RESOLUTION
ACCEPTING THE PROPOSAL OF ATEC ASSOCIATES, INC. FOR
PHASE II ENVIRONMENTAL ASSESSMENT OF SOUTH GROVE AVENUE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, be and is hereby
authorized and directed to accept the proposal on behalf of
the City of Elgin of ATEC Associates, Inc. for Phase II
environmental assessment of South Grove Avenue, a copy of
which is attached hereto and made a part hereof by reference.

SUBJECT: Phase II Environmental Testing at
South Grove Avenue Riverboat Site
PURPOSE
The purpose of this memorandum is to seek City Council
authorization to proceed with Phase II testing at three loca-
tions within the South Grove Avenue riverboat project area.
BACKGROUND
In February of 1993, City Council authorized ATEC &
Associates to perform a Phase I audit of the South Grove
Avenue riverboat redevelopment site. The Phase I study was a
requirement of the Development Agreement between the City and
Nevada Landings, Inc. /Hyatt Corporation. In April of this
year, City Council authorized an agreement with ATEC & Associ-
ates for soil borings and the development of a remediation
plan at 210 South Grove Avenue (D. H. Martin site) . In May
and June of 1993, City Council awarded bids for the removal
of above ground and below ground storage tanks, asbestos and
PCB light ballasts at the Martin site.
The recent decision of the Gaming Commission requires
that the City move forward with the verification of the suit-
ability for development of certain parts of the riverboat
project area site as well as the continued cleanup of certain
areas of the site that are known to have some contamination.
In order to continue the momentum of this project, a proposal
for additional environmental work was sought from ATEC &
Associates. ATEC is very familiar with the site and has
performed well on earlier assignments. ATEC has suggested
that the work at the site be subdivided into three areas.
The breakdown of additional work will permit separate track-
ing of costs for reimbursement purposes.

ATEC prepared the following subdivision of the entire
project area:
1. D. H. Martin site.
2. Bunge's Auto Center site.
3. Parking lot site (area east of National Street
bounded by Lake Street, Wellington Avenue and Na-
tional Street) .
ATEC proposes the following activities at each of the
above-mentioned locations:
1. D. H. Martin Site
SCOPE OF WORK
ATEC proposes a total of four soil borings to be in-
stalled to determine the extent of contamination from
the underground storage tank (UST) area and aboveground
storage tank (AST) area. ATEC's cost proposal is based
on three (3) 10-foot borings and one ( 1) 20-foot boring
(which will be converted into a groundwater monitoring
well) .

ATEC proposes that soil borings be placed on the south
and west side of the AST area. Two borings are recom-
mended along the south side of the AST area and one
boring along the west side of the AST area.
Each soil boring will be continuously split spoon sam-
pled. Field boring logs will be completed accordingly
on ATEC forms. ATEC is assuming that each soil boring
will be less than ten feet deep. Following completion
of the soil boring, a cement/bentonite or volclay grout
will be placed in the boring. The soil cuttings will
remain in the vicinity of the soil boring.
The boring on the west side of the AST area should be
completed as a monitoring well and sampled for the above
list of parameters. ATEC anticipates that the depth of
this boring will be 20 feet.
UST Area
ATEC proposes that one soil boring be placed southwest
of the UST excavation to determine the extent of contami-
nation.

General
ATEC will specify a three day turnaround time for labora-
tory analysis. This results in a 40% premium for the
laboratory fees.
ATEC will prepare a report, documenting the soil boring
activities, laboratory analysis, and findings. ATEC
understands that prior to completion of the report, a
meeting may be held at the City's offices to discuss the
findings.
2. Bunge's Auto Center
A Phase I environmental assessment for this site, per-
formed by ATEC (April, 1993) revealed past usage of this
property that required further investigation. Due to
the presence of a service station at this property, the
installation of soil borings for the collection of soil
samples for laboratory analysis was recommended.
SCOPE OF WORK
ATEC proposes a total of six soil borings be installed
to determine if past usage of the property has resulted
in contamination at the property. The two major areas
of concern are in the vicinity of six former above
ground storage tanks, and in the vicinity of underground
storage tanks. It is unknown if the underground storage
tank(s) have previously been removed.
ATEC will specify a three day turnaround time for labora-
tory analysis. This results in a 40% premium for the
laboratory fees.

3. Parking Lot Site
A Phase I environmental assessment for this site per-
formed by ATEC (April, 1993) revealed past usage of this
property that required further investigation. Due to
the presence of several auto service and sales business-
es along this property, the installation of soil borings
for the collection of soil samples for laboratory analy-
sis was recommended.

SCOPE OF WORK
ATEC proposes a total of 12 soil borings be installed to
determine if past usage of the property has resulted in
contamination at the property. The chosen locations of
the 12 soil borings will be based upon the level of
impact that may have occurred by past usage of the prop-
erty. The major areas of concern are in the vicinity of
several former auto sales and service businesses . Al-
though there were no listings of underground storage
tanks in this section, it would be likely they would
have existed. There is also a concern on the past prac-
tices of these facilities . It is unknown if underground
storage tank(s) exist at the property or have previously
been removed:

FINANCIAL IMPACT
ATEC' s cost proposals for the three identified areas are
as follows:

The charges proposed by ATEC are consistent with cost
estimates provided for work performed. As noted earlier, the
City is requesting a three day turnaround time for test re-
sults. Standard turnaround is two weeks . A premium is paid
for quick turnaround time on test results. The costs are not
to exceed estimates. If certain elements of the testing are
not required, then the costs will be lower.

260.

RECOMMENDATION
Authorize the City Manager to enter into an agreement
with ATEC & Associates for Phase II testing on South Grove
Avenue at a cost not to exceed $48,858.26 .

PROFESSIONAL SERVICES AGREEMENT

"Th i s agreement is entered into this 7" day of
1993, between the City of Elgin, Illinois, a
mu icipal corporation (hereinafter referred to as "City") ,
and ATEC Associates, Inc. , an Indiana corporation (hereinaf-
ter referred to as "Consultant") .'
WHEREAS, the City has determined it to be in its best
interests to obtain the assistance of an expert environmental
consultant concerning environmental conditions located at the
South Grove Riverboat Redevelopment Site; and .
WHEREAS, Consultant is expert in the relevant environmen-
tal sciences, and desires to enter into an agreement to ren-
der Consultant services to the City;
NOW, THEREFORE, in consideration of the mutual promises
and covenants contained herein, the receipt and sufficiency
of which is hereby acknowledged, the parties hereto agree as
follows :
1. • Scope of Work
Consultant shall provide and direct the necessary quali-
fied personnel to perform the services described in the pro-
posals for soil and ground water sampling and report prepara-
tion, which is attached hereto and incorporated by reference
herein as Attachments III, IV, V and VI .
2. Term
This agreement shall have a term commencing on September
9, 1993 and ending upon delivery and acceptance of all
project deliverables, or until otherwise terminated as provid-
ed herein. This agreement may be terminated by the City at
such time as the City may elect, provided that the effective
date of such termination will not be earlier than seven days
following the mailing of written notice of termination to
Consultant at the address provided herein. Upon receipt of a
notice of termination, Consultant shall deliver to the City
the work product or other results obtained by Consultant up
to that time.
3. Fee
So long as Consultant is discharging its obligations
hereunder to the reasonable satisfaction of the City, Consul-
tant shall be paid a fee for such services at the rate set
forth in Table 1 and Table 2 which is appended hereto and
incorporated by reference herein. Said fee shall not exceed
$48,858.00 in total for all tasks combined. Said fee shall
be payable within 60 days of receipt by the City of an item-
ized invoice for services rendered by the Consultant.
4. Rights in Results of Services
The results of Consultant's services under this agree-
ment shall be the exclusive property of the City, and all
documents (including without limitation, all writings, draw-
ings, blueprints, pictures, recordings, computer or machine-
readable data, and all copies or reproductions thereof) which
describe or relate to the services performed or to be per-
formed pursuant to this agreement or the results thereof,
including without limitation all notes, data, reports or
other information received or generated in the performance of
this agreement, shall be the exclusive property of the City
and shall be delivered to the City upon request (except for
one copy, which may be retained by Consultant for its confi-
dential files) . No articles, papers, treatises, or presenta-
tions related to or in any way based upon or associated with
the services performed pursuant to this agreement shall be
presented or submitted for publication without the prior
written consent of the City.
5. Other Agreements
Consultant warrants that it is not a party to any other
existing or previous agreement which would prevent Consultant
from entering into this agreement or which would adversely
affect Consultant's ability to perform the services under
this agreement. During the term of this agreement Consultant
will not, without the prior written consent of the City,
perform services for any person, firm or corporation other
than the City if such services could lead to a conflict with
Consultant's obligations under this agreement.
6 . Subcontracting
If Consultant intends to hire or retain any person, firm
or corporation to perform services under this agreement,
Consultant shall first secure the written agreement of such
party that such party ( 1) shall assume and agree to be bound
by the same obligations as Consultant has assumed under the
provisions of this agreement, and (2) that such party shall
not be or act as an agent or employee of the City, nor assume
or create any commitment or obligation on behalf of nor bind
the City in any respect whatsoever. Consultant shall provide
the City with a copy of each such written agreement.
7 . Assignment
Neither this agreement nor any of the rights or obliga-
tions hereunder may be assigned or otherwise transferred by
Consultant, nor shall the benefits of this agreement inure to
the benefit of any trustee in bankruptcy, receiver or credi-
f for of Consultant, whether by operation of law or otherwise,
without the prior written consent of the City. Any attempt
to assign or transfer this agreement or any rights hereunder
without such consent shall be null and void and of no force
or effect.
8. Independent Contractor
Consultant is and shall perform its services under this
agreement as an independent contractor, and shall not be
deemed an agent, employee or legal representative of the
City. Consultant has no authority to assume or create any
commitment or obligation on behalf of or to bind the City in
any respect whatsoever.
9 . Licenses and Permits
Consultant shall obtain any and all licenses and permits
required by federal, state, or local statutes, regulations or
ordinances necessary for the performance of its services
pursuant to this agreement.
10. Compliance with Laws
Consultant shall at all times impose work orders on its
employees and subcontractors which are designed to assure
that they comply with all applicable federal, state and local
laws and regulations, including occupational safety and envi-
ronmental protection statutes and regulations, in performing
the services hereunder, and shall comply with any directions
of governmental agencies and the City relating to site safe-
ty, security, traffic or other matters.
11. Indemnification of Client
Consultant shall defend and indemnify the City from and
against any and all claims for damages, causes of action,
suits or other liability arising out of the performance of
the service for the City where such liability is caused by
the negligent act, error or omission of Consultant, its
agents, employees or assigns, or any person or organization
for whom Consultant is legally liable.
12. Consultant's Insurance
Consultant shall obtain and maintain the following poli-
cies of insurance:
( 1) Worker' s compensation and occupational disease
insurance in amounts required under the laws
of the State of Illinois;
(2) Comprehensive general liability and automobile
liability insurance for bodily injury, death
or loss of or damage to property of third
persons in the minimum amount of $1 million
per occurrence which policy shall name the
City and owner of property, if other than the
City, upon which Consultant's services are
performed as additional insured. Consultant
shall furnish to the City a Certificate of
Insurance as evidence of such policies on or
before September 9, 1993.
(3) Professional liability insurance for errors
and omissions in the minimum amount of $1
million per occurrence. Consultant shall
furnish to the City Certificate of Insurance
as evidence of such policy on or before Septem-
ber 9, 1993.
13. Right of Entry
The City shall provide for Consultant' s right to enter
from time to time property owned by the City or other(s) in
order for Consultant to fulfill the scope of services, pursu-
ant to the attached authorization form.
14 . Severability
If any portion of this agreement, or application thereof
to any person or circumstance, shall to any extent be in-
valid, the remainder of this agreement, and the application
of such provision to persons or circumstances other than
those as to which it is held invalid, shall not be affected
thereby, and each provision of this agreement shall be valid
and enforced to the fullest extent permitted by law.
15 . Governing Law
The validity, performance and construction of this agree-
ment shall be governed and interpreted in accordance with the
laws of the State of Illinois applicable to contracts made
and to be performed therein.
16 . Additional Provisions
This agreement includes those additional provisions
contained in Attachments I, II, III, IV, V and VI.
17. Entire Agreement
This agreement contains the entire understanding and
agreement between the parties hereto with respect to the
subject matter hereof and supersedes all previous communica-
tions, negotiations and agreements, whether oral or written,
between the parties with respect to such subject matter, and
no addition to or modifications of this agreement or waiver
of any provisions of this agreement shall be binding on ei-
ther party unless made in writing and executed by the City.
The terms and conditions , set forth herein are ac-
cepted as of this i?r day of 19 .

Consultant Certifies That:
1. The undersigned firm certifies that it is not delinquent
in the payment of any tax administered by the Department
of Revenue except for tax it is contesting in accordance
with the procedures established by the appropriate reve-
nue act.
2 . The undersigned firm certifies that the firm is not
barred from making an offer to contract as a result of a
violation of either Section 33E-e, or 33E-4 of Chapter
38 of the Illinois Revised Statutes.
3. The undersigned firm certifies that the firm shall com-
ply, where applicable, with the Wages of Employees on

AFFIRMATIVE ACTION INFORMATION
To assure compliance with the City of Elgin's contract compli-
ance ordinance, all contractors and vendors, herein referred
to as "bidders", are requested to submit the following Affir-
mative Action information:
1. Work Force Analysis using the enclosed bidder's employee
utilization form.
2 . Provide the information required by item #3 on the em-
ployee utilization form if the answer to question 2 on
the form is 'yes ' .
3. Provide a written commitment outlining the steps that
the bidder plans to take in the area of recruitment and
promotion of minorities and female to assure equal em-
ployment opportunity. (A coy of the bidder' s affirma-
tive action plan may be submitted in lieu of this re-
quirement. )

tion and labor force.
3. Set out what the bidder has done and has set as goal to
be done to recruit minority and female employees.
4 . Set out the bidder' s specific goals to recruit minority

ATTACHMENT III
The Consultant certifies that it has in writing sexual harass-
ment policies that include, at a minimum, the following infor-
mation:
(i) the illegality of sexual harassment;
(ii) the definition of sexual harassment under state law;
(iii) a description of sexual harassment, utilizing examples;
(iv) the vendor's internal complaint process including
penalties;
(v) the legal recourse, investigative and complaint pro-
cess available through the Illinois Department of
Human Rights, and the Illinois Human Rights Commission;
(vi) directions on how to contact the department and commis-
sion;
(vii) protection against retaliation as provided by Section
6-101 of the Human Rights Act.
A copy of the policies must be provided to the Department of
Human Rights upon request. P.A. 87-1257 .
Sexual harassment is defined as follows:
"Sexual harassment" means any unwelcome sexual
advances or requests for sexual favors or any
conduct of a sexual nature when ( 1) submission
to such conduct is made either explicitly or

SCOPE OF WORK

than tea feet deep. Following completion of the soft boring, a ceiaent/bentonite or voldlay
grout will be placed in the boring. The soil cuttings wiU remain in the vicinity of the soil
_ Soil samples will be collected for headspaee analysis from each split-qx= sample. Each
soil sample will be placed into a glass jar and covered with aluminum foil. After waiting 15
minutes a field geologist will screen the soil samples by piercing the aluminum foil jar eoverr
` with the probe tip of an organic vapor monitor equipped with a photoionization detector
OID�
If elevated PID readings are recorded in the field,two soil samples from each soil boring
will be sent to the laboratory for benzene, toluene, ethylbenaene and xylene (BWCX
polyrwclear aromatic hydrocarbons (PAM)and lead analysis. These two soil samples will
correspond to the split spoon interval with the highest PID reading, and the first split spoon
interval with a PID reading less than 5 ppm below the split spoon interval with the highest
split spoon interval. If no elevated PID readings are recorded from a boring,then the split
spoon interval with the,highest PID reading will be sent to the laboratory for BTTIX,PAM
and lead analysis.
If no readings are found on the PM, a soil sample wM be submitted for laboratory analysis
for BlUX PAM and lead from the soil horizon just above the groundwater table. ATEC
is assuming that the groundwater table is less than ten feet below the ground surface.
The boring on the west side of the AST area should be completed as a monitoring well,and
sampled for the above list of parameters. ATEC anticipates that the depth of this boring
• will be 20 feet

Thy monitoring well will be constructed of 2-inch internal diameter 304 stainless steel

anticipated,howVer,the screen length maybe shortened depending upon field observations.
The annular apace m=ounding the screen section wIU be packed with silica sand. The sand
pack will extend 2 feet above the well screen. To prevent the migration of fluids from the
surface and between subsurface sediments,a bentonite seal will be installed above the filter
pack The bentonite seat will extend at least 2 feet above the filter pack. The bentonite
will be hydrated and tremied in place. A concrete-bentoMte or volclay grout will be
installed above the bentonite seal and will extend to the surface. A protective casing will
be installed at the surface. If possible,the well and protective casing will extend (stick-up)
approximated'24et above the ground surfacx. If traffic or other activities prohibit a stick-
up, a flush-mounted protective casing will be installed.
The newly installed well will be allowed to sit for at least 4 9-hours before developing. 15
volumes of water wM be removed from the well using a decontaminated stainless steel
bailer. The time required to purge the well of 15 volumes of water is onntingent upon
natural recharge time.

After development, the well will be allowed to equalize for at least 48 hours prior to
sampling. The water sample will be analyzed for BTEX.PAHs and Lead util An SW-846
• methods.
UST&M
ATEC proposes that one soil boring be placed southwest of the UST excavation to
determine the extent of contamination.
The soil boring will be continuously split spoon sampled. A field boring log wilt be
completed accordingly on ATEC forms. ATEC is assuming that the soil borlog will be less
than tea feet deep. Following completion of the soil boring, a cement/bentonite or volclay
grout will be placed In the boring. The soil cuttings will remain in the vicinity of the soil
boring.
Soil samples will be wHected for headsp= analysis from each split-spoon sample. Bach
soil sample will be placed into a glass jar and covered with aluminum foil. After waiting 15
minutes a field geologist will screen the soil samples by piercing the aluminum fail jar cover
with the probe tip of an organic vapor monitor equipped with a pbotoionization detector

non-carcinogenic PAM and carcinogenic PAM will be equal to or less than the soil ADLs
as presented in Table 3 of the 1F2A guidance dated February 1993. Soil samples will be
sent to the ATZaC-Mgbland office for analysis.

BACKGROUND
A Phase I environmental assessment for tbis site, performed by ATEC (April, 1993)
revealed past usage of this property that required further investigation- Due to the presence
of a service station at this property,the installation of soil borings for the collection of soil
samples for laboratory analysis was recommended.
SCOPE OF WORK
ATEC proposes a total of b sot borings be installed to determine if past usage of the
property has resulted in contamination at a property. The two major areas of concern are
m the vicinity of six former above graund�torage tanks, and in the vicinity of underground
storage teaks. It is unknown if the underground storage tank(s) have previously been
• removed.
Each soil boring will be continuously split spoon samplyd. Field boring logs will be
~ completed a000rdmgly on ATEC forms. ATEC is assuming that each soil baring will be less
Ow ten fact deep. Following completion of the soil boring,a eement/bentordte or voldlay
grout will be placed in the boring. The soil cuttings will remain in the 'vicinity of the soil
boring.
Sol maples will be collected for headspace analysis from each split-spoon sample. Fed*
soil sample will be placed into a glass jar and covered with aluminum foil. After waiting 15
mi=w a field geologist will screen the soil samples by piercing the aluminum foil jar cover
with the probe tip of an organic vapor monitor equipped with a photoionization detector
(PM).
If elevated PID readings are recorded in the field, two soil samples from each soil boring
will be sent to the laboratory for benzene, toluene, ethylbenzene and xylene (BTEX)and
polynuclear aromatic bydrocarbons(PAHs)analysis. These two soil samples will correspond
to the split spoon interval with the highest PID reading, and the first split spoon interval
moth a PID reading less than S ppm below the split spoon interval with the bighest split
spoon interval. If no elevated PIA readings are recorded from a boring,then the split spoon
interval with the blgbest PM reading will be sent to the laboratory for(BTEIt)and(PAHs)

The member of soil aamples submitted for analyses from this sampling event will be a
mmmmum of 6 soil samples and a mWmum of 22 soil samples depending on the result of
PID readings in the field. The analytical program for the soft samples is tailored towards
detecting chemical constituents associated with the former aboveground and underground
tanks. The soil samples will be analyzed for benzene, toluene, ethylbenzene and rylene
(B'YEX) and polynu:clear aromatic hydrocarbons(PAM). There is no evidence to suggest
that waste oil tanks,which would include analysis for the priority pollutants, eadsted at the
site. USEPA SW-846 analytical methods will be used for each soil sample. Detection limits
for non-carcinogenic PAM and carcinogenic PAM will be equal to or less than the, soil
ADLs as presented in Table 3 of the IEPA guidance dated February 1993. Soll samples will
be scat to the ATEC-Highland office for analysis.
ATEC will specify a three day time for laboratory analysis. This results in a
40%premium for the laboratory fees.

SCOPE OF WORK
ATEC proposes a total of 12 soil borings be installed to determine if past usage of the
property has resulted in contamination at the property. The chosen.locations of the 12 soil
borings will be based upon the level of impact that may have occurred,by past usage of the
property. The major areas of concern are in the vicinity of several former auto sales and
service businesses, Although there were no listings of underground storage tanks in this
section, it would be likely they would have existed. There is also a concern on the past
practices of these facilities. It is unknown if underground storage tank(s) e3dst at the
'r property or have previously been removed.

_ To determine the appropriate number of soil sample locations within the footprmt of the
property, ATEC estimated the footprint to have dimensions of 650 feet by 275 feet. This
results In an area of approximately 4.1 acres.The Illinois Environmental protection Agency's
(IEPA) closure &dance for RCRA hazardous waste sites provides two equations to
determine an appropriate sampling interval.For grid sampling,the following equations may
be used to determine grid intervals and the cumber of samples in a given area:
(1) GI . ((A z w)/GL)" or (2) GI = W r)03/2
The equations establish grid point intervals, proportioned to the size of the waste
management unit,where:
OL = greatest length of the area to be gridded (feet)
A = area to be gridded (feet), and
GI = grid interval (feet).
Equation 1 results in a heavy sample weighting for small sites,so it should be used for sites
Urger than 3 acres. Equation 2 should be used for units smaller than 3 acres.
Equation 1 results in a grid interval of 30 feet and equation 2 results in a grid interval of
120 feet. Based upon the size of the footprint, equation 1 would result in 189 sampling
locations and equation 2 would result in 10 sampling locations.

Considering that this is not a RCRA regulated unit,and the sire of the footprint is not much
greater than 3 acres, ATEC used equation 2 as guidance to estabHsh the cumber of sot

If no readings are found on the PID,a soil sample will be submitted for laboratory analysis
for VOAs and PAHs from the soil horizon just above the groundwater table. ATEC is
assuming that the groundwater table is less than ten feet below the ground arrfam.
The number of soil samples submitted for analyses from this sampling event will be s
minimum of 12 soil samples and a maim of 24 soil samples depending on the result of
PID readings in the field.
USEPA SW-846 analytical methods will be used for each soil sample. Detection limits for
non-carcinogenic PAHs and carcinogenic PAM will be equal to or less than the soil ADLa
