RESOLUTION
AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN AGREEMENT
WITH CRAWFORD, MURPHY AND TILLY, INC. , FOR IMPROVEMENTS
AT THE SLADE/DUNDEE INTERSECTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard B. Helwig, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute Amendment No. 1 to an agreement on behalf of the
City of Elgin with Crawford, Murphy and Tilly, Inc. for
improvements at the Slade/Dundee intersection, a copy of which
is attached hereto and made a part hereof by reference.

INTERSECTION IMPROVEMENTS
ENGINEERING SERVICES AGREEMENT AMENDMENT NO. 1
This Amendment No. 1 entered into this 3 0,? day of , 1995, by and between
the City of Elgin, an Illinois Municipal Corporation (herei after referred to as "CITY") and
Crawford, Murphy & Tilly, Inc., Consulting Engineers, (hereinafter referred to as
"ENGINEER"), shall modify that Agreement dated February 23, 1995, whereby the ENGINEER
was engaged by CITY to perform certain professional services in connection with the preparation
of plans, specifications, estimates of cost, and construction related engineering services for the
Slade Avenue/Dundee Avenue Intersection Improvements (hereinafter referred to as
"PROJECT").
Whereas the payment to the ENGINEER for construction engineering related services was not
included in the Agreement, and,
Whereas the CITY desires to include the payments to the ENGINEER under paragraph IV C of
the Agreement in connection with the construction administration, construction observation and
quality control of the construction phase of the PROJECT.
In response to these additional services, certain revisions must be made to the Agreement. In
compliance, therefore, the terms and conditions of the agreement are modified as specifically
set out below. All other parts of the Agreement remain unchanged.
SECTION IV of the AGREEMENT is hereby amended to replace paragraph C. and add
paragraph E, F and G.
C. Inclusive of paragraph IV A, IV B and IV E, this agreement shall be in the total amount
not to exceed $59,810.00.
E. For services provided in connection with the construction administration, construction
observation, and quality control of the construction phase of the PROJECT, the ENGINEER
shall be reimbursed in accordance with the Schedule of Hourly Charges, dated January 1995,
included as Attachment B of the original agreement, with the total fee not to exceed $28,894.00
regardless of the actual cost incurred by the ENGINEER unless substantial modification to the
scope of work are authorized by the CITY through a change order or amendment.

F. The compensation set forth in Paragraph C above does not include any engineering
service after the original construction contract completion date for the PROJECT. In the event
the CITY approves and authorizes an extension of time for the Contractor to complete the
construction work, the compensation for engineering services set forth in Paragraph C shall be
increased for the additional services required for the ENGINEER. In the event the Contractor
does not complete the construction work within the contract completion time including any
extensions thereof granted by the CITY, the CITY shall pay the ENGINEER extra compensation
at the ENGINEERS' hourly rates until the PROJECT construction work has been accepted by
the CITY.
G. The compensation set forth in Paragraph C does not include any engineering services
regarding warranty work by the Contractor after the PROJECT, or parts thereof, has been
accepted for operational use by the CITY. In the event that warranty work is required of the
Contractor, the CITY shall pay the ENGINEER extra compensation at the ENGINEERS' hourly
rates to assist the CITY in enforcing the Contractor's guaranty to repair or replace defective
work within the warranty time stated in the Construction Contract Documents for the
PROJECT.
Attachment A, Scope of Services of the original contract will be supplemented by the following
tasks which correspond to the attached estimate of levels of effort and associated cost worksheet:
Construction Phase
1. Schedule preconstruction conference.
2. Attend and facilitate preconstruction conference.
3. Coordinate schedule with contractor
4. Perform initial construction layout (Subsequent layout, if necessary, will be the
contractor's responsibility).
5. Full time resident engineer duties per the City requirements of Construction
Services including:
a. Inspection Daily Reports
b. Weekly Reports
c. Monthly Progress Reports
d. Construction Observation
e. Quantity and Material Record
f. Preparation of Partial Pay Estimates

g. Preparation of Extra Work and Change Orders, as necessary
h. Facilitate Final Inspection
i. Facilitate Weekly Progress/Coordination Meetings
j. Material Testing
k. Review Shop Drawings
6. Record Drawing Surveys.
7. Prepare and Submit Record Drawings
All other provisions of the AGREEMENT shall remain in full force and effect.
IN WITNESS WHEREOF, the undersigned have placed their hands and seals upon and executed
this Agreement in triplicate as though each copy hereof was an original and that there are no
other oral agreements that have not been reduced to writing in this statement.

SUBJECT: Amendment No. 1 - Construction Engineering:
Slade/Dundee Intersection Improvements (ST27b)
PURPOSE
The purpose of this memorandum is to provide the Mayor and
the members of the City Council with information to consider
Amendment No. 1 to an agreement with Crawford, Murphy and
Tilly, Inc. which will add the fee for construction related
engineering and inspection services to that agreement.
BACKGROUND
At its meeting of February 22, 1995, City Council authorized
an agreement with Crawford, Murphy and Tilly, Inc. , for the
preparation of plans, specifications, estimates, bidding and
construction engineering services, for the Slade/Dundee
Intersection Improvements. Crawford, Murphy and Tilly, Inc.
was selected by the competitive proposal method with four
firms submitting proposals.
As the extent of the improvements were not known at the time
the City executed the agreement with Crawford, Murphy and
Tilly, Inc. , the fees for the construction related services
were not included.
The construction of the Slade/Dundee Intersection
Improvements is on the agenda for award by City Council on
June 14, 1995.
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
Residents of Hill Avenue had been notified of the project.
Hill Avenue will be closed at Slade Ave. as a component of
this project. No objections were received.

FINANCIAL IMPACT
The Amendment No. 1 is in the amount of $28,894 , and is based
upon a construction period from July 5, 1995 to October 30,
1995.
Payment to the engineer will be on an hourly not-to-exceed
basis. A fee calculation schedule is attached.
This Amendment No. 1 is budgeted within the 1995 Bond Issue,
Account No. 395-10-00-795 .93-80, Project No. 395003 funded at
$635,000. Obligations to-date are as follows:
1. Slade Ave. Construction at $ 315,616 .84
2 . Slade/Dundee Intersection
Engineering at $ 30,916 .00
3. Slade/Dundee Intersection
Construction at $ 225,901 . 60
4 . Slade/Dundee Intersection
Construction Engineering at $ 28,894 . 00
Total Obligation to-date $ 601,328.44

None.
RECOMMENDATION
It is recommended that City Council authorize the City
Manager to execute Amendment No. 1 to the Agreement with
Crawford, Murphy and Tilly, Inc. , dated February 23, 1995, in
the not-to-exceed amount of $28, 894 .Ian
