ZELASKO BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard B. Helwig, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Elizabeth S. NOW, THEREFORE, for and in consideration of the mutual Promises and covenants contained herein, the sufficiency of which is hereby. acknowledged, the parties hereto agree as follows : 1. 'City shall pay to- worker the sum of- $ y on or. before 199 2 . Lker shall be retained as an independent contractor. This agreement shall not be construed to create An agency, joint venture or employment agreement between the parties hereto. 3 . Worker shall. provide the services described in attachment ''A" hereto, which attachment is hereby incorporated into and made a part of this agreement. 4 . This agreement shall terminate on / / 199_, or as otherwise provided herein. 5 . Either party may terminate this agreement at any time upon written notice. . In the . event this agreement is terminated prior to � by- either party, worker shall be compensate , on a pro-rata basis based on the number of days worked as a percentage of the complete amount of work contemplated by this agreement pursuant to attachment "A" . 6 . The terms of this - agreement shall be severable. In the event that any of the terms or provisions of this agreement shall be found to be void or otherwise unenforceable for any reason, the remainder of this agreement shall remain in full force and effect. 7 . This agreement shall be subject to and governed by the laws of the State of Illinois . 8 . Worker agrees to hold harmless and indemnify the City for ' and against any and all claims for damages, suits, causes of action or other liability arising out of or due to worker' s negligent acts . The Costume Designer shall. with the Director and Tech Director to develop costume and make-up design appropriate for the show. 2 . Costume Designer shall be responsible for measuring all cast members, and constructing, altering, and fitting costumes- for indi- vidual cast members . All efforts should be made to use existing costumes and accessories owned by the City of Elgin. 3 . Costume Designer shall arrange for purchase of materials and rental of costumes as deemed necessary within the confines of the budget and time tables set by the Director and Technical Director. 4 . Costumer shall be responsible for the repair and cleaning of costumes as needed. 5 . Costumer shall be responsible for the sorting, arranging, and labeling of all costumes . 6 . Costumer shall purchase` all make-up and. .related materials with- in the confines. of the budget. All efforts should be made to- use preexisting supplies owned. by City of Elgin. 7 . Costumer shall supervise the use of make-up by all. cast members . 8 . Costumer shall insure that all costumes and make-up are correct and in place at the times set forth by Director and. Tech Director. Costumer shall provide cast. members with a list of personal items needed for each costume, allowing sufficient time for cast to` gath-. er or purchase indicated items to comply with costume timetable. 9 . Costumer shall collect, inventory, and arrange for- cleaning- and- return or storage of all costumes at the conclusion of the produc- tion. 10 .Costumer shall collect, sort, inventory, . and pack all make-up and. related items at the conclusion of the final performance,_ and make arrangements with the TD for storage of make up. 11. Costumer shall arrange with the Set Designer- any needs for quick-change areas backstage and shall be available (or provide vol-. unteer staff) to assist actors with quick changes when necessary. Costumer shall insure all costume pieces involved in-- quick change are pre-set, then returned to costume shop. 12 . All receipts for all purchases will be turned in to the Techni- cal Director immediately. 13 . Costumer shall arrange for all voluntary labor needed for the successful completion of the duties stated above.
