RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
CLARK DIETZ, INCORPORATED FOR THE
NORTHWEST AREA INTERCEPTOR SEWERS
WHEREAS, the City of Elgin has heretofore entered into a
contract with Clark Dietz, Incorporated for the Northwest Area
Interceptor Sewers; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 1,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be
and is hereby authorized and directed to execute Change Order
No. 1, a copy of which is attached hereto and made a part
hereof by reference.

NORTHWEST AREA INTERCEPTOR SEWERS - DESIGN & INSPECTION
CHANGE ORDER NO. 1
SCOPE: This Change Order No. 1 covers the extra work
necessary to complete the design for the Big
Timber/Tyler Creek and North Randall Interceptor
Sewers.
The consultant for these projects is Clark Dietz, Inc.
of Champaign, Illinois .
REASONS FOR CHANGE: This change order is required to pay the
costs associated with the changes to the routing of both of the
interceptor sewers . The changes were necessary to re-route the
North Randall sewer around the Panasonic property and to
re-route the Big Timber/Tyler Creek sewer in the area of Valley
Creek to satisfy the owner.
The work included in this change order was not known and was not
reasonably foreseeable at the time of the letting of the
contract.

The present contract with Clark Dietz, Incorporated is for
$314 ,900 .00 . By reason of this Change Order No. 1, the contract
for the Design and Inspection of the Northwest Area Interceptor
Sewers will be increased in the amount of Thirty-seven thousand
two hundred ninety and 95/100 dollars ($37,290. 95) , the total
contract value being Three hundred fifty-two thousand one
hundred ninety and 95/100 dollars ($352, 190. 95) .
OTHER CONTRACT PROVISIONS: All other contract provisions shall
remain the same.

MEMORANDUM

SUBJECT: Northwest Interceptor Sewers
Contract Amendment for Design Engineering
PURPOSE: To provide the Mayor and Council with information to
consider an amendment to the contract with Clark Dietz, Inc.
(CDI) for Design Engineering Services on the Northwest
Interceptor Sewers.
elk BACKGROUND: The City Council awarded an engineering contract to
CDI at their June 26, 1991 meeting for the design and inspection
of two sewers in the northwest area of the City. The two
projects were the Big Timber/Tyler Creek and North Randall Road
Interceptor Sewers .
During the last two weeks of October 1991, the center line of
the Big Timber/Tyler Creek Interceptor west of the railroad spur
was moved from the previously approved location on the north
edge of Big Timber Road to easements north of Big Timber Road
and the existing FRWRD easements . This change was required to
minimize the impact of the sewer construction on traffic along
Big Timber.
During November 1991 the location of the center line of the Big
Timber/Tyler Creek Interceptor was moved 10 foot off of the
north park line along Tyler Creek at the request of Valley Creek
Corporation. No additional surveying was done for the
interceptor move, but extensive redesign and redrafting was
required for the interceptor.
The route of the North Randall Interceptor was changed due to
requests by Panasonic. The new route was surveyed, redesigned
and drafted.
The route of the North Randall Interceptor north of I-90 was
changed due to concerns of possible soil contamination along the
petroleum pipe line which was detected when obtaining soil
borings. The new route was surveyed, redesigned and drafted.
This extra work, however, is to be expected in this type of
contract and is not recommended for payment.

The revised route of the Big Timber/Tyler Creek Interceptor
along the north park adjacent to Tyler Creek was again revised
to the original location. The route of the North Randall
Interceptor north of I-90 was also revised back to the original
location. No survey was required for these revisions, but the
drawings again required revisions .
During February 1992, CDI was directed to modify the drawings
and specifications to incorporate a bore and jack under the
trees at Panasonic. This was done at the request of Panasonic
so as not to remove trees or destroy the park like area along
the sewer route. Also during February, the drawings and
specifications for both projects were modified twice due to
changes at the intersection of Big Timber Road and McLean Blvd.
The 155 ' of 60" pipe and the 10 ' manhole in Big Timber Road were
removed from the Big Timber/Tyler Creek Interceptor project and
added to the North Randall Road Interceptor project because of
concerns that the Big Timber sewer project could not be bid due
to easement problems. After the changes were made, it was
decided that the Big Timber project could be bid and started
first, and the drawings and specifications were changed back to
the original design.
Additional changes in the easement of the Big Timber/Tyler Creek
Interceptor between Tyler Creek and the Metra Commuter Rail
required a revision to the alignment of the interceptor. To
avoid the cost of again surveying this portion of the project,
CDI utilized a topographic survey of the area by Burnidge and
Westphal.
The North Randall sewer was designed to pass through the east
side of the Panasonic property in accordance with our
conversations with the representatives from the organization
constructing the Panasonic complex. We were still negotiating
for the easement when Panasonic accepted the complex at which
time we were informed by Panasonic that they would not grant the
easement.
Due to the problems in obtaining easements from Panasonic, the
route of the interceptor was changed to provide a crossing of
the Tollway at property owned by P.K. Products. In addition to
the changes on the south side of the Tollway, it was necessary
to make changes on the north side of the Tollway. We obtained
permission to place approximately 250 feet of interceptor on
emk Tollway property parallel to the right-of-way in order to avoid
obtaining an additional easement on the north side of the
Tollway. To avoid the cost of performing additional survey, CDI
prepared the plans on the north side of the Tollway based on
USGS maps and utilized survey data prepared by Burnidge and
Westphal across the P.K. Products property on the south side of
the Tollway. Redesign and drafting was required.

FINANCIAL IMPACT: The original engineering contract was in the
amount of $314, 900 which was to cover the cost of the design and
field inspection of the two sewer projects . The cost of all
this additional work which was not anticipated is $41,012 .49 .
After deducting the cost of the redesign North of the tollway,
which the City has rejected as an extra payment item, the
revised cost is $37,290 . 95 . The above amount will increase the
engineering contract to $352, 190. 95.
RECOMMENDATION: It is recommended that the City Council
authorize the preparation of a contract amendment with Clark
Dietz, Inc. for the design and inspection of the Northwest Area
Interceptor Sewers in the amount of $37 ,290 . 95.

Dear Jim:
In our meeting last Tuesday, you indicated that I needed to submit a request for a contract
amendment that incorporates all of the additional costs that we have incurred for the interceptor
projects. This letter is intended to replace our letters of June 10, 1992, November 3, 1992 and
April 8, 1993. In preparing this request, we have reviewed the costs previously submitted to
assure that the claimed costs are accurate and include all associated expenses. Since the previous
requests did not include some of the related expenses, the amounts included in this request may
vary from the previous requests. I have attached descriptions and costs associated with this
request. Following is a summary of the requested contract amendment:

In an effort to see this project through completion, we have continued to work, even though we
believe we have exceeded the requirements of our contract. Part of the costs included in this
request were previously authorized by the City. We believe, however, we are due a contract
amendment for the entire amount. Since you have withdrawn your previous authorization, it is
imperative that we resolve this issue and receive a contract amendment quickly.

DESIGN CHANGES
The original schedule for this project required completion of the design by September 24, 1991,
subject to award of the contract by June 12,1991. The actual contract was signed on June 24,
1991. CDI did complete the design and submitted the documents to the City on October 16,
1991. A preliminary submittal was made to the City on August 28, 1991 as required by the
contract.
The Engineering Services Agreement specifically requires that the City reimburse CDI for
revising previously approved Drawings and Specifications. The following Design Changes were
required by the City after the completion of the Bidding Documents:
Alignment Along Big Timber
The original design was based on the installation of the Big Timber/Tyler Creek Interceptor
within the roadway along Big Timber from the intersection at McLean to the west. This routing
was determined by the City. This alignment was approved in a review of the preliminary
drawings on September 3, 1991. During the last two weeks of October 1991 we revised the
interceptor location to the north of the FRWRD easement along Big Timber from the railroad
spur to the west. It was necessary to resurvey, redesign, prepare new drawings, and revise the
specifications. Following are the costs associated with this work:
Labor $5,104.59
Expenses 1.049.92
Total $6,154.52
Based on quality control review, CDI had recommended on September 19, 1992 that the sewer
be moved 10 feet further into Big Timber roadway in order to reduce the construction cost
associated with protecting existing utilities. Note, however, that the sewer could have been
constructed as originally designed. If our recommendation had been accepted, only minor
drafting work would have been required. Instead, the City decided to move the interceptor
completely out of the roadway in order to minimize the impact on traffic along Big Timber. The
decision was not made until the design documents were complete.
Alignment Along Tyler Creek
The original design along Tyler Creek was along the fence line. That alignment was based on
direction by Ralph Ridley at the September 3, 1991 review meeting. It was our understanding
that he had an agreement with the landowner to allow placement at that location. On November
7, 1991 the location was moved to 10 feet off of the north park line based on a revised verbal
agreement between the City and the landowner. No additional survey was required. However,

the change made substantial redrafting necessary. Following are the costs associated with this
change.
Labor $2,308.69

Alignment Change At Panasonic
The original design along the Panasonic property was based on direction by Ralph Ridley and the
understanding that he had an agreement with the landowner. On November 7, 1991 the routing
through the Panasonic property was changed at the direction of Ralph Ridley as requested by the
landowner. In order to perform this work, it was necessary to perform additional survey, design
and drafting. Following are the costs associated with this change.
Labor $2,176.22
Expenses 247.50

Ali t Change North of I-90
The original design'of the North Randall Interceptor to the north of 1-90 was parallel to an
existing Badger petroleum pipeline. Because of concern about possible petroleum contamination
of the soil, CDI was directed on November 7, 1991 to revise the routing to avoid the pipeline.
In order to perform this work, it was necessary to perform additional survey, design and
drafting. Following are the costs associated with this change.

Alignment Along Tyler Creek and North of I-90
The revised route of the Big Timber/Tyler Creek Interceptor along Tyler Creek was again revised
to the original location. The route of the North Randall Interceptor north of I-90 was also revised
back to the original location. Both of these changes were due to the failure of the City to obtain
easements at the proper time. While no survey was required for these revisions, the drawings
and specifications had to be changed again. Following are the costs associated with this change.

Bore and Jack at Panasonic, Big Timber/McLean Intersection
During February 1992, CDI was directed to modify the drawings to incorporate a bore and jack
under the trees at Panasonic. This change was required because the City had not obtained
easements at the proper time.
Also during February, the Drawings and Specifications were changed twice concerning the work
at the intersection of Big Timber Road and McLean Blvd. Because of the changing.ea<ment
situation, we were required to move parts of the work between the two projects in order to allow
bidding of at least one of the two interceptors.
Following are the costs associated with these changes.

Additional Revision of Alignment Along Tyler Creek
Due to changes in the easement finally obtained by the City for the interceptor along Tyler
Creek, the alignment was again revised. CDI utilized topographic data provided by Burnidge and
Westphal to avoid the need to perform additional survey. Drafting was required. The
Specifications were not changed since the project was already under construction. Following
are the costs associated with this change.

Revision of Easement At P. K. Products
Due to problems in obtaining easements from Panasonic, CDI was directed to redesign the
Tollway crossing to utilize an easement the City was negotiating with P. K. Products. In addition
to the redesign on the south side of the Tollway, it was necessary to make changes to the design
to the north of the Tollway and obtain permission from the Tollway Authority to place
approximately 250 feet of interceptor on Tollway right of way in order to avoid easement
problems with a landowner. To avoid the cost of resurveying, we based the plans on the north
side of the Tollway on USGS maps and utilized a survey by Burnidge and Westphal across the
P. K. Products property. Following are the costs associated with this change.
