RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
ATEC & ASSOCIATES, INC:

WHEREAS, the City of Elgin has heretofore entered into a
contract with ATEC & Associates, Inc. for the design and
installation of a groundwater remediation system for
266-280 South Grove Avenue; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 1,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Richard B. Helwig, City Manager,
be and is hereby authorized and directed to execute Change
Order No. 1, a copy of which is attached hereto and made a
part hereof by reference.

ADDITIONAL SERVICES FOR 206 - 280 SOUTH GROVE AVENUE
CHANGE ORDER NO. 1
SCOPE: This Change Order No. 1 covers additional services
required at the City of Elgin properties located at 206 -
280 South Grove Avenue under a contract awarded on
February 10, 1994.
The Contractor for this project is ATEC Associates, Inc.
Of Addison, Illinois.
REASONS FOR CHANGE: This Change Order is required for the costs to
implement the Corrective Action Plan submitted to the Illinois
Environmental Protection Agency (YEPA) .
ADDITIONAL SERVICES TO BE PERFOR)MD: ATEC shall cause
the construction and installation of the groundwater
investigation and groundwater corrective action plan as
set forth in the "Groundwater Investigation and
Corrective Action Plan for the City of Elgin property at
206-280 South Grove Avenue, Elgin, Illinois" prepared by
ATEC Associates, Inc., dated July 1994, as the Same may
be amended and approved by the Illinois Environmental
Protection Agency (IEPA) ATEC shall commence with the
proposed work upon final approval of said plan by the
IEPA and shall complete the installation of the
groundwater remediation system by September 1, 1994. The
additional work under said plan shall include but not be
limited to the following:
1. Install nine groundwater monitoring wells
• The ISPA required that the horizontal and vertical extent
Of groundwater contamination be defined at the South
Grove Avenue properties. This will be accomplished with
the installation of the nine
wells'. groundwater monitoring
2. Install Extraction Well and Perform Pump Test
• To verify groundwater flow conditions prior to the
installation of the full groundwater remediation system,
it will be necessary to install one groundwater
extraction well and perform a pump test.
3. Install Four Extraction Wells
As part of the groundwater remediation system, four
additional groundwater extraction wells must be
installed.

4. Construct Groundwater Piping and Electrical Trenches
• Following the installation of the groundwater extraction
Wells., the remaining portions of the groundwater
remediation system will be installed. This includes the
construction of two shallow trenches for the installation
of groundwater piping and electrical liner. Soils
excavated for the construction of the trench will be
disposed of off site. Following the installation of the
Piping and electrical, the trenches will be backfilled.
The groundwater remediation system will be approved by
the IEPA prior to installation.
S. Construction Preparation and Construction Oversight
• ATEC will coordinate the installation of the groundwater
remediation system and will perform construction
oversight during the installation of the system.
6. Prepare O & M Manual
• Following the installation of the groundwater extraction
system, ATEC will prepare an O & M Manual for the
groundwater extraction and remediation system.
SUMMARY OF CHANGES IN CONTRACT AMOUNT:

Change Order No. 1 the contract for the additional services Will be

Thousand One Hundred Three and 25/100 Dollars ($222,103.25) . The
near revised contract total will be an amount not to exceed Two
Hundred Sixty Thousand Four Hundred seventy Seven and 75/100
Dollars ($260,477.75) .

OTHER CONTRACT PROVISIONS: All other contract provisions of the
original contract agreement of February 9, 1994, shall remain the
same and in full force and effect for the additional work to be
performed under this change order.

SUBJECT: Change Order No. 1 for the Installation
of a Groundwater Remediation System at
206-280 South Grove Avenue
PURPOSE
The purpose of this memorandum is to forward to the Mayor and
City Council Change Order No. 1 for the installation of a
groundwater remediation system at 206-280 South Grove Avenue.
BACKGROUND
As part of a request for specific soil cleanup objectives to
the Illinois Environmental Protection Agency ( IEPA) in Decem-
ber, 1993 for 210 South Grove Avenue and 240 South Grove
Avenue, the City of Elgin stated that it would continue to
investigate the site through groundwater studies and would
design and operate an appropriate groundwater remediation
system.
ATEC & Associates, Inc. (ATEC) was awarded a contract on
February 9, 1994 to sample groundwater at the South Grove
Avenue redevelopment site and to develop a groundwater Correc-
tive Action Plan (CAP) for submittal to the IEPA. The CAP
includes the design of the proposed groundwater treatment
system.
Under recently revised IEPA regulations, a site classifica-
tion plan must be submitted to the agency prior to the devel-
opment of a Corrective Action Plan. The site classification
plan was approved by IEPA in June. The 280 South Grove Ave-
nue site was classified as a high priority site. The Correc-
tive Action Plan which includes the groundwater remediation
system was submitted to the IEPA on July 21, 1994 .
Attached is Change Order No. 1 from ATEC for the installation
of the proposed groundwater remediation system. (The final
draft of the Change Order is not complete and will be present-

ed to the Mayor and City Council prior to the meeting) . ATEC
is proposing a series of five groundwater extraction wells
and the installation of nine additional monitoring wells .
The plan calls for the discharge of the groundwater into the
sanitary sewer system.
The cost estimate of $222, 103 . 25 for the installation of the
groundwater remediation system is a not-to-exceed price. The
estimate is based on ATEC 's experience with the installation
of similar applications at other sites . A cost estimate had
to be submitted as a part of the budget submittal that accom-
panied the Corrective Action Plan document. ATEC will solic-
it bids on behalf of the City for the construction of the
groundwater remediation system and oversee the installation
of the system.
The Hyatt Development Corporation is currently completing the
final grading of the river bank portion of the riverboat
site. The installation of the groundwater remediation system
could not begin until this portion of the site work was com-
pleted.
The installation of the groundwater system must begin early
in August in order to be coordinated with scheduled landscap-
ing activities at the riverboat pavilion site.
Installation of the groundwater remediation system will not
begin until IEPA has indicated that the proposed system is
acceptable and the Fox River Water Reclamation District has
agreed to accept the water discharge.
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
ATEC and the Hyatt Development Corporation will be present at
the meeting on July 27 to answer any questions you may have
regarding the change order.
FINANCIAL IMPACT
The change will result in a $222, 103.25 increase in the con-
tract with ATEC from $38,374 .50 to $260,477 . 75 .
The cost of installing the groundwater remediation system is
eligible for reimbursement from the IEPA Leaking Underground
Storage Tank (LUST) fund.
It is proposed to charge these expenditures to the South
Grove Special Tax Allocation Fund (#260) . Because of the
fund's deficit position (currently $198,988) , a $225,000 loan
from the Risk Management Fund (#630) is proposed.
This loan will be funded by LUST reimbursements already re-
ceived ($136,697 . 00) , the budgeted expenditure for South

Grove Tank Remediation ($100,000 . 00) , and contingency in the
Risk Management Fund ($13,303 . 00) .
A corresponding budget amendment will be presented to the
City Council at the next meeting. Reimbursement to the South
Grove and Risk Management funds should be a priority with any
future gaming proceeds .
LEGAL IMPACT
None.
RECOMMENDATION
It is recommended that staff be directed to execute Change
Order No. 1 for the installation of a groundwater treatment
system at 206-280 South Grove Avenue.
