HomeMy WebLinkAbout93-313 Resolution No. 93-313 RESOLUTION AUTHORIZING EXECUTION OF A VEHICLE STORAGE AGREEMENT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that George VanDeVoorde, Mayor, and Dolonna Mecum, City Clerk, be and are hereby respectively authorized and directed to execute a Vehicle Storage Agreement with Ohm's Car Care, Inc. for the storage of vehicles at 35 Walnut Avenue, Elgin, Illinois, a copy of which is attached hereto and made a part hereof by reference. s/ George VanDeVoorde George VanDeVoorde, Mayor Presented: December 15, 1993 Adopted: December 15, 1993 Vote: Yeas 4 Nays 1 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk A 4 _ VEHICLE STORAGE AGREEMENT THIS AGREEMENT entered into this /7 day of ,.®e'c,,,h1 6,; 1993, by and between the City of Elgin, a municipal corporation (hereinafter referred to as the "City" ) and Ohm' s Car Care, Inc. , an Illinois corporation (hereinafter referred to as "Ohm' s Car Care" ) . WHEREAS, the City of Elgin Police Department requires a location to store seized vehicles; and WHEREAS, Ohm's Car Care has a secure facility suitable for the storage of such seized vehicles at 35 Walnut, Elgin, Illinois . NOW, THEREFORE, for and in consideration of the mutual promises and undertakings as set forth herein, and other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows: 1 . Ohm' s Car Care agrees to supply the City with a secure storage lot (hereinafter referred to as the "subject property" ) at 35 Walnut Avenue, Elgin, Illinois, for vehicles seized by the City of Elgin Police Department. Inside storage at the subject property shall be available upon request of the City. 2 . The parties hereto further agree to the following procedures regarding the storage of vehicles at the subject property: (a) Vehicles shall be accepted for storage during regular business hours . (b) Stored vehicles shall be available for inspection and release during regular business hours. (c) Ohm' s Car Care agrees to disconnect batteries of stored vehicles . A ,r .t - (d) Ohm's Car Care agrees to assist in the starting of vehicles being released from storage so long as no • mechanical work or parts are required. (e) Ohm's Car Care agrees not to release any of the stored vehicles without written approval from a Police CAG Unit Supervisor. ( f) The City agrees to pay Ohm' s Car Care $500 . 00 per month for each month vehicles are stored in the secured lot at the subject property. 3. Ohm' s Car Care hereby further agrees to indemnify and hold harmless the City, its officers, employees and agents from and against any and all damages, losses, claims, causes of action, lawsuits, losses, suits, judgments or any and all liability whatsoever arising out of damage to or claims of damage to vehicles while stored on the subject property. Ohm' s Car Care shall maintain general comprehensive liability insurance against claims for damage to vehicles while stored on the subject property. 4 . This agreement shall continue from month-to-month until terminated in writing by either party. Either party may terminate this agreement with a ninety (90) day advance written notice to the other party. Maim, Interim City Manager SUBJECT: Seized Vehicle Storage PURPOSE To provide adequate and safe storage of vehicles seized pursu- ant to asset forfeiture proceedings. BACKGROUND For the past year, the Police Department has been renting 1D space at 200 Brook Street from the Roth 1992 Gift Trust for the secure storage of seized vehicles . These vehicles, once properly processed and titled, are sold at public auction and the proceeds are used to purchase equipment to support future drug operations . The current site, although adequate in size, is extremely damp due to deteriorating conditions of the structure. The vehicles stored there have been damaged by mildew, which depreciated their value. The Department has identified an alternative site - Ohm's Care Care, 315 Walnut - which would permit outside storage of some units and inside dry storage of more valuable ones. In addition, the storage provider has agreed to do maintenance and conditioning, such as battery changing and starting, not presently afforded under the present arrangement. The current lease for space at 200 Brook Street expires December 31, 1993. After that date, the lease is subject to month-by-month renewal. The existing lease requires a 30 day cancellation notice. FINANCIAL IMPACT The present lease is for $700/mo. , plus electricity. The new agreement is for $500/mo. This is a savings of $2,400 per year, of which funds are budgeted. r Mayor and Members of the City Council November 23, 1993 Page 2 em. RECOMMENDATION Staff recommends that a cancellation notice be give for the leased property at 200 Brook Street and that the City enter into an agreement with Ohm's Car Care for seized vehicle storage.
