as this. Suffi-
cient funds remain available for the requested Contract Amend-
ment totaling $38,950.
LEGAL IMPACT
None.
RECOMMENDATION
Authorize the City Manager to approve Contract Amendment No.
3 with Environmental Science and Engineering, Inc. for the
new police facility site.
