RESOLUTION
APPROVING CHANGE ORDER NO. 3 IN THE CONTRACT WITH
CLARK DIETZ, INC. FOR THE NORTHWEST AREA INTERCEPTOR SEWERS
WHEREAS, the City of Elgin has heretofore entered into a
contract with Clark Dietz, Inc. for the Northwest Area
Interceptor Sewers; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 3,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Richard B. Helwig, City Manager,
be and is hereby authorized and directed to execute Change
Order No. 3, a copy of which is attached hereto and made a
part hereof by reference.

SUBJECT: Change Order No.3 with Clark Dietz, Inc.
for Construction Engineering Services on
the Northwest Interceptor Sewers
PURPOSE
To provide information to the Mayor and City Council in their
consideration of a Change Order No.3 with Clark Dietz, Inc. ,
for additional construction engineering services on the North
Randall Interceptor Sewer - Tollway Crossing.
BACKGROUND
The City Council awarded an engineering contract to Clark
Dietz, Inc. (CDI) at their June 26, 1991 meeting for the
preparation of plans and specifications, and inspection and
construction engineering services for the two interceptor
sewer projects in the northwest area of the City. The two
projects are the Big Timber-Tyler Creek Interceptor and North
Randall Interceptor.
On May 12, 1993, City Council authorized a Change Order #1 to
CDI 's contract for design engineering additions in the amount
of $37,290.95. These design engineering changes were in
conjunction with the Big Timber-Tyler Creek Interceptor Sewer.
On August 11, 1993, City Council authorized a Change Order#2
to CDI 's contract for construction engineering additions in
the amount of $70,939. 15. These additional services were
primarily in conjunction with construction problems and time-
extensions incurred on the Big Timber-Tyler Creek Interceptor
Sewer.
Work on the Big Timber-Tyler Creek Interceptor Sewer has been
completed and the final payment is in preparation.
Work on the North Randall Interceptor Sewer has been
substantially completed with the exception of the crossing of
the I-90 Tollway right-of-way.

• Since early March, 1994, we have been in negotiations with
the project contractor, Abbott Contractors, for the p
accomplishment of the tollway crossing. A high water table,
loose running sand and the existence of large cobbles has
made the crossing a very difficult activity. Coupled with the
sensitivity of the high traffic volume roadway, and
subsequent strict permit conditions required by the Tollway,
the crossing will be a risky and costly undertaking.

After interviewing several pipe auguring and tunnelling
contractors, and after conducting extensive soil boring and
soil composition and water profile analysis, it has been
concluded that a closed-faced tunnelling process will be the
least risky tunnelling method with the highest probability of
success . We are in final negotiations with Abbott Contractor
for the initiation of the tunnelling work. The tunnel will
either be 54 or 60 inches in diameter for a distance of
approximately 320 feet. We estimate that the work will take
up to six to eight weeks to complete.
The proposed Change Order No.3 with our project construction
engineer Clark Dietz, Inc. , is to provide construction
engineering services for the Tollway crossing. Services will
include: soil borings and soil testing (already
accomplished) , preparation of a final change order with
Abbott Contractors for the work, on-site full time inspection
during the tunnelling work, and other incidental and related
activities, at a cost of $72,200 .
FINANCIAL IMPACT
Additional moneys, in the amount of $265,000 were budgeted in
1994 to supplement the funding for the North Randall
Interceptor Sewer, specifically for the Tollway Crossing.
These additional moneys were budgeted in account
392-0000-795 .92-32 project 339526 .
The proposed Change Order No.3 is in the amount of $72,200,
and will increase the Agreement amount from $423, 130 . 10 to
$495,330. 10, as detailed below:

RECOMMENDATION
It is recommended that City Council approve the Change Order
No.3 and authorize the City Manager to execute the Change
Order in the amount of $72,200.

Re: Engineering Services for Toliway Crossing
North Randall Interceptor
Dear Jim:

As you requested, we are proposing to provide engineering services for the construction of the
Toliway Crossing.
Scope of Services
CDI will assist the City in the negotiation of a change order with Abbott Contractors to
perform the construction of the crossing on a time and material basis.
CDI will subcontract with Terracon to perform soil testing and to evaluate the contractor's
proposed dewatering system. Any cost for Terracon services in excess of the proposed amount
will be an extra to the contract.
CDI will assist the City in obtaining a permit from the Tollway Authority to allow construction
of the crossing.
CDI will provide up to 60 calendar days of Resident Project Representative services. Each day
will consist of 12 hours. If the construction period requires that CDI provide more than 60
days of Resident Project Representative services, the cost of those services will be an extra to
the contract. If the contractor is required or allowed to work more than 12 hours per day, CDI
will provide additional personnel as required and the cost of providing those personnel will be
an extra to the contract.
CDI will review contractor payment requests and prepare a final change order for the City.

BIG TIMBER/TYLER CREEK INTERCEPTOR SEWER - DESIGN & INSPECTION
CHANGE ORDER NO. 3
SCOPE: This Change Order No. 3 covers the extra work
necessary to complete the construction, engineering
and inspection for the North Randall Interceptor
Sewer - I-90 Tollway Crossing.
The Engineer for this project is Clark Dietz, Inc. of
Champaign, Illinois .
REASONS FOR CHANGE: This Change Order No. 3 is required to
reimburse the engineer for construction related engineering and
inspection services for the I-90 Tollway crossing.
The location of the crossing was changed from that originally
included in the construction contract due to the failure on the
part of the City to obtain the necessary original easements . As
the soil and ground water conditions were substantially changed
from the original Tollway crossing alignment, the work in .this
Change Order No. 3 was not known and was not reasonably
foreseeable at the time of the letting of the contract.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount of the
contract will be revised as follows :

two hundred ( $72,200 . 00) dollars, the total contract value being

10/100 ( $495, 330 . 10) dollars .
