AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE
ELGIN SYMPHONY ORCHESTRA FOR A PERFORMANCE AT WING PARK
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to
execute any agreement on behalf of the City of Elgin with the
Elgin Symphony Orchestra for a performance at Wing Park on
July 19, 1992 , a copy of which is attached hereto and made a
part hereof by reference.

ARTIST CONTRACT
Agreement made this 13th day, of April, 1992 , by and between The
City of Elgin ("Emplo-er ") and the Elgin Symphony Orchestra,
( "Artist") .
The Artist is hereby engaged to perform the program (s) , role (s) ,
and Performances (s) at the location (s) and on the date (s) and
time(s) enumerated:

The Artist agrees, also, to participate and perform in rehearsals

In return for the Artist's services, the Employer agrees to pay a

Sum includes One Thousand dollars for marketing expenses. This
sum is to be paid by check , drawn to the order of the Artist,
either upon completion of the final performance, or mailed to the
Artist on that date whichever is agreed upon by both parties.

in this contract, additional fee arrangements may be necessary.
All notices and/or changes pertaining to this contract shall be
in writing and transmitted either by personal hand delivery or
the U.S. Post Office.
Employer , Artist, and/or Agent shall not be held liable for
fulfillment of this contract should disturbances arise beyond the
control of any of the involved parties, such as fire, civil
disturbances, labor difficulties, strikes, epidemics, destruction
of premises and/or 'Acts of God'.
Controlling law. The validity, interpretation, and performance
of this Agreement shall be controlled by and construed under the
laws of the State of Illinois.

SUBJECT: Elgin Symphony Orchestra Summer Concert
PURPOSE
0
The Parks and Recreation Department requests Council
approval of the contract for the 1992 Summer Outdoor Concert
• featuring the Elgin Symphony Orchestra in the Wing Park
Bandshell .
BACKGROUND
The two previous outdoor concerts performed by the Elgin
Symphony Orchestra under the sponsorship of the City of Elgin
have been memorable ones . Between two and three thousand
persons attended these performances at Wing Park.
This third annual event will again take place at the Wing
Park Band Shell on Sunday, July 19 at 7 : 00 p.m. In case of
inclement weather on this date, the program will take place at
the Hemmens Auditorium. The program will include familiar
popular works as well as well-known classics.
One outdoor concert, featuring the Elgin Symphony
Orchestra, was approved in the Recreation Division 1992 Budget.
The monies are allocated in the Recreation Division's
Miscellaneous Contractual Services budget (082-875-3901) . This
sum will cover costs of the musicians fees, conductor fees,
operations and librarian services, instrument and music rental,
advertising and promotion of the concert.
FINANCIAL IMPACT
. Monies have been approved in the 1992 Recreation Division
Budget for this concert.

RECOMMENDATION
The Elgin Parks and Recreation Department recommends
the City Council approval for the 1992 summer outdoor concert
featuring the Elgin Symphony Orchestra.

Dear Mayor Van De Voorde,
I want to take this opportunity to respond to the issue of an increased
Hotel/Motel tax to provide "funding for the arts."
The Elgin Symphony Orchestra is the major arts group which would
benefit from such a tax and so we are already in favor of the proposal.
We believe that it is an appropriate tax since the ESO and other arts
groups in Elgin attract many visitors and dollars to Elgin's
restaurants, service stations, and often to its hotel/motel facilities.
The ESO draws subscribers from 80 communities from as far north as
Waukegan, south as Lowell, Indiana, west as Oregon, and east as
Chicago. The Elgin choral, theatre, and dance groups also impact a
larger area than simply Elgin itself.
The issue of the financial responsibility of the arts groups has been
raised and we would like to refer you to the 501 (C) (3) not-for-profit
statements filed by Gleeson, Sklar, Sawyers for our certified audits.
Arts organizations normally receive no more than 40% to 50% of their
revenue from ticket sales. The generous sponsorship of corporations
and individuals is necessary to the arts. Since the arts are both
essential to the quality of life in a community and also the source of
visitor dollars for our business, they are also appropriate benefactors
for the local government units as well as State Arts Council and
National Endowment subsides. This combination of corporate, private
and government support has characterized the support of the arts.
While we are not in a position to argue the issue of the legality of an
increased hotel/motel tax, we hope this information will be helpful in
arguing for the appropriateness of funding of the arts by the City of
Elgin.

Dear Mayor Van DeVoorde and Members of the Elgin City Council:
Elgin Area Performing Arts respectfully requests sponsorship of the
1991 Nutcracker Suite Ballet school performances in the amount of
$5, 000.
The EAPA production of the 22nd Annual Nutcracker Suite Ballet is
well known and well respected in the greater Chicago area, both in
dance and audience circles. The Hemmen's staff reports that the
Nutcracker Suite Ballet is the single event which generates the
most calls for ticket information, often months in advance.
Audience surveys 'document that we draw from over 50 surrounding
communities to this production.
We introduced 2 ,.400 students annually to the ballet as an art form
through educational school perforamnce programs. We provide
college and professional level scholarships for talented students
from twelve area high schools through a juried audition scholar-
ship competition each spring.
EAPA is a non-profit organization, and all of its programms are
administered by a volunteer board. With the addition in 1981 of
the Elgin Symphony Orchestra and professional guest artists, our
budget for all Nutcracker performances has grown from $9, 000 in
1981 to over $25, 000. 00 in 1991. Over the decade, the orchestra
has become fully professional and other artists' , promotional, and
rental costs have increased.
We are confident that we can continue to raise a portion of our
funding in other sectors to assist with our public performances and
scholarships. City of Elgin sponsorship greatly enhances our
ability to provide the educational school performances for the
2 ,400 students in our area schools. Your support of our Nutcracker
Suite school performances is most appropriate as the Nutcracker
Suite Ballet is truly a community holiday tradition and our school
educational performances introduce many children to music and dance
who would not otherwise have the opportunity based on a variety of
home-life circumstances.

SUBJECT: Funding for the Arts
PURPOSE
The purpose of this memorandum is to discuss the possi-
ble use of the hotel/motel tax to fund various arts/cultural
organizations, including the Elgin Symphony Orchestra.
BACKGROUND
!® The Elgin Symphony Orchestra (ESO) is requesting a
$25,000 contribution from the City to support its operation
(see attached letter) . Earlier in the year, .the Independent
Players ( IP) requested. $15,000 for a special theatrical pro-
gram which was not received in time to be included in the
CDBG grant process (see attached) . Both requests for finan-
cial assistance are still pending.
The ESO and IP, as well as several other organizations, help
enliven Elgin's center city, increase the quality of life for
the community and enhance the City's -reputation and image.
Moreover, the recently published draft Center City Master
Plan Report recommends that Elgin build on its existing
strengths and become a regional resource for the arts and
entertainment.
In reviewing funding requests for the arts, the City Council
may want to consider a range of alternatives including the
following:
1. Provide no funding for the arts.
2. Consider requests for financial support as they are
received with monies coming from the City' s General
Fund.-

3. Same as two, but use an increase in the hotel/motel _
tax receipts to fund the requests . A report on the
hotel/motel tax is attached and it shows that for
each 0.5% increase in the tax, e.g. , 3 1/2 to 4%,
approximately $25,000 in additional revenue could
be raised.
4 . Consider a more comprehensive approach to arts
funding whereby a special fund is established and
organizations are encouraged to participate in a
formal grant application process (perhaps on a two
year funding cycle to ensure continuity) .
5. Same as four, but with the City Council appointing
an "Arts Council" to consider the grant applica-
tions and to make recommendation regarding funding
various organizations and programs .
FINANCIAL IMPACT
The report on the hotel/motel tax provides information
on how the receipts are currently used as well as the revenue
potential if the rate was increased.
SUMMARY
Various alternatives to requests for support from
arts/cultural organizations were outlined above. The Mayor
and City Council may want to provide additional direction to
the staff regarding funding for arts.

On April 21, 1991 the Chicago Tribune's Tempo Northwest cover story
featured The Elgin Symphony Orchestra. This three page article entitled An
Ensemble of Note (copy enclosed) describes our symphony as ". . .the finest
professional ensemble outside the city!"
To support an orchestra of this caliber requires raising nearly one-half
million dollars of private and public support in addition to our ticket income.
To that , end, we are seeking a $25,000 contribution from the City of Elgin.
Your support will not only enhance the professional status of our orchestra,
but will help offset expense increases such as the surcharge now inured at
Hemmens Auditorium.
j A review of national statistics) would indicate support of this kind is
rather common. In fact, on average, orchestras our size receive between 2% and
8% of their revenues from local Government. • The City's contribution would
qualify them as our ' "Classical Series Sponsor" and would be acknowledged
accordingly (with your approval) throughout our season.
