Resolution No. 93-310 RESOLUTION APPROVING CHANGE ORDER NO. 2 IN THE CONTRACT WITH ATEC ASSOCIATES, INC. FOR AN ENVIRONMENTAL ASSESSMENT OF SOUTH GROVE AVENUE WHEREAS, the City of Elgin has heretofore entered into a contract with ATEC Associates, Inc. for an environmental assessment of South Grove Avenue; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 2, attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Robert 0. The Contractor for this project is ATEC Associates, Inc. of Addison, Illinois REASONS FOR CHANGE: This Change Order is required for the costs associated with the items requested by staff to complete the following work. 1 . Oversight of the removal of soils from the underground and aboveground storage tank areas and soil sampling following the removal of soil at 210 South Grove Avenue. Additional soil sampling and analysis at 222-270 South Grove Avenue. Following discussions with the Illinois Environmen- tal Protection Agency ( IEPA) , it will be necessary to remove additional soils at 210 South Grove Avenue ( former D. H. Martin property) . Since it is neces- sary to excavate additional soils, ATEC requires additional time for oversight of activities . It will be necessary to collect confirmation soil samples for analysis following the removal of con- taminated soils . To ensure that soil removal from the site is dis- posed of properly, it will be necessary to conduct additional soil sampling at the 222-270 South Grove Avenue property prior to commencement of activities by Hyatt. Twenty-three borings will be dug to a depth of three feet. 2 . Environmental services associated with the 210 South Grove Avenue and 222-270 sites . Following the completion of field activities as described in Item 1, ATEC will require additional time for preparation of reports for submittal to the IEPA and meetings and discussions with the IEPA. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount of contract will be revised as follows : ITEM COST CHANGE Item 1 Add $30, 106 . 82 Item 2 Add $15,000 . 00 The present contract with ATEC is for $57,581 . 70 . By reason of Change Order No. 2, the contract for the additional over- sight and additional services will be increased in the amount of Forty-Five Thousand One Hundred and Six and 82/100 Dollars ($45, 106 . 82) . The new revised contract total will be One Hundred and Two Thousand Six Hundred Eighty Eight and 52/100 Dollars ($102,688 .52) . Malm, Interim .City Manager SUBJECT: Change Order No. 2 With ATEC Associates, Inc. for Additional Oversight and Services at 210 South Grove Avenue and 222-270 South Grove Avenue PURPOSE The purpose of this memorandum is to forward to the Mayor and City Council Change Order No. 2 for additional oversight and services at the former D. H. Martin site at 210 South Grove Avenue and the property located between 222-270 South Grove Avenue. BACKGROUND ATEC Associates, Inc. (ATEC) was awarded a project to prepare plans and specifications for the removal of three underground storage tanks and nine aboveground storage tanks at 210 South Grove Avenue. ATEC's scope of work also included the review of a previously completed report, installation of soil bor- ings, remediation oversight and report preparation of the property located between 222-270 South Grove Avenue. The plans and specifications prepared by ATEC for 210 South Grove Avenue additionally included the removal and disposal of 150 cubic yards of soil from the underground storage tank area, and 350 cubic yards of soil from the aboveground storage tank area. Subsequently, a contract was awarded to BGS and Associ- ates (BGS) for the project. On November 17, 1993, the City Council authorized Change Order No. 1 for $25,917 .70 with ATEC. Change Order No. 1 authorized additional expenses related to subcontractor evalu- ation, oversight for the removal of additional soils and soil sampling, surveying expenses and services related to disposal of contaminated water from the basement of the Martin build- ing. Change Order No. 2 November 29, 1993 Page 2 Change Order No. 2 from ATEC authorizes oversight expenses related, to the removal of an additional 600 cubic yards of soil from the D. H. Martin site as well as the performance of certain tests to determine that all the contaminated soils have been removed. Since the top three (3) feet of soil on the pavilion site must be removed from the site, it is necessary to place 24 borings to a depth of three (3) feet in order to ensure that the soil is properly disposed of when it leaves the site. The total amount of the change order is $45, 106 . 82 . ATEC will be present at the meeting of December 1, 1993 to answer any questions you may have regarding the change order. FINANCIAL IMPACT The change will result in a $45, 106 . 82 increase in the con- tract with ATEC from $57,581.70 to $102,688 .52 . A portion of the oversight and sampling activities may be eligible for reimbursement from the Illinois leaking underground storage tank fund and will be paid from the Risk Management Fund (#630) . RECOMMENDATION It is recommended the staff be directed to execute Change Order No. 2 for the additional oversight and services . Robert 0.
