Helwig, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Kane County and R & S Used Oil for a used motor oil collection event, a copy of which is attached hereto and made a part hereof by reference. sl George VanDeVoorde George VanDeVoorde, Mayor Presented: August 10, 1994 Adopted: August 10, 1994 Omnibus Vote: Yeas 7 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk AGREEMENT THIS AGREEMENT entered into this J_�j day of IF 1994, by and between the CITY OF ELGIN, a municipal corporation (hereinafter referred to as the "City" ) , KANE COUNTY (hereinafter referred to as the "County" ) and R & S USED OIL, an Illinois corporation (hereinafter referred to as "R & S" ) . WITNESSETH WHEREAS, the City and the County are public agencies within the meaning of the Intergovernmental Cooperation Act; and WHEREAS, the City and the County are also units of local government within the meaning of Section 10 of Article 7 of the Constitution of the State of Illinois; and WHEREAS, the City and the County are authorized to contract among themselves to obtain or share services, or exercise, combine or transfer any power or function in any manner not prohibited by law; and WHEREAS, the County has requested the City host a one-day used motor oil collection event; and WHEREAS, the collection of used motor oil so as to protect the environment is a matter within the government and affairs of the parties; and WHEREAS, the County has contracted with R & S to service used motor oil collection events throughout the county. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the City, County and R & S agree as follows : 1 . That the foregoing recitals are hereby incorporated into this agreement in their entirety. 2 . That the City agrees to host a one-day used motor oil collection event on Saturday, September 17, 1994, from 9 : 00 a.m. to 2 : 00 p.m. The event will be conducted at the recycling drop-off site (north of the public works complex) located at Grove and McBride Street, Elgin, Illinois . 3 . R & S will provide a tanker truck at the collection site and will accept oil at no charge. Participants will bring used oil to the collection point where it will be emptied into 55 gallon drums by County staff. Empty containers will then be immediately returned to the participants . The City will provide a staff member to supervise the activities . 4 . R & S personnel will pump the oil from the drums into the R & S tanker. R & S will clean up any and all spills . 5 . R & S and the County represent and warrant to the City that they each have general liability insurance to cover any and all claims and damages which may result from the used motor oil collection event as described herein. R & S and the County agree to indemnify and hold the City harmless from any and all claims, damages or causes of action which may result from said event. 2 IN WITNESS WHEREOF, the parties have executed this agreement on the date and year first written above. Used Motor Oil Collection Event Councilwoman Yearman made a motion, seconded by Councilman Walters, to authorize staff to participate in the used motor oil collection event proposed by the Kane County Solid Waste Division. Multi-family Garbage Reimbursement Agreements Councilwoman Yearman made a motion, seconded by Councilwoman Popple, to approve six additional multi-family garbage reimbursement agreements . Yeas : Councilmembers Fox, Gilliam, Popple, Schock, Walters, Yearman, and Mayor VanDeVoorde. Nays : None. Contracts for the Hemmens Auditorium Spring 1995 Performing Arts for Young People Series Councilman Walters made a motion, seconded by Councilwoman Yearman, to approve the proposed contracts for the Hemmens Auditorium Spring 1995 Performing Arts for Young People Series . Yeas : Councilmembers Fox, Gilliam, Popple, Schock, Walters, Yearman, and Mayor VanDeVoorde. Nays : None. Testing Service Agreement with Testing Service Corporation for Various City Projects Councilman Fox made a motion, seconded by Councilman Gilliam, to approve the testing service agreement with Testing Service Corporation. Yeas : Councilmembers Fox, Gilliam, Popple, Schock, Walters, Yearman, and Mayor VanDeVoorde. Nays : None. Miscellaneous A discussion was held regarding various matters including enforcement procedures for city vehicle stickers, playing automobile stereos excessively loud, cumbersome procedure for obtaining a building permit, and need for having housing inspectors work weekends and evenings . 111 r", Agenda Item No. June 16, 1994 TO: Mayor and Members of the City Council FROM: Richard B. Helwig, City Manager SUBJECT: Used Motor Oil Collection Event PURPOSE To provide information whereby Council may authorize partici- pation in the subject County-wide program. BACKGROUND The Solid Waste Division for Kane County has proposed a Coun- ty-wide used motor oil collection event. Attached is a copy of their letter dated May 12, 1994 which outlines the plan. Kane County and the Kane-DuPage Soil and Water Conservation District will coordinate the collection of used motor oil. They have requested that the City of Elgin host the event in September to better serve the northern portion of Kane County. Aurora and St. Charles will be hosting the event on July 23rd and August 20th, respectively. Staff is suggesting the collection program in - Elgin be held at the recycling drop-off site at the Public Works Complex on Saturday, September 17th. FINANCIAL IMPACT The cost of one staff person to assist with the event from 9 a.m. to 2 p.m. LEGAL IMPACT A written agreement will be prepared. Public Works Director City of Elgin 150 Dexter Court Elgin, IL 60120-5555 Dear Gary: Thank you for expressing an interest in hosting a used motor Oil collection event, co-sponsored with the County and the Kane- DuPage Soil and Water Conservation District. The District held a very successful collection last summer at the County Highway Department and we are looking forward to expanding the availability of this service to residents across the County. The program will be serviced by R & S Used Oil of Monee. They provide a tanker truck during the collection and accept the oil at no charge. Residents bring the used oil to the collection point, where it is emptied into 55 gallon drums by District and County staff. The empty containers are then immediately returned to the residents. R & S personnel pumps the oil from the drums into their tanker. A gravel or sand base is strongly recommended for the handling area. R & S cleans up all spills, although at previous events spillage has been limited to incidental amounts. R & S is licensed and insured, and the District-1-s liability insurance will also cover the event. We would like to hold once-a month collections from . June through October around the County. The collections would be on Saturdays from 9:00 am to 2:00 pm. The draft schedule of locations is as follows: June 25 - Kane County Highway Dept. , Campton Township July - Aurora . August - - St. Charles September - Elgin October - Elburn �z The County and the District will provide publicity, staffing, and coordination with R & S at each event. We are asking each municipality to provide a location, select a preferred Saturday during the assigned month, provide one staff person, and-publicize the event in their newsletter. The District's collection last summer netted 3,000 gallons of used oil from 150 - 200 cars - on a Wednesday! Used Oil also represents a major portion of the material accepted during household hazardous waste collections. It is clear that there is a public demand for a convenient method to properly handle used oil, and we believe that this series of collection days is a step in the right direction. Please let me know as soon as possible if your community will be able to host one of these events. We would like to establish dates for all of them, so we can publicize the entire series. A fee for this annual emission inventory survey will be based on the amount of B.T.U. input from this fuel burning equipment or process equipment involved. LA G GES so•No or COUNTY coawisaoNEQS DIRECTOR 5. 5-3 (c) OF THE COOK COUNTY ENVIRONMENTAL CONTROL ORDINANCE "RIGHT OF ENTRY" An authorized inspector shall have the authority to enter, at any reasonable hour, any building, structure, or premises to enforce the provisions of this Ordinance. 5.5-3 f Any person, firm or corporation, or agents, employees or contractors of such, who violate, disobey, omit, neglect, or refuse to comply with or who resist enforcement of any of the provisions of this Ordinance, shall be subject to a fine of not more than five hundred dollars ($500_ ._00) or imprisonment for not more than six months. or b of or each offense, and each ay a violation continues to exist shall constitute a separate offense. 5.4 CERTIFICATE OF OPERATION It shall be unlawful for any person or his agent to use or operate any fuel burning, combustion or process equipment, process or device without having an effective certificate of operation therefor. 5.5-3 (e) PERSONS LIABLE Unless otherwise specifically provided, the owner, his agent for the purpose of managing, controlling or collecting rents, and any other person managing or controlling a building or premises, in any part of which there is a vio- lation of the provisions of this Ordinance, shall be liable for any viola- tion therein, existing or occurring, or which may have existed or occurred, at or during any time when such person is or was the person owning, or man- aging, controlling, or acting as agent in regard to said buildings or prem- ises. Wherever used in the provisions of this Ordinance, the "owner" shall include any person entitled under any agreement to the control or direction of the management or disposition of the building or premises or of any part of the building or premises where the violation in question occurs. The liabilities hereunder imposed on an owner shall attach to a trustee under a land trust, holding title to such building, structure, or premises without the right of possession, management, or control, unless said trustee in a proceeding under said provisions of this Ordinance discloses in a verified pleading or in a affidavit filed with the court. the name and last known address of each person, if any, who was then acting as agent for the pur- pose of managing, controlling, or collecting rents, as the same may appear on the records of the trust.
