RESOLUTION
APPROVING CHANGE ORDER NO. 3 IN THE CONTRACT WITH
SZABO CONTRACTING FOR THE BIG TIMBER/TYLER CREEK INTERCEPTOR
WHEREAS, the City of Elgin has heretofore entered into a
contract with Szabo Contracting for Big Timber/Tyler Creek
Interceptor; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 3,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be
and is hereby authorized and directed to execute Change Order
No. 3, a copy of which is attached hereto and made a part
hereof by reference.

BIG TIMBER/TYLER CREEK INTERCEPTOR
CHANGE ORDER NO. 3
SCOPE: This Change Order #3 covers additional changes in the scope of work at
the Big Timber/Tyler Creek Interceptor that were not reasonably foreseeable at
the time the contract was signed and are in the best interest of the City. The
item covered in this change order is for additional cost for sanitary sewer bore
and jack.
This contract for construction is with Szabo Contracting, Elmhurst, Illinois.
REASON FOR CHANGE:
The project was originally designed and bid with the installation of the 36-inch
diameter sewer installed by open cut method across Big Timber Road just west of
Lyle Avenue. After the project was bid, the City of Elgin decided that it would
be in their best interest to bore and jack the interceptor sewer under Big Timber
Road. This would allow Big Timber Road to remain open to traffic while
construction is ongoing, thus minimizing commuter inconvenience. After the bore
and jack operations were started, utilizing a 48-inch diameter casing, the
contractor encountered soil conditions beneath the road that prevented the casing
from remaining at the proper elevation. The soil conditions encountered were not
discernible from the contract documents or site inspection. It was decided that
in order to ensure the pipe could be installed at the correct elevation, a larger
diameter casing was needed. The installation would also have to be performed
using a push and hand mine procedure instead of bore and jack. This will result
in a net addition to the contract.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount of the contract will be
revised as follows:

1. Add 100 lineal feet of 36-inch diameter sanitary sewer
crossing (push and hand mine) including 60-inch diameter
casing at $395/l .f.
Total Add = $39,500
TOTAL NET ADDITIONAL COST = $39,500.00
The original contract with Szabo Contracting was for $1,769,562.50 (one million,
seven hundred sixty-nine thousand, five hundred sixty-two and 50/100 dollars) .
Previous change orders amounted to $114,236.35 (one hundred fourteen thousand,
two hundred thirty-six and 35/100 dollars) . With this change order amounting to
$39,500.00 (thirty-nine thousand, five hundred and no/100 dollars), the total
contract will be for $1,923,298.85 (one million, nine hundred twenty-three
thousand, two hundred ninety-eight and 85/100 dollars) .
OTHER CONTRACT PROVISIONS: All other provisions shall remain the same.

Jacking Method.

MEMORANDUM
TO: Mayor and Members of the City Council
FROM: City Manager
SUBJECT: Big Timber/Tyler Creek Interceptor Sewer
Change Order No. 3
PURPOSE: This memorandum will provide the Mayor and Council
with information to consider the subject Change Order No. 3 to
the contract with Szabo Contracting, Inc.
BACKGROUND: The work on the crossing of Big Timber has come to
a stop based on the materials encountered at Big Timber and Lyle
intersection. The sewer has been extended to that point and the
contractor has been trying to bore under Big Timber Road. The
ground conditions found at this location are sand, silt and
water. This type of material has made the augering of the
casing that will hold the pipe impossible. The contractor has
requested that he be allowed to jack and mine this crossing.
To jack and mine it will be necessary to install a 60" casing
which can be jacked under the road while the excavation for the
new casing is done by hand from inside the casing. Because this
method is necessary the cost of the crossing of Big Timber Road
will be substantially increased and the length of time to
complete the job will be extended into December.
A copy of correspondence from the contractor is attached for
your consideration. The Change Order #3 and recommendation
letter from the Engineer will be provided prior to the Committee
of the Whole meeting.
FINANCIAL IMPACT: The additional cost for the jacking and
mining of the crossing of Big Timber Road will increase the
contract by approximately $39,500 ( 100 feet @ $395 per foot) .
The current cost of the contract is $1,883,798.85. The proposed
new cost would be $1,923,298. 80.
A copy of the change order will be provided at the time of the
Council meeting for your review and consideration.

RECOMMENDATION: It is recommended that the City Council
direct the City Manager and City Clerk to execute Change Order
No. 3 for the Big Timber/Tyler Creek Interceptor Sewer contract
with Szabo Contracting in the amount of $39,500.
