PUBLIC WORKS (Sponsoring Jurisdiction) and ELGIN BAHA'I COMM. (Group), recognize the need for litter free highways and are entering into this Agreement in an effort to contribute toward maintaining litter free highways. By signature below, the Group acknowledges the hazardous nature of the work and agrees to the terms and conditions set by the Sponsoring Jurisdiction and the Illinois Adopt-A-Highway Act. The Group and its volunteers and agents shall assume all responsibility for, and hold the State of Illinois and the Sponsoring Jurisdiction (including their officials, employees and agents) harmless from, any and all claims or actions resulting from the Group's volunteers' or agents' work in the program, except for the negligent acts of the State of Illinois and the Sponsoring Jurisdiction (including their agents or employees) . Members of the Group are jointly and severally bound by the terms and conditions of this Agreement. The Group and the Sponsoring Jurisdiction will fulfill their respective responsibili- ties as set forth in Sections 25 and 30 of the Illinois Adopt-A- Highway Act. A copy of those sections is attached as an appendix and is expressly incorporated by reference. The Sponsoring Jurisdiction agrees to abide with all of the requirements of the Illinois Adopt-A-Highway Act and to ensure that participating groups likewise abide with the requirements of the Act. Further, the Sponsoring Jurisdiction agrees to abide with the Adopt-A-Highway Sign Standards printed on the reverse side of this sheet. The Sponsoring Jurisdiction also agrees to secure written commitments from participating groups to hold the State and the State's agents or employees harmless from any and all claims or action resulting from the program. SPONSORING JURISDICTION Submitted by: �� Gini#' , _ 4? 3 p Mayor Date: �U�� ^�7'4/ e and Title) ILLINOIS DEPARTMENT OF TRANSPORTATION Approved by: Date: %'t / t-N I c District Engineer Eon • Agenda INo. 'eK_Ag"I • September 29, 1993 MEMORANDUM TO: Mayor and Members of the City Council FROM: City Manager SUBJECT: Authorization to Execute an Adopt-A-Highway Agreement with IDOT PURPOSE: The intent herein is to provide information whereby the Mayor and Council can consider authorizing the Elgin Baha' i Community group to adopt a section of state highway in Elgin, under the sponsoring jurisdiction of the City of Elgin. r BACKGROUND: The State of Illinois passed legislation dated 9-16-92 cited as the Illinois Adopt-A-Highway Act. This pro- gram allows private citizens to support local anti-litter efforts by allowing groups to adopt a section of highway for the purpose of litter collection. The City was contacted by a local group named the Elgin _ Baha' i Community. They proposed adopting Route 31, from the Soo Line Railroad overpass (south of Big Timber) , north to the I-90 Tollway. An agreement with IDOT is required and a copy is attached for your consideration. The Mayor's signature is required on behalf of the City. Our Legal Department, in response to an earlier proposal, has prepared an agreement between the City and the Elgin Baha' i Community, a copy of which is also attached for your considera- tion. This agreement would require the signature of the City Manager. The Adopt-A-Highway program has been successful in Illi- nois, as well as throughout many states in the nation. We believe that such a program would greatly improve the quality of life in our community. FINANCIAL IMPACT: The City would be obligated to install signs at each end of the adopted section with the name of the group displayed. The City would provide trash bags, safety apparel • and safety training. The City would collect the bags of trash four times each year.
