HomeMy WebLinkAbout94-139 Resolution No. 94-139 RESOLUTION ESTABLISHING PREVAILING WAGE RATES ON PUBLIC WORKS CONTRACTS WHEREAS, 820 ILCS 130/1, et seq. entitled "AN ACT regulating wages of laborers, mechanics, and other workers employed in any public -works by the State, county, city or any public body or any political subdivision or by any one under contract for public works. " requires that any public body awarding any contract for public work, or otherwise undertaking any public works as defined herein, shall ascertain the general prevailing hourly rate of wages for employees engaged in such work; and WHEREAS, said Act further provides that if the public body desires that the Department of Labor ascertain the prevailing rate of wages, it shall notify the Department of Labor to ascertain the general prevailing wage rate; and WHEREAS, at the request of the City of Elgin the Department of Labor has determined the prevailing rate of wages for construction work in Cook and Kane Counties in the State of Illinois. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the determination of the prevailing wages as made by the Department of Labor, copies of which are attached hereto and made a part hereof by. reference, are adopted by the City of Elgin. BE IT FURTHER RESOLVED that all contracts for public work of the City of Elgin shall include a stipulation to the effect that not less than the prevailing rate of wages as found by the Department of Labor shall be paid to all laborers, workers and mechanics performing work under the contract. BE IT FURTHER RESOLVED that all contract bonds for public works shall include a provision to guarantee the faithful performance of the prevailing wage clause as provided by contract. BE IT FURTHER RESOLVED that a copy of the prevailing wage rate as established by the Department of Labor shall be publicly posted and kept available for inspection by any interested party. IL. DEPT. The following list is considered as those days for which holiday rates of wages for work performed apply: New Years Day, Memorial/Decoration Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day, Christmas Day. Generally, any of these holidays which fall on a Sunday is celebrated on the following Monday. This then makes work performed on that Monday payable at the appropriate overtime rate for holiday pay. Common practice in a given local may alter certain days of celebration such as the day after Thanksgiving for Veterans Day. If in doubt, please check with IDOL. Class 5. Oilers. Other Classifications of Work: For definitions of classifications not otherwise set out, the Department generally has on file such definitions which are available. If there is no such definition on file, the Bureau of Labor Statistics SIC list will be used. If a task to be performed is not subject to one of the classifications of pay set out, the Department will upon being contacted state which neighboring county has such a classification and provide such rate, such rats being deemed to exist by reference in this document. Further, if no such neighboring county rate applies to the task, the Department shall undertake a special determination, such special determination being than deemed to have existed under this determination. LANDSCAPING Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver. The work performed by landscape plantaman and landscape laborer is covered by the existing classification of laborer. The work performed by landscape operators (regardless of equipment used or its size) is covered by the classifications of operating engineer. LANDSCAPING Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver. The work performed by landscape plantsman and landscape laborer is covered by the existing classification of laborer. The work performed by landscape operators (regardless of equipment used or its size) is covered by the classifications of operating engineer. The work performed by landscape truck drivers (regardless of size of truck driven) is covered by the classifications of truck driver. By law, this is to occur during the month of June. Often the wage rates established by the Illinois Department of Labor are automatically adopted by municipalities. Landscape industry wage classifications are not recognized in those rates. And, those rates are not those that prevail in the landscape industry. What this means is that you, your taxpayers and your contractors spend thousands of unnecessary dollars on landscape projects. The Illinois Department of Labor prevailing wage rate reflects a misclassification of landscape work as "construction laborer" at $19.95 plus nearly $4 in fringe benefits. On March 19, 1993, the U.S. Department of Labor re-established the enclosed landscape classifications in ten northern Illinois counties based on the results of a lengthy wage survey of building, residential, heavy and highway projects. These classifications further prove that the rates used by the State of Illinois are not those that prevail in the industry. In addition, there are in effect bargaining agreements with both the Teamsters and Operating Engineers for landscape work. Today, everyone faces both tightening budgets and greater needs for spending. Here is at least one area where you can save significant dollars. We encourage you to exercise your prerogative and responsibility to establish fair and representative wages rates for your construction projects by using the wages that prevail in the industry. Survey your area for representative wage rates. This process has been successfully tested in court by a local governing body (Circuit Court for the 16th Judicial Circuit, Kane County, Illinois Gen. All empoloyees who have been employed for a full season and who have not worked less than 1200 hours shall be entitled to one week of vacation pay. Employees who have worked 3 or more consecutive full seasons and worked at least 1200 hours per season, shall be entitle to 2 weeks of vacation pay.
