RESOLUTION
AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL
AGREEMENT WITH ELGIN TOWNSHIP
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that George VanDeVoorde, Mayor, and Dolonna Mecum,
City Clerk, be . and are hereby authorized and directed to
execute an intergovernmental agreement on behalf of the City
of Elgin with Elgin Township for payment and reimbursement of
a PACE Dial-a-Ride Local Share Agreement, a copy of which is
attached hereto and made a part hereof by reference.

INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CITY OF ELGIN AND ELGIN TOWNSHIP
FOR PAYMENT FOR BUS SERVICES
WHEREAS, due to circumstances, Elgin Township is unable at the
present time to pay the expenses of the PACE Dial-a-Ride Local
Share for providing bus services in the Township during the period
from October 4, 1993 through December 31, 1993; and
WHEREAS, the City of Elgin desires to facilitate the provision
of such services for the benefit of its citizens and others who
might benefit from it; and
WHEREAS, it is in the best interests of both Elgin Township
and the City of Elgin that the bus services be provided; and
WHEREAS, the City of Elgin is authorized to enter into this
intergovernmental agreement pursuant to the Intergovernmental
Cooperation Act, 5 ILCS 220/3; and
WHEREAS, Elgin Township is authorized to enter into this
intergovernmental agreement pursuant to the Illinois Township Act,
60 ILCS 5/13-20.
NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS SET FORTH
HEREIN, IT IS AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS:
1. The City of Elgin shall pay to Elgin Township, for the
purpose of the Township paying for PACE Dial-a-Ride Local Share
charges for bus service to be provided during the period October
4, 1993 and December 31, 1993, a sum not to exceed Six Thousand
Seven Hundred and Forty-One and No/100 ( $6741.00) Dollars.
2. Elgin Township shall reimburse the City of Elgin the total
amount advanced by the City for this purpose, without interest, and
in full, not later than December 31, 1994.
3. The funds to be paid under this agreement shall be paid
by the City to the Township on or before November 15, 1993, and
Elgin Township shall deliver to the City of Elgin a copy of the
pertinent invoice submitted to the Township by PACE for the
services in question in support of its request for funds pursuant
to this agreement.
4. This agreement shall take effect at such time as a
resolution authorizing its execution has been passed and approved
by each of the municipalities which are parties hereto. This
agreement may be executed in duplicate counterparts containing the
authorized signatures of both the City of Elgin and Elgin Township.
Each- party shall provide to the other a certified copy of its
resolution authorizing execution of this agreement, within five (5)
days of its passage and approval.
5 . This agreement shall inure to the benefit of and be

binding upon the parties and their respective successors.
6. If any section, paragraph, subdivision, clause, sentence
or provision of this Agreement shall be adjudged by any court of
competent jurisdiction to be invalid, such judgment shall not
affect, impair, invalidate or nullify the remainder of this
Agreement, which remainder shall continue in full force and effect.
