Each provision of this agreement shall be con- sidered severable, and if any of the provisions contained herein are determined to be void, illegal or otherwise unen- forceable for any reason, the remainder of this agreement shall be valid and enforceable, and shall remain in full force and effect. 9 . Artist shall provide a performance of the Elgin Symphony Orchestra at the Hemmens Auditorium, in Elgin, Illinois on August 27, 1993, beginning at 8 : 00 p.m. 2 . Artist will assume all costs for the transportation of the musicians, including air fare and ground transportation, to and from Elgin. 3 . ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS CONTRACT,OR BREACH THEREOF,SHALL BE RESOLVED UNDER ON F THE FOLLOWING PROCEDURES TO BE SELECTED BY THE PURCHASER AT THE TIME THAT THIS CONTRACT IS SIGNED,BY PLACING HIS OR HER INITIALS IN THE BOXADJACENT TO THE PROCEDURE SELECTED.IN THE EVENT THAT NEITHER BOX IS INITIALED,IT WILL BE CONCLUSIVELY PRESUMED THAT THE PURCHASER HAS CHOOSEN THE PROCEDURES SET FORTH IN(A). ALL RULINGS AND AWARDS MADE BY THE LOCAL BOARD WHICH ARE NOT APPEALED TO THE IEB SHALL BE FINAL AND BINDING UPON THE PURCHASER AND PARTICIPATING MUSICIAN(S)AND ALL RULINGS AND AWARDS MADE BY THE IEB ON APPEAL SHALL BE FINAL AND BINDING UPON THE PURCHASER AND PARTICIPATING MUSICIAN(S).ANY PARTY TO A PROCEEDING BEFORE THE LOCAL BOARD OR TO AN APPEAL TO THE IEB MAY BRING AN ACTION TO CONFIRM OR ENFORCE A FINAL DETERMINATION AND AWARD OF THE LOCAL BOARD OR,IF APPEALED,OF THE IEB,IN THE COURTS OF THE JURISDICTION IN WHICH THE LOCAL BOARD IS LOCATED;AND THE PURCHASER AND PARTICIPATING MUSICIAN(S)AGREE TO SUBMIT TO THE JURISDICTION OF SUCH COURT OR COURTS FOR THAT PURPOSE.
