HomeMy WebLinkAbout92-0311 Employment Contract City Manager Larry Rice COVERSHEET Agreement/Document Attached Document Name in Laserfiche: 92-0311 Employment Contract City Manager Larry Rice AMENDED EMPLOYMENT CONTRACT WHEREAS, it is in the public interest and serves the health, safety and welfare of the citizens of the City of Elgin, Illinois, to employ Larry L. Rice as City Manager upon such terms and conditions as will promote his continuous productivity and efficiency, provide him with reasonable employment and financial security, and set forth a fair, equitable, and orderly means for continuation of such employment, and in consideration of the mutual covenants contained herein, the City of Elgin, a municipal corporation, and Larry L. Rice, agree as follows : 1 . Larry L. Rice shall serve as City Manager of the City of Elgin for an indefinite term and shall carry out to the best of his ability all the duties imposed upon him as City Manager by the statutes of the State of Illinois and the ordinances of the City of Elgin, including the following: a. To enforce the laws and ordinances within the City of Elgin; b. To appoint and remove all directors or departments upon no basis other than that of merit and fitness; C. To exercise control of all departments and divisions thereof; d. To attend all meetings of the City Council with the right to take part in the discussions, but with no right to vote; e. To recommend to the City Council for adoption such measures as he may deem necessary or expedient; f . To perform such other duties as may be prescribed by statute or may be required of him by ordinance or resolution of the City Council . 2 . Rice shall commence employment on October 16, 1989, and his salary shall initiate at an annual rate of $80,200. The Council shall consider a merit adjustment to his salary after six months, and on January 1st of each year thereafter. Rice' s salary shall be at an annual rate of $93, 156 commencing January 1, 1992 . 3 . The City agrees to pay organizational memberships necessary and desirable for the performance of the duties of the office of City Manager, and expenses of a generally job-affiliated nature incurred by Rice in the conduct of City business, including professional conferences Page 1 of 3 and meetings, and including the 1989 ICMA Conference in Des Moines . 4 . The City shall pay for an individual, portable term life insurance policy for Rice in the amount of his annual salary. 5 . The City shall, in addition to IMRF, provide for and contribute an amount equal to 8 . 7% of Rice' s salary toward his ICMA-RC 457 deferred compensation program. 6 . The City shall either provide Rice with the use and enjoyment of a personal passenger automobile, or pay to Rice $350 per month for an automobile allowance, it being the intent of both parties if the allowance is paid that he will provide his own transportation within the Elgin area. 7 . The City shall pay expenses for Rice and his wife to make one visit to Elgin to seek housing. The City shall pay all expenses associated with moving Rice and his family and furniture, household goods, and personal possessions to Elgin, including travel expenses . 8 . At such time as Rice commences employment as City Manager of Elgin, if he maintains residences in both Elgin and Lakewood, Colorado, the City shall pay to him $600 per month through and including June, 1991 in order to maintain two residences . 9 . City shall pass such resolution as may be necessary to permit Rice to convert eligible out-of-state prior service retirement credits to the Illinois Municipal Retirement Fund. 10. Upon termination from the Office of City Manager, Rice shall receive compensation for all accrued sick leave benefits as provided by ordinance, and for all accrued and unused annual leave without limitation by city ordinances . Rice shall have an initial earned credit of ten days vacation, and accrue vacation benefits at the rate of four (4 ) weeks per year. Rice may also in his discretion during his employment convert annual leave to cash payments . 11 . In the event the City of Elgin terminates Rice ' s employment as City Manager, the City shall continue his salary and all benefits then in effect for a period of six months as a severance benefit. Such benefit shall be extended by an additional one months salary for each full year of employment to a maximum of six years . Such severance benefit shall be payable regardless of whether he obtains other employment. 12 . Rice may engage in such activities as teaching, writing, and professional consultation, provided such Page 2 of 3 activities are accomplished upon his own time and do not conflict with his duties and responsibilities as City Manager. 13 . In addition to the terms and provisions set forth above, Rice shall be entitled to all other benefits and privileges afforded to Class A management level employees under applicable ordinances of the City of Elgin. 14 . That this amended agreement shall supersede and replace the agreement between the parties dated September 14, 1989 . IN WITNESS WHEREOF, the City of Elgin has caused this amended agreement to be executed by its Mayor and duly attested by its City Clerk, Larry L. Rice has executed this agreement, and it shall be in full force and effect upon its execution. DATED this day of March, 1992 .
