RESOLUTION.
AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE
REGENCY SOUTH CONDOMINIUM ASSOCIATION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, be and is hereby
authorized and directed to execute an agreement on behalf of
the City of Elgin with the Regency South Condominium
Association for the enforcement and regulation of parking in
designated fire lanes, a copy of which is attached hereto and
made a part hereof by reference.

MEMORANDUM
TO: Mayor and City Council
FROM: Larry L. Rice, City Manager
SUBJECT: Request for Fire Lane Designations
PURPOSE: This memo will provide the Mayor and City
Council with background information concerning a request by
Rage Management for the designation of fire lanes in
certain locations at the Regency South Condominium Complex.
BACKGROUND: A request has been received from Mr. Don
Rage of Rage Management, on behalf of the Regency South
Condominium Association, to have selected areas within the
Regency South Condominium Complex designated as fire lanes .
The complex has experienced problems with vehicles parking
on the private streets located throughout the complex,
making ingress and egress of emergency equipment difficult
if not impossible at times .
Designation of the fire lanes and a signed agreement
between the City of Elgin and the Condominium Association
will enable the City to enforce on-street parking
regulations on the private streets within the complex.
Maps indicating the proposed locations and proposed
agreement are attached for your reference.
The Police and Fire Departments have both reviewed the
proposed locations of the fire lanes within the complex and
find the designations to be satisfactory.
FINANCIAL IMPACT: There will be no direct costs
resulting from this request. Indirect costs will be
incurred, however, with the increase in areas requiring
enforcement by the Police Department.
RECOMMENDATION: It is staff 's recommendation that the
proposed fire lanes be so designated and that staff be
directed to prepare the resolutions authorizing the
execution of roposed enforcement agreements.

AGREEMENT
PURSUANT TO SECTION 11-209. 1 of the
ILLINOIS MOTOR VEHICLE CODE
. WHEREAS the CITY OF ELGIN has authority to regulate traffic
and parking on semipublic streets within designated fire lanes; and
WHEREAS the REGENCY SOUTH CONDOMINIUM ASSOCIATION of ELGIN is
the governing body for the operation and maintenance of certain
common area, including the private streets and designated fire
lanes contained within its Property located within the corporate
limits of the CITY of ELGIN, most specifically those designated
fire lanes as delineated on the attached Exhibit A ; and
WHEREAS the REGENCY SOUTH CONDOMINIUM ASSOCIATION has
authority pursuant to its Declaration to regulate the use and
operation of parking areas; and is desirous of having the CITY of
ELGIN enforce and regulate the parking of vehicles in designated
fire lanes, and further desires to enter into such a contract for
such purposes.
WITNESSET H:
That for and in consideration of the mutual promises and
covenants herein contained and by authority of the applicable
Illinois Statutes, REGENCY SOUTH CONDOMINIUM ASSOCIATION, owner and
operator of the aforementioned Property, and the CITY of ELGIN,
agree as follows:
1) That fire lanes are hereby established within those
portions of REGENCY SOUTH CONDOMINIUM ASSOCIATION Property as shown
on Exhibit A attached hereto and made a part of this Agreement.

2) That REGENCY SOUTH CONDOMINIUM ASSOCIATION shall erect,
install, and maintain appropriate signs designating such fire lanes
and reading "No Parking Fire Lane" with the warning "Tow Zone"
attached. In the alternative, the REGENCY SOUTH CONDOMINIUM
ASSOCIATION agrees to pay all costs incurred by the CITY of ELGIN
in purchasing, erecting, or maintaining any parking regulation
signs necessary, required, or desirable to be placed on the
Property in connection with designated fire lanes.
3) That the REGENCY SOUTH CONDOMINIUM ASSOCIATION shall
cause that portion of its Property designated as fire lanes to be
painted with bright yellow lines and the words "Fire Lane No
Parking" and shall cause said paint to be maintained in a clear and
readable condition.
4) That the presence of any vehicle, including motorcycles,
either standing or parking in such a manner as to block or obstruct
a fire lane is prohibited.
5) That the CITY of ELGIN shall cause vehicles violating the
fire lane regulations to be removed and stored pending payment by
the owner of the costs in connection with said removal and storage.

That part of the Northwest 1/4 of Section 21, Township
41 North, Range 8 East of the Third Principal Meridian,
bounded by a line described as follows: Beginning at
the intersection of the west line of Edgewood Street,
being the West line of Walter G. McIntosh and Company' s
Fox River Acres, with the North line of South Street,
as established by deed recorded February 18, 1965 as
Document No. 1040511; thence South 88 degrees 17
minutes 45 seconds West, along said North line of South
Street, 685 .919 feet to a point; thence North 01
