Method C- Progress Payments. Upon receipt of the contractor's first and subsequent progressive bills for this improvement,the LA will pay to the STATE,an amount equal to the LA's share of the constriction cost divided by the estimated total cost,multiplied try the actual progress payment(appropriately adjusted for nonparticipating costs)made to the contractor until the entire obligation incurred under this Agreement has been paid. (2) This Agreement shall be binding upon the parties,their successors and assigns. (3) It is the policy of the U.S.Department of Transportation that Minority Business Enterprises,as defined in 49 CFR Part 23,shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds under this Agreement. Consequently the MBE requirements of 49 CFR Par 23 apply to this agreement. The STATE/LA agrees to ensure that minority business enterprises,as defined in 49 CFR Part 23.have the maximum opportunity to participate in the performance of this Agreement In this regard the STATE/LA shall take all neoessary and reasonable steps, in accordance with 49 CFR Part 23,to ensure that minority business enterprises have the maximum opportunity to compete for and perform portions of contracts and subcontracts financed in part with Federal funds provided under this Agreement The STATE/LA shall not discriminate on the basis of race,color,national origin or sex in the selection and retention of contractor or subcontractors including procurement of materials and leases of equipment. CITY OF ELGIN _ S./3//7S- DATE ATTEST: B B CITY CLERK MAYOR -6- r.hw4\S9spo.doc V _ STATE OF ILLINOIS COUNTY OF KANE RESOLUTION NO 95 - 177 INTERGOVERNMENTAL AGREEmEN% BETWEZN TEE COUNTY OF KANE, THE =TY OP ELGIN,AND TIE STATE OF ILLINOIS FOR THE IMPROVEMENT OF RANDALL ROAD WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et seg. authorizes the County of Kane (hereinafter "county") and the State of Illinois (hereinafter "State") , and the City of Elgin (hereinafter "City") to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and, wHEREAS, the County, the City and the state desire to undertake a project to upgrade of Kane County Highway No. 34 also known at Randall Road (hereinafter "Randall") from its intersection with 1-90 to Big Timber Road. Said upgrade shall consist of, among other things, roadway construction, Widening, resurfacing, curb and gutter, storm sewers, traffic signals, pavement markings and other associated work; and, WHEREAS, the County, the City and the State wish to cooperate among themselves to accomplish the improvement to Randall. The improvement is deemed by the County, the City and the State to be of immediate benefit to the residents of the County of Kane in that it shall facilitate the efficient movement of traffic and shall provide for the safety of the motoring public; and, WHEREAS, the County and the State have determined a Mutually satisfactory distribution of all costs for said improvement to Randall as set fort.h, in the attached Local Agency Agreement For Federal Participation. The total cost of the project is estimated to be two million two hundred and fifty thousand dollars ($2,250,000.00) . The County's share of the project is estimated to be four hundred fifty thousand dollars ($450,000. 00) , the Federal share as administered by the state is estimated to be one million eight hundred thousand dollars ($1,000, 000 . 00) . Further, the County and the City mutually agree to a distribution of the maintenance and energy costs of the new traffic signals to be installed at Randall Road and Fox Lane and Randall Road and'AIft Lane in the percentages as set forth in the attached agreement. Helwig, City Manager SUBJECT: Randall Road Traffic Signals at Alft Lane and Fox Lane PURPOSE The purpose of this memorandum is to provide the Mayor and the members of the City Council with information to consider entering into an Agreement with the Illinois Department of Transportation ( IDOT) for the construction and maintenance of traffic signals on Randall Road at Alft Lane and at Fox Lane. BACKGROUND Kane County, through IDOT, has scheduled the bidding for the reconstruction of Randall Road from Big Timber Road to the I-90 Tollway. A component of this project will be the reconstruction, with new traffic signals, of the intersections of Randall Road at Alft Lane and at Fox Lane. It has been the practice of the City to accept ownership of the permanent traffic signal installations on Randall Road subject to the following conditions : 1 . All construction and installation costs are borne by Kane County. 2 . The City will pay 100 percent of the electrical charges for the signals ' operations. 3. The maintenance costs of the signals will be shared equally between Kane County and the City. The maintenance and repairs to the signals will be accomplished by Kane County with the City invoiced on a periodic basis . In order to comply with federal and IDOT requirements, the City is required to execute the attached agreement. , Randall Road Traffic Signals May 16 , 1995 Page 2 eP- COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Kane County Division of Transportation Illinois Department of Transportation FINANCIAL IMPACT The City will not be subjected to any immediate cost. Upon completion and acceptance of the two traffic signal installations, which will likely be in 1997 , the City will be subject to the following costs . 1 . Electrical: Under the current Franchise Agreement with Commonwealth Edison, the City receives power to traffic signals at no charge. The Franchise Agreement expires in the year 2016 . 2 . Maintenance: It is anticipated that the annual maintenance cost share for the City will be approximately $1, 200 and will need to be added to the 1997 budget. LEGAL IMPACT None. rRECOMMENDATION It is recommended that City Council authorize the execution of an Agreement with IDOT for the installation of the traffic signals on Randall Road at Alft Lane and at Fox Lane. Re: Randall Road - Big Timber to I-90 Dear Mr. Helwig: The scheduled bid date for the above referenced section is July 7, 1995 in Springfield. Since this project has federal funding, the letting is held by IDOT on their scheduled bid dates. Prior to the project being approved for the letting, all right-of-way must be acquired and intergovernmental agreements must be completed and approved by IDOT. These items must be signed off by the IDOT - Schaumburg office by no later than May 31, 1995. We are in the process of finalizing the right-of-way acquisition and intend to forward certification to IDOT in mid-May. An intergovernmental agreement must be completed regarding the energy and maintenance of the signals. There are two traffic signals to be installed as part of the Randall Road improvement. Both are at Elgin maintained side roads. One is at Alft Lane and the other is at Fox Lane. Since the City receives free energy as a part of their franchise agreement with Commonwealth Edison, we anticipate that the City would accept this responsibility. The cost of the maintenance of the signals is proposed to be 50% County and 50% City. The County will assume the responsibility for the maintenance of the signals. Attached is a copy of a letter forwarded to the City regarding Alft Lane west of Randall Road. Prior to us completing the right-of-way acquisition on Alft Lane, we must have a response regarding the correspondence. r eft We would appreciate your urgent attention to these matters so that the proposed bid date of July 7 is not jeopardized.
