Solid Waste Collection Services Contract Amendment #1 City of Elgin Collection and Disposal of Garbage and Refuse The CONTRACT AMENDMENT #1, made as of the ,14iL day of of 1992, by and between the City of Elgin, Illinois (hereinafter called the CITY) and Elgin Wayne Disposal, Elgin, Illinois (hereinafter called EWD) . WITNESSETH, THAT WHEREAS, the CITY and EWD have previously entered into a Solid Waste Collection Services Contract dated the 14th day of February, 1990 for Collection and Disposal of -GA-rbage and Refuse and Curbside Recycling Collection Program. Whereas, the Solid Waste Collection Contract includes a section covering the additional cost for yardwaste disposal by EWD and EWD' s responsibilities and whereas EWD has identified the fol- lowing additional services and associated costs : Additional Scope of Services A. The present contract with Elgin Wayne Disposal (EWD) provides for the collection of all yardwastes during the months of April through November. The City is to pay EWD at the contract rate of 79c/Stop/Month for yardwaste collection in 1992, providing all loose yardwaste material is placed in large Kraft paper bags and limbs/branches are tied in bundles . B. The contract is hereby amended such that grass clip- pings will not be collected unless a yardwaste stick- er is attached to each paper bag. Stickers shall be sold for $1 . 00 each by EWD through various local retail stores as outlined in the EWD letter dated 2-14-92 . Details for implementation by EWD are out- lined in their letter dated 3-16-92 . The circumstances making this change necessary were not reason- ably foreseeable at the time the contract was signed. Therefore, the City of Elgin and Elgin Wayne Disposal mutually agree to modify the yardwaste collection program as outlined herein at no additional cost to the City of Elgin. In witness whereof, the parties hereto have caused this AMEND- MENT to be executed as of the day and year hereinabove set forth. A. Sticker Sales Locations Per your instructions , we have identified sales locations in each part of town making the sticker purchase as convenient as possible. Advertising 1 . We will work with Elgin Proud & Beautiful to develop an ad for the Courier . This ad will address the yardwaste plan and explain grass clippings and the use of stickers . 2 . We will develop a flyer to be passed out with the stickers encouraging homeowners to leave the grass lay and explaining its benefits . 3 . I have contacted radio station WRMN for a slot on their talk show to address yardwaste . C . Enforcement We expect the majority of yard waste picked up in April to be debri from cleaning the yard and not from grass clippings . We will not look in every bag , only question those bags where it is obvious it is grass clippings . In the event grass is put out without a sticker we will attach an orange tag to the bag and leave them a sheet on where to buy stickers and how the program works . The tag explains why the item was not picked up. D. Elgin Brochure We are also updating the Elgin brochure to include the new yardwaste plan as well as a new map of service days . This proposal was drafted after a careful review and conversations with a cross section of Elgin residents. Yardwaste became a topic at the Elgin Expo . While working the Elgin Proud and Beautiful booth , we were able to get some very good input from the residents . As you know, there is not a yardwaste management facility in Kane County. Yardwaste generated in DuPage County will be given first priority at the DuPage County facility. Out of county yardwaste is accepted if space is availalbe. However, I expect they will reach capacity with their own yardwaste (as they did last year) before we are able to use the facility. As was done in 1991 , it is our intention to transport the yardwaste from Elgin to the DeKalb County yardwaste facility in DeKalb. It is our impression that by reducing yardwaste volumes in Elgin, we will be able to continue using this site without overloading its' capacity. Last year when we addressed the City Council it was decided to continue with the existing program for 1991 and eliminate the grass clippings from the yardwaste contract in 1992 . PROPOSAL A continuation of the yardwaste program for those items that cannot be left on the lawn: leaves, shrubs , tree trimmings , and gardening waste. Grass clippings will be eliminated from this program, as they can be managed by leaving them lay on the lawn. All indications are these clippings actually help the lawn and do not create thatch. Residents surveyed indicated a favorable response to this program. I think we should still offer a program for grass clippings , but it should be a "user pay system" . Our past experience has indicated that when a "user pay" sticker program for grass is initiated, at least half the volume goes away. ill Il,if A Waste Management Company Mr. James Kristiansen Page -2- Last year, I indicated to the Council our situation on yardwaste cost. The State of Illinois yardwaste ban actually took effect after our contract with the City of Elgin was in effect , but was anticipated in the contract. The problems of locating or effectively operating a compost facility were unforeseen and projected disposal rates at the facilities were speculative . These locations quickly found out how difficult and time consuming the facility was to run and either closed or double or tripled their price . In 1991 we were actually fortunate in the fact we had a very dry growing season for grass . As our cost comparison will indicate, we actually lost $174 . 50 per load picked up. I am enclosing our 1991 cost comparison for your perusal . As a summary, I would ask the City Council ' s approval of a continuation of our existing yardwaste program with the elimination of grass clippings . I still believe we need to give the residents a choice so I would recommend a "user pay sticker program" for grass clipping with stickers being sold by local retail stores for $1 . 00 each. Elgin Wayne will administer the sticker program. I would appreciate your review and comments on this proposal .
