City Engineer City of Elgin 150 Dexter Court Elgin, Illinois 60120 Subject: Amendment No. 1 Area II Special Assessment Project City of Elgin Dear Mr. Dahl: This amendment to WVP Corporation's January 14, 1991, Agreement with the City of Elgin for the Area II Special Assessment Project changes WVP's scope and compensation to include construction phase services during calendar year 1993. This supersedes our January 22, July 8, and October 8, 1992 submittals. In general, WVP will not provide complete construction phase engineering services but rather will assist the City by providing construction staking services. On- Site representatives and/or record drawings can be provided as additional services. The following changes to the January 14, 1991 Agreement are made: • Delete paragraph 1.m. of THE ENGINEER AGREES. WVP will not be responsible for materials testing. This is the LA's responsibility. • Replace paragraph 1.n. of THE ENGINEER AGREES with the following: 1.n Furnish or cause to be furnished: Establishment and setting of lines and grades. • Replace paragraph 3 of THE LA AGREES with the following: 3. To pay for services stipulated in paragraphs 1n and 6 of THE ENGINEER AGREES at the hourly rates stipulated below for personnel assigned to this SECTION as payment in full to the ENGINEER for the actual time spent in providing these services. The hourly rates include profit, overhead, readiness to serve, insurance, social security and retirement deductions. Traveling and other out-of-pocket expenses will be reimbursed to the ENGINEER at his actual cost. The estimated upper limit of the ENGINEER'S compensation is $120,000. The ENGINEER shall not exceed this amount without prior approval of the LA. Subject to the approval of the LA, the ENGINEER may sublet all or part of the services provided under paragraphs 1n and 6 of THE ENGINEER Page 1 of 2 Chicago St. Louis Decatur AGREES. If the ENGINEER sublets all or part of this work, the LA will pay the cost to the engineer plus a five (5) percent service charge. "Cost to the ENGINEER" to be verified by furnishing the LA copies of invoices from the party doing the work. The classifications of the employees used in the work should be consistent with the employee classifications for the services performed. If the personnel of the firm perform routine services that should normally be performed by lesser salaried personnel, the wage rate billed for such services shall be commensurate with the work performed. In the event the services of the ENGINEER extend beyond December 31, 1993, the hourly rates will be adjusted yearly by addendum to this AGREEMENT to compensate for increases or decreases in the salary structure of the ENGINEER that are in effect at that time. If the above changes are satisfactory, please execute all four (4) amendments and return one signed amendment to my attention at the above address. Rice, City Manager SUBJECT: Area II Special Assessment Project Engineering Agreement Amendment No. 1 PURPOSE: This memorandum will provide the Mayor and Council with information to consider authorizing execution of the subject amendment. BACKGROUND: The City Council on January 9, 1991 authorized an engineering agreement with WVP Corporation for the design of various improvements to be included in the subject project. A copy of that agreement is attached hereto. Included in that agreement also is the provision for WVP to provide construction engineering services, but only upon written authorization by the City Council . The services to be provided were material testing, a full time resident engineer and full time inspectors and technicians, the number to be determined by the City, to perform the work specified in the agreement. However, we have decided that it would be in the City's best interest if we used our own in-house engineering personnel to provide for full time resident engineer and inspectors, but use WVP personnel to establish and set the lines and grades for the storm sewers and pavements. We are unable to provide the necessary manpower for setting of line and grade because of our commitments to other ongoing City projects. Attached for your consideration is a copy of Amendment No. 1 which provides for the construction staking services. I Mayor and Members of the City Council February 4, 1993 Page 2 FINANCIAL IMPACT: It is estimated that it will cost a maximum of $120,000 for WVP to provide the necessary construction staking services. This could be paid for from the money budgeted in the Area II Construction Fund (381-00-00-795.92 .80) . RECOMMENDATION: It is recommended that the City Council authorize the City Manager and City Clerk to execute Amendment No. 1 to the original engineering contract with WVP Corporation in the not to exceed amount of $120,000.
