RESOLUTION
AUTHORIZING EXECUTION OF AN AGREEMENT FOR SOIL TESTING
WITH HABITAT FOR HUMANITY, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to
execute an Agreement for Soil Testing on behalf of the City of
Elgin with Habitat for Humanity, Inc. for the property located
at St. Charles and Dixon Streets, a copy of which is attached
hereto and made a part hereof by reference.

AGREEMENT FOR SOIL TESTING
This agreement is entered into this to day of
, 1993, by and between the CITY OF ELGIN,
a municipal corporation, (hereinafter referred to as "City" ) ,
and HABITAT FOR HUMANITY, INC. , a not-for-profit corporation,
(hereinafter referred to as "Habitat" ) .
NOW, THEREFORE, in consideration of the mutual
provisions contained herein, the parties hereto agree as
follows :
1 . City shall permit Habitat or its representatives
to conduct up to 10 soil borings on the property located at

2 . Habitat shall fill and level and otherwise
return the subject property to its original condition.
3 . Habitat shall indemnify and hold harmless the
City and its employees, agents, and assigns against any and
all liability, causes of action, suits, and claims for damages
which may arise out of or in connection with the subject of
this agreement.

SUBJECT: Authorization of Soil Test on City Property
Located at St. Charles and Dixon Street
and Consideration of Sale of the Property
to Habitat for Humanity
PURPOSE:
The purpose of this memorandum is to advise the Mayor
and City Council that Habitat for Humanity has requested that
the City of Elgin consider the sale of four city owned lots
at St. Charles Street and Dixon Street to Habitat, at a nomi-
nal fee, for the construction of four new single family
homes. Prior to starting construction, Habitat would like to
make several soil borings on the property to determine if the
sites are buildable.
BACKGROUND:
The property in question is the former site of a City
Water Department facility. The buildings on the site were
demolished in 1989 . The property had been zoned Service
Business District but was changed to RC3 when the zoning
ordinance was recently revised. This classification only
allows for the construction of single family homes. Habitat
is interested in constructing four new homes on the site, but
wishes to do some investigation to determine if the method of
demolishing the buildings that had been on the site will
impact any new construction.
FINANCIAL IMPACT:
None.
RECOMMENDATION:
Authorize the City Manager to enter into an agreement
F for soil testing with Habitat for Humanity for property locat-
ed at St. Charles Street and Dixon Street. If the property
proves to be suitable for the construction of new homes, the
City Manager is also authorized to enter into a real estate

Dear Ray:
With regard to the several conversations we have had concerning the
four lots belonging to the City on the southwest corner of St. Charles and
Dixon Streets, Habitat respectfully requests that these lots be donated to
rour local affiliate. We would then build houses on these lots for sale to
low income families as we did on the lot at the corner of Gifford and
Hickory Place.
If the City Council feels this request can be filled, we would like to
make some test borings in the property before we take responsibility for
it. The old well site has the potential for building problems which we
might not be able to overcome financially, so we would like to check
first. Enclosed is an agreement for soil testing which we have signed and
which can be used if this request is granted.
