RESOLUTION
AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN AGREEMENT WITH
BURNIDGE CASSELL & ASSOCIATES, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard- B. Helwig, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute Amendment No. 1 to an Agreement on behalf of the
City of Elgin with Burnidge Cassell & Associates, Inc. for
engineering services for the reopening of South Grove Avenue,
a copy of which is attached hereto and made a part hereof by
reference.

Amendment No. 1
This Amendment No. 1 entered into this day of June, 1994,
by and between the City of Elgin, an Illinois municipal
corporation (hereinafter referred to as "CITY" ) and Burnidge
Cassell & Associates, Inc. (hereinafter referred to as
"ENGINEER" ) , shall modify that Agreement dated 17 August, 1993
and Change Order #1, whereby the ENGINEER was engaged by CITY to
perform certain professional services in connection with the
preparation schematic engineering and design development plans
for the Fountain Square Plaza (South Grove Avenue) Reopening
(hereinafter referred to as "PROJECT" ) .
Whereas the CITY desires to expand the scope of services of the
ENGINEER to include the furnishing of certain additional
professional services in connection with the preparation of
plans, specifications, materials lists and estimates of cost, of
the engineering phase of the PROJECT.
In response to these additional services, certain revisions must
be made to the Agreement. In compliance, therefore, the terms
and conditions of the Agreement are modified as specifically set
out below. All other parts of the Agreement remain unchanged.
I. SCOPE OF SERVICES:
Paragraphs I .B. and I .0 are amended to include the
following additional services :
B. In general, the additional work will consist of the
preparation of construction documents and the
preparation of quantities, and cost estimates for Phase
I of the Fountain Square Plaza Reopening (based upon
option #2 as approved by City Council on May 4, 1994) ,
as follows :

It is understood that the Scope of Services detailed
under paragraphs I .B and I .C. herein above may not be
all-inclusive, and that other services incidental and
necessary for the accomplishment of the work are
included in this Amendment No. l as if specifically
listed.
Paragraph I . is further amended to add the following
additional Paragraphs I .D. and I .E:
D. The scope of services as defined in paragraphs I .B. and
I .C. above are limited to Phase I improvements defined
as : Grove Avenue between the south curb of Chicago
Street and the east curb of Spring Street, plus South
Grove Avenue between Fulton Street and Prairie Street,
all as outlined on Attachment C. to this Amendment No. l .
E. The CITY has engaged the services of a Construction
Manager for the implementation of the project. ENGINEER
will at all times participate and cooperate with the
Construction Manager. The ENGINEER shall contract
separately with Elgin Riverboat Resort for Construction
Engineering related services .
IV. PAYMENTS TO THE ENGINEER:
Section IV. has been amended by adding the following
additional paragraphs IV.D. and IV.E:
D. The CITY shall reimburse the Engineer for services
performed under this Amendment No. l at the hourly rates
listed in Attachment D to this Amendment No. l, and
reimbursables with the total payment for this Amendment
No. l not to exceed two hundred seventy five thousand
($275,000 .00) dollars including fees and reimbursables,
regardless of the actual costs incurred by the ENGINEER
unless substantial modifications to the scope of the
work are authorized by the CITY through a change order
or amendment.

IN WITNESS WHEREOF, the undersigned have placed their hands and
seals upon and executed this Amendment No. 1 in triplicate as
though each copy hereof was an original and that there are no
other oral agreements that have not been reduced to writing in
this statement.

ATTACHMENT B
SCOPE OF SERVICES
Task 1. Project Administration/Community Relations -the ENGINEER
will interface with mall business owners to coordinate scheduling
and address access to businesses throughout project. The
ENGINEER will also provide information to the CITY for a weekly
newsletter to be disseminated to all interested parties. Periodic
meetings with the CITY regarding the project status will be
recorded with meeting minutes taken by the ENGINEER.
Task 2. Survey
Contract with Surveying Company to be a reimbursable expense
under the Agreement. Provide survey services within the Project
Area to define;
1) all building lines (assumed property lines) as well as
awnings, posts and canopies, on both sides of Grove
Avenue between Chicago Street and Prairie Street, and
shall include the area of DuPage Street fifty (50) feet east of
Grove Avenue;
2) curb line geometrics and spot elevations f roni

3) the location and elevation of all corners and doorways,
including recessed doorways;

5) the location of all electric, phone, gas and other utilities after
each respective utility owner marks the location in the field;

7) the pedestrian 'alley', south of the Crocker Theatre between
Grove Avenue and the Fox River, from the parking lot to the
south face of the building;
8) locate and dimension the existing fountain vault.
The survey will be produced in AutoCAD format. A work drawing
will also be produced showing hand written elevations, inverts,
sizes and building dimensions.
Task 3. Soil/Material Borings. Approximately twelve (12) borings along
the roadway length will be performed to determine the bearing
capacity and depth of existing pavements. Soil borings will be
performed in the fountain/clock tower locations as needed to
design their foundations. Soil borings will be performed by a soil
testing firm and will be a reimbursable expense to the contract.
Task 4. Design Development. Provide services to update and finalize the
design development plans.
Task 5. Construction Documents. Drawings and specifications will be
prepared which address all the elements listed below.
A. DEMOLITION :- showing the removal of all existing items necessary
to accommodate the proposed improvements, including;
- road pavement, curbs
- any concrete walks adjacent to the project
- all underground utilities to be abandoned/or removed
- all vaults to be filled (if required)
- all paved surfaces
- all architectural elements; the fountain, the centrum, the
kiosks, the clock structure
- all site furnishings such as bollards, light fixtures, tree
planters
- all trees, including those to be relocated to another site.
B. GRADING - showing proposed finished grades by means of spot
elevations, typical cross-sections, profiles, etc. as necessary to
illustrate construction of the new roadway, pedestrian pavements,.
and other improvements.
C. SITE LAYOUT -showing the extent and location of all proposed
improvements, including the following;
decorative pavers
scored concrete sidewalk
roadway pavement and curbs
handicap ramps
roadway striping
crosswalks
traffic signals
regulatory signs
clock tower (foundation only)
fountain
irrigation
all other streetscape elements;kiosks, bollards, trees, tree
grates, pedestrian light fixtures, benches, waste
receptacles, entryway monuments, amenity signage and
banners.
D. DETAILS - detail sections, elevations, catalog cuts and other
drawings confirming the actual material selection and illustrating
the extent and type of construction will be provided for each
element listed above.
E. IRRIGATION -showing the extent and location of the irrigation
system for the nineteen (19) street trees, as well as the plantings at
the fountain base. The plan will address the piping system,
backflow prevention, sleeving system, control system and moisture
sensor details.
F. UTILITIES -showing the required repairs, connections or
replacement of existing service including electric, storm, and water
mains. Plans will also address line relocation as required to
accommodate improvements. Plans will include sleeving for
electric and irrigation lines, if necessary. Provisions will be made
for existing roof drains, and new underdrains for tree wells. Details
and profiles will be provided as necessary.
G. LANDSCAPE -showing the location, species and sizes of all new
street trees (19), plants at the fountain base and any other
landscaping.
H. LIGHTING -showing any service connection location and detail,
control panels, pedestrian lighting layout, wiring diagram, special
fountain lighting, supplementary lighting outlets, entry monument
wiring stub, and clock tower lighting stub. Uniformity ratios, lamp
type, wattage, lumens and color of lights will all be detailed.
I. TRAFFIC SIGNALIZATION - addressing the proposed signal
modifications at the intersections of Chicago/Douglas, Grove,
Spring and Fulton, and Highland/Douglas.
J. SPECIFICATIONS - prepare technical specifications to further
describe construction and/or material requirements for all
construction outlined above. Technical specifications will be
referenced (where applicable) to standard specifications for similar
public works improvements.
Task 6. Coordination with Utilities -the ENGINEER will coordinate all
proposed utility work with the respective utility owner.
Task 7. Quantity List -the ENGINEER will prepare a list of quantities for
every item identified in the construction documents.

Addition to Amendment No. 1
ENGINEER will not be responsible for any services to be provided on private
properties without the written consent of those property owners. This permission
for services and access to be obtained by the CITY on behalf of the ENGINEER.
In some instances the entry stairs to private properties extend into the street
right-of-way. It will be the responsibility of the CITY to determine the manner in
which these stairways are altered (if altered) and whether any changes
constitute the need to implement handicap accessibility standards.

Re: Fountain Square Plaza Reopening
Dear Mr. Kristiansen:
Enclosed is a memorandum from Rich Klatt of Walker concerning the extension
of Grove Avenue south from Chicago Street through Fountain Square. Also
attached is a report from Barton-Aschman, the Traffic Consultants for Hyatt
Development, which reviewed the traffic recommendations presented in our
Plan.
In addition to the comments contained in the above mentioned reports, I would
like to offer the following comments.
Traditionally, Fountain Square has symbolized the center of Elgin. With the
opening of Fountain Square Plaza, I believe this area will again become a focal
point. If Grove Avenue is extended south, the area for the fountain and the
future clock tower can not be realized. In the Sasaki plan, this area was
envisioned as a public plaza area, which is what is proposed in our Plan. The
fountain at Fountain Square will provide a place of beauty for flowers, a small
plaza with benches and a place for people to meet.
The purpose for not putting Grove Avenue through was to eliminate a difficult
intersection where Grove and Douglas come together. This location is further
complicated by the Union Bank drive-up location. We believe this piece of
roadway would do much more to complicate and disrupt both vehicular and
pedestrian traffic than it would offer to expedite traffic. Referring back to the
Sasaki Master Plan, Grove was not to connect to Douglas.

The process that evolved the plan included many property owners and business
owners. This Ad Hoc Committee worked very hard and were responsible for the
decisions that led to the final design presented to the Elgin City Council. The
change suggested will not only compromise the design of the plaza opening, but
will add to delays in signalization and redesign of the intersection.
In a conversation with John Ryden of Hyatt Corporation, he indicated he had
asked Barton-Aschman certain questions about the Plaza Reopening design:
1. Should traffic by one way or two way?
2. Should the Fulton/Grove intersection flow freely south or as
designed?
In all cases, Barton-Aschman concurred with the design and the conclusions of
the Architects and Engineers that created the Fountain Square Plaza.
For the reasons listed above, it is my feeling that Elgin and the center of our City
is best served by the design as presented on May 4, 1994.

Dear John:
Per your request, we have reviewed the traffic study conducted by Walker regarding the opening
of Fountain Square Plaza to vehicular traffic.The study by Walker compdred the advantages and
disadvantages of allowing two-way traffic versus one-way traffic on Grove Avenue between
Chicago Street and Fulton Street.
Based on our review, we offer the following comments:
a Opening Fountain Square Plaza to traffic will be beneficial to area traffic, including Ron
Riverboat traffic, in that it will provide an additional link in the downtown area, thus
reducing the traffic loads on parallel routes, such as Spring Street.
• Aarton-Asehman also roeornmends allowing two-way traffic on Grove between Chicago
Street and Fulton Street in order to better serve the riverboat traffic by providing inbound
and outbound site traffic with alternative routes.
• Given the implementation of the recommended geometries at the intersection of Grove
Avenue and Fulton Street (page 3 of Walker's memorandum), it is our opinion that the
intersection will adequately accommodate the riverboat's traffic traversing it.
• We suggest that it might be more appropriate to use signage to direct inbound and outbound
site traffic to travel on Spring Stetet versus Grove Avenue(through Fountain Square Plaza).
This route would allow vehicles to avoid making turns (right turns for inbound traffic and
left turns for outbound traffic) at Grove/Fulton.

Per your request, I am responding to the following comments from the city of Elgin:
�. Connecting Grove Avenue across Chicago Street to join Douglas Street extended south.
• A designated right turn lane for eastbound Chicago Street at Fountain Square (Douglas
Street).
• Right turn radii on Chicago Street at Douglas Street and on Grove Avenue at Spring
Street.
Grove Avenue Connection
Continuing Grove Avenue at Chicago Street southerly at Fountain Square was considered as
one of the alternatives in the functional design phase of the re-opening of Fountain Square.
From a traffic perspective it was rejected for the following reasons:
• Grove Avenue at the Fountain Square intersection would require a stop or yield sign
for southbound Grove Avenue traffic. Grove Avenue however, does not intersect
Douglas Street at the desirable right angle which then could create some traffic safety
concern.
• very little traffic now travels on Grove Avenue between Highland Avenue and Chicago
Street (presently 75 vehicles during the evening peak hour) or would travel south on
Grove Avenue, thus there would be very little benefit in continuing Grove Avenue
south to connect to the reopened Fountain Square Plaza.
• This connection would create two additional roadway crossings for pedestrians.
The future level of service (LOS) at Chicago Street and Douglas Street; Chicago Street and
Grove Avenue; and Grove Avenue and Douglas Street with the Grove Avenue connection were
calculated. The conclusion is that the future LOS at both of the Chicago Street intersections
will be the sane with or without the connection. The LOS of the additional intersection
formed by this connection, Grove Avenue and Douglas Street, under stop sign control Would
be "A"

Chicago Street Right Turn Lane
The amount of eastbound Chicago Street traffic estimated to turn right at Fountain Square
during the afternoon peak hour, after the opening of the Riverboat Resort, is 194 vehicles or
about three vehicles per minute. The future afternoon LOS with a designated right turn was
calculated. With this right turn lane, the future LOS will remain at "B". since the LOS will
be very good ("B") without this designated right turn lane, a designated right turn lane is not
recommended.
Right Turn Radii
To provide for a softer right turn for Riverboat Resort bound traffic, a iadius of 30' is
recommended for the southwest corners of Chicago Street and.Douglas Street: and Spring
Street and Grove Avenue. -

SUBJECT: Amendment No. 1 to an Agreement with
Burnidge Cassell and Associates
PURPOSE
To provide information to the Mayor and City Council for
their consideration of an Amendment No. l to an agreement with
Burnidge Cassell and Associates to provide professional
engineering related services for the reopening of Fountain
Square Plaza (South Grove Avenue) .
BACKGROUND
On August 17, 1993, the City entered into an agreement with
Burnidge Cassell and Associates to provide schematic
engineering and design development plans for the Plaza
reopening in the amount of $74,974 . On December 1, 1993, the
final schematic-design development plans were presented to
City Council for approval. Consideration of approval was
tabled until May 4, 1994, at which time City Council approved
the scheme identified as Option #2.
This Amendment #1 amends the Scope of Services by including
the preparation of plans, specifications, quantities and cost
estimates as required by Elgin Riverboat Resorts (ERR) and
their construction manager Pepper Construction Company,
necessary to "fast track" the construction of the project.
ERR will determine the number of bid packages and the content
of the bid documents required, the level of bid document
specificity as well as the delivery dates of each bid
package. The cost for Amendment No. 1 engineering services
is $275,000.
Burnidge Cassell and Associates will contract separately with
ERR to provide for construction engineering services for the
review and interpretation of the work, rejection of defective
work, on-site inspections, testing of materials, shop drawing
reviews, bidding and negotiating prices with contractors, etc.

FINANCIAL IMPACT
A budget of $275,000 has been included in 1994 under account
393-0000-795. 93-80 project, 339517, for engineering services
related to the preparation of plans and specifications. The
increased scope of services will result in increasing the
Agreement amount by $275,000 to an adjusted Agreement amount
of $352,579 .
LEGAL IMPACT
None.
RECOMMENDATION
That the City Council authorize the City Manager to execute
Amendment No. 1 to the Agreement with Burnidge Cassell and
Associates for the Fountain Square Plaza Reopening (South
Grove Avenue) .
