HomeMy WebLinkAbout94-72 Resolution No. 94-72 RESOLUTION AUTHORIZING EXECUTION OF A PURCHASE OF SERVICE AGREEMENT WITH LARSEN MIDDLE SCHOOL ASSOCIATES FOR YOUTH IN ACTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that George VanDeVoorde, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute a purchase of service agreement on behalf of the City of Elgin with Larsen Middle School Associates for Youth in Action for after school programs for Larsen Middle School students, a copy of which is attached hereto and made a part hereof by reference. s/ George VanDeVoorde George VanDeVoorde, Mayor Presented: April 13, 1994 Adopted: April 13, 1994 Omnibus Vote: Yeas 7 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk PURCHASE OF SERVICE AGREEMENT THIS GREEMENT is made and entered into this /72k day of , 1994, by and between the City of Elgin, Illin ' s, an Illinois municipal corporation, (hereinafter referred to as the "City" ) , and Larsen Middle School Associates for Youth in Action (hereinafter referred to as the "Provider" ) . In consideration of the mutual promises and covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereby agree as follows : 1 . The City shall pay Provider an amount not to exceed Two Thousand Five Hundred Dollars ($2,500 .00) for the following programs : after school programs for Larsen Middle School students, including but not limited to, computer classes and open gym programs. 2 . All monies granted for this program shall be expended by Provider before December 31, 1994 . 3 . The City shall pay up to the sum of Two Thousand Five Hundred Dollars ($2,500 . 00) after Provider submits a budget for their programs for 1994 . 4 . All funds received for this program will be expended only for the programs as described above. In the event Provider changes the programs without the prior written consent of the City of Elgin, all funds shall be refunded to the City. 5 . Provider shall submit to the City on or before December 31, 1994, an annual report of the activities of the programs described herein and the actual expenditures made for said programs . 6 . Provider shall upon request make available to the City financial documents for the year which a grant was received. 7 . No monies shall be used for any purchase of permanent equipment, capital improvements or construction, payment of previous year' s deficit, activities outside of the state geographic boundaries or subsidy for an individual ' s academic study. 8 . No person shall be denied participation in or the benefits of the programs described in paragraph 1 on the grounds of race, color, religion, national origin, sex or handicap. Malm, Interim City Manager SUBJECT: Larsen Middle School Associates for Youth in Action PURPOSE To provide a Purchase of Service Agreement (PSA) between the City and Larsen Middle School Associates for Youth in Action. BACKGROUND One of the requests as part of the 1994 budget process came from the Larsen Middle School Associates for Youth in Ac- e tion. The Associates are a group of students and leaders providing after-school hours programming. A PSA for $2,500 in City funding has been drafted and present- ed for the City Council 's review. As part of the PSA, the Associates will provide open-gym programs, computer classes, cultural awareness programs, etc. Programs are now offered to Larsen students on Saturdays. FINANCIAL IMPACT A total of $2,500 has been budgeted in the General Fund' s Boards and Commissions budget. LEGAL IMPACT The PSA will require legal review. RECOMMENDATION Direct staff to prepare a resolution authorizing the execu- tion of the PSA. :61461:0444.-- t O. Malm, Interim City Manager amp Attachment Larsen Middle School esk Associates for Youth - in Action 655 Dundee Avenue Elgin, Illinois 60120 The Honorable Mayor George VanDeVoorde Elgin City Council 150 Dexter Court Elgin, IL 60120 October 25, 1993 Dear Mayor VanDeVoorde and Elgin City Council: We have recently sent you information regarding Larsen Middle School Associates for Youth - in Action - that package is enclosed. The Associates program can only be successful with the support of the Elgin community. We are asking you to extend your support in the form of a financial contribution. The Associates program provides healthy, creative options for Larsen's students. Our philosophy is to achieve unity while utilizing the diversity and dignity of our population. Larsen's population parallels that of Elgins'; this is especially evident in its ethnic and financial status. Our students are at the age where intervention and direction are crucial to their future as well as the future of our community. Our program offers students a safe, unbiased environment in which to experiment with their interests. Caring, nurturing adult role models extend themselves to these students who may not otherwise have the opportunity for this kind of relationship. We adults are committed to providing whatever is necessary to continue the programs developed by the students and to keep these children interested in the Associates program and away from undesirable activities. Supplies are necessary to keep the Saturday morning programs running students have requested activities such as, producing a music video, woodworking, art, drama, engine repair, gang alteratives and a sports program. Many of our students are unable to participate in the schools sports program because of financial difficulty. • Yourfinanclal support would allow us to purchase materials needed, provide outside experiences, as well as open our gym on Saturday afternoons throughout the year. Our building custodian has volunteered his time on Saturday mornings to open the school for us. The cost of keeping the gym open in the afternoon would be approximately$5000.00 for the year. An additional $5000.00 is requested as seed money for the other activities listed. • • • All adults involved volunteer their time. All students who participate agree to give something back to the community. Last week our students participated in Make A Difference Day;they cleaned up the Larsen property and planted shrubs and flowers which were donated by local nurseries. Students have suggested raking leaves, and shoveling snow for senior citizens as one way to give back to the community. They are also planning something for Veterans Day In November. We are hopeful that you recognize the need for programs such as the Associates. Traditional approaches Do Not Work! Provider hereby agrees to indemnify and hold harmless the City, its officers, employees and agents, from and against any and all damages, losses, claims, causes of action, lawsuits, judgments or liability whatsoever arising out of the programs described in paragraph 1, providers activities undertaken pursuant to this agreement or as a result of the existence of this agreement. The provider, at the provider's own cost and expense, will defend by counsel of the City's choosing, any and all claims falling within said indemnification against the City or in which the City may be impleaded with others. 10. The programs described in paragraph 1 and which shall be conducted within the geographical boundaries of the City of Elgin. 11 . This agreement shall not be construed to create an employment, joint venture or partnership agreement between the parties hereto.
