RESOLUTION
AUTHORIZING AN AGREEMENT WITH NI JAZZ ENSEMBLE AND SOLOIST
FOR A PERFORMANCE FOR THE ELGIN FINE ARTS FESTIVAL
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that it hereby authorizes Larry L. Rice, City
Manager, and Dolonna Mecum, City Clerk, to execute an
agreement with NI Jazz Ensemble and Soloist for a performance
for the Elgin Fine Arts Festival, a copy of which is attached
hereto and made a part hereof by reference.

Now therefore, in consideration of the mutual prom-
ises and covenants contained herein, the sufficiency of which
is hereby acknowledged, the parties hereto agree as follows:
1 . Jazz Ensemble shall provide a performance of a
concert at the Elgin Fine Arts Festival, Civic Center Plaza in

7 . In the event of sickness or of accident to
artist, or if a performance is prevented, rendered impossible
or infeasible by any act or regulation of any public authority
or bureau, civil tumult, strike, epidemic, interruption in or
delay of transportation services, war conditions or emergen-
cies or any cause beyond the control of artist, it is under-
stood and agreed that there shall be no claim for damages by
performer against City.
8 . Each provision of this agreement shall be con-
sidered severable, and if any of the provisions contained
herein are determined to be void, illegal or otherwise unen-
forceable for any reason, the remainder of this agreement
shall be valid and enforceable, and shall remain in full force
and effect.
9 . This agreement shall be subject to and governed
by the laws of the State of I?linois .

PERFORMANCE AGREEMENT
This agreement is entered into this day of
, 1993, by and between the City of Elgin, Illinois,
a municipal corporation (hereinafter referred to as "City" ) ,
and Burgundian Consort, a .41" P-a�,J(hereinafter re-
ferred to as Artist) .
Now therefore, in consideration of the mutual prom-
ises and covenants contained herein, the sufficiency of which
is hereby acknowledged, the parties hereto agree as follows :
1 . Artist shall provide a performance of concert
at the Elgin Fine Arts Festival, Civic Center Plaza in Elgin,
Illinois on August 28, 1993, beginning at 10 : 30 a.m.
2 . Artist will assume all costs for the transporta-
tion of the musicians, including air fare and ground transpor-
tation, to and from Elgin.
3 . City shall pay to Artist the sum of $650 . The
sum of $ 0' ° shall be payable on or before
q- with $650 at time of performance.
4 . This Agreement shall not constitute nor be
construed as an employment, joint venture or partnership
agreement between the parties hereto.
5 . Artist shall not conduct any marketing, promo-
tional or other activities related to the event without prior
agreement from the Hemmens Program Coordinator.
6 . In the event of sickness or of accident to
artist, or if a performance is prevented, rendered impossible
or infeasible by any act or regulation of any public authori-
ty or bureau, civil tumult, strike, epidemic, interruption in
or delay of transportation services, war conditions or emer-
gencies or any cause beyond the control of artist, it is
understood and agreed that there shall be no claim for damag-
es by performer against City.

PERFORMANCE AGREEMENT

and Elgin Symphony Orchestra, a not-for-profit corporation
(hereinafter referred to as "Artist" ) .
Now therefore, in consideration of the mutual
promises and covenants contained herein, the sufficiency of
which is hereby acknowledged, the parties hereto agree as
follows :
1 . Artist shall provide a performance of the Elgin
Symphony Orchestra at the Hemmens Auditorium, in Elgin,
Illinois on August 27, 1993, beginning at 8 : 00 p.m.
2 . Artist will assume all costs for the
transportation of the musicians, including air fare and ground
transportation, to and from Elgin.
3 . Ticket prices shall be $� for the main
floor and $ ?a 1/6) for the balcony.
4 . City shall pay to Artist the sum of Sixteen
Thousand Three Hundred Sixty and no/100ths ($16,360 . 00) on or
before August 27, 1993 . Such sum shall constitute full
payment.
5 . This Agreement shall not constitute nor be
construed as an employment, joint venture or partnership
agreement between the parties hereto.
6 . Artist shall not conduct any marketing,
promotional or other activities related to the event without
prior agreement from the Hemmens Program Coordinator.
7 . In the event of sickness or of accident to
artist, or if a performance is prevented, rendered impossible
or infeasible by any act or regulation of any public authority
or bureau, civil tumult, strike, epidemnc, interruption in or
delay of transportation services, war conditions or

"Storyteller" ) .

1 . Storyteller shall provide two performances of
storytelling at the Elgin Fine Arts Festival, Civic Center
Plaza in Elgin, Illinois on August 29, 1993, beginning at

PERFORMANCE AGREEMENT

and An American Sampler, (hereinafter referred to as "Sam-
pler" ) .
Now therefore, in consideration of the mutual prom-
ises and covenants ::ontained herein, the sufficiency of which
is hereby acknowledged, the parties hereto agree as follows:
1 . Sampler shall provide a performance of a con-
cert at the Elgin Fine Arts Festival, Civic Center Plaza in
Elgin, Illinois on August 28, 1993, beginning at Noon until
1 :00 P.M.
2 . Sampler will assume all costs for the transpor-
tation of the musicians, including air fare and ground trans-
portation, to and from Elgin.
4 . City shall pay to Sampler the sum of $375 .00 on
or before August 28, 1y93, made payable to M.G. Furlong. Such
sum shall constitute full payment.
5. This Agreement shall not constitute nor be
construed as an employment, joint venture or partnership
agreement between the parties hereto.
6 . Sampler shall not conduct any marketing, promo-
tional or other activities related to the event without prior
agreement from the Hemmens Program Coordinator.
7 . Additional Terms . City shall make provisions
for the following: adequate stage lighting and at least one

(A) (EXECUTIVE BOARDS)
STEP 1. ANY SUCH CONTROVERSY SHALL FIRST BE SUBMITTED TO THE LOCAL UNION BOARD OF DIRECTORS(HEREIN CALLED THE"LOCAL BOARD")IN ACCORDANCE WITH RULES OF PRACTICE AND
PROCEDURE ADOPTED BY IT FOR THIS PURPOSE.ALL RULINGS AND AWARDS MADE BY THE LOCAL BOARD UNDER THIS STEP i SHALL BE FINAL AND BINDING UPON THE PURCHASER AND PARTICIPATING
MUSICIAN(S),UNLESS ANY PARTY INVOKES STEP 2 WITHIN TEN DAYS AFTER THE MAILING OF A DECISION OF THE LOCAL BOARD.
STEP 2. A DECISION OF THE LOCAL BOARD UNDER STEP 1 MAY BE APPEALED TO THE INTERNATIONAL EXECUTIVE BOARD OF THE FEDERATION(HEREIN CALLED"IEB")BY ANY PARTY WHO WAS A PARTICIPANT
THEREIN. APPEALS FROM SUCH PROCEEDINGS SHALL BE PERFECTED IN THE MANNER PROVIDED IN THE RULES OF PRACTICE AND PROCEDURE OF THE IEB IN EFFECT AT THE TIME OF SUCH APPEAL.
ALL RULINGS AND AWARDS MADE BY THE LOCAL BOARD WHICH ARE NOT APPEALED TO THE IEB SHALL BE FINAL AND BINDING UPON THE PURCHASER AND PARTICIPATING MUSICIAN(S)AND ALL RULINGS AND
AWARDS MADE BY THE IEB ON APPEAL SHALL BE FINAL AND BINDING UPON THE PURCHASER AND PARTICIPATING MUSICIAN(S).ANY PARTY TO A PROCEEDING BEFORE THE LOCAL BOARD OR TO AN APPEAL
TO THE IEB MAY BRING AN ACTION TO CONFIRM OR ENFORCE A FINAL DETERMINATION AND AWARD OF THE LOCAL BOARD OR,IF APPEALED,OF THE IEB,IN THE COURTS OF THE JURISDICTION IN WHICH THE
LOCAL BOARD IS LOCATED;AND THE PURCHASER AND PARTICIPATING MUSICIAN(S)AGREE TO SUBMIT TO THE JURISDICTION OF SUCH COURT OR COURTS FOR THAT PURPOSE.
(B) (AMERICAN ARBITRATION ASSOCIATION)

PERSONALLY INCURRED BY THE PARTIES HERETO FOR THE PRESENTATION OF THEIR OWN CASE,SHALL BE SHARED EQUALLY BY THE PURCHASER AND THE SIGNATORY MUSICIAN(S).
