HomeMy WebLinkAbout92-0909 Szabo Contracting q -cPlo9 RESOLUTION APPROVING CHANGE ORDER NO. 2 IN THE CONTRACT WITH SZABO CONTRACTING FOR THE BIG TIMBER/TYLER CREEK INTERCEPTOR . WHEREAS, the City of Elgin has heretofore entered into a contract with Szabo Contracting for Big Timber/Tyler Creek Interceptor; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 2, attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Larry L. The contractor for this project is Szabo Contracting of Elmhurst, Illinois . REASONS FOR CHANGE: This change order is required to pay the costs associated with the removal of hazardous materials found at and east of the intersection of Big Timber and McLean which were completed by Szabo Contracting. The hazardous materials were not known at the time of the design or letting of the contract and could not be foreseen. By reason of this Change Order No. 2, the contract for construction of the Big Timber/Tyler Creek Interceptor Sewer will be increased in the amount of Seventy-five thousand eight and 10/100 dollars ($75,008 . 10) , the total contract value being One million eight hundred eighty-three thousand seven hundred ninety-eight and 85/100 dollars ($1,883,798 . 85) . BACKGROUND: Szabo Contracting, our contractor for the Big Timber/Tyler Creek Interceptor Sewer, was severely impacted for the initial three weeks at the start of the project when gasoline was encountered during trench excavation. Amoco Corporation assumed responsibility for mitigation efforts within Big Timber Road across their frontage. However, it took about three weeks before the inflow of gasoline contaminated ground water was sufficiently reduced to allow trench excavation and the installation of pipe to continue. As noted in our previous status reports to City Council, pumping evacuation and the installation of well points with pumping were unsuccessful. Only after the installation of a grout curtain was the inflow of gasoline contaminated water reduced sufficiently to allow Szabo to proceed. Szabo needed to be mobilized and on site to proceed with trench excavation should the pumping of the excavation and well points have been successful. Consequently, no project progress was made until the grout curtain was installed and trench excavation could resume. The major portion of this Change Order #2 deals with the cost of unproductive labor and equipment during this time period. A separate report will be provided to City Council concerning additional costs to the City for work within the Big Timber - McLean intersection and along McLean Boulevard for gasoline contamination investigation, excavation monitoring and removal and disposal of contaminated water and soil. This work was contracted with Mittelhauser after Amoco refused responsibility for the gasoline contamination. r 4 Mayor and Members of the City Council August 21, 1992 Page 2 FINANCIAL IMPACT: The amount of Change Order No. 2 to the contract Szabo Contracting for the Big Timber/Tyler Creek Interceptor Sewer is in the amount of $75,008. 10. A copy of the change order is attached for your consideration. The total cost of the mitigation services, including disposal of contaminated soils and water, is $79,077 .43. RECOMMENDATION: It is recommended that the City Council direct the City Manager and City Clerk to execute Change Order No. 2 for Big Timber/Tyler Creek Interceptor Sewer contract with Szabo Contracting in the amount of $75,008. 10. It is also recommended that the invoices and supporting reports of the staff be submitted to Corporation Counsel for possible legal action aga' he responsible parties in this matter. llip Larry L.
