PURPOSE: • This memorandum will provide the Mayor and Council with information to consider approving an amendment to the agreement with Coleman Land Co. for additional land acquisition services. BACKGROUND: On June 26, 1991, the City Council authorized a letter of engagement with Coleman Land Co. for appraisal and negotiation services to acquire easement rights for the installation of a • water main from Highland Avenue south to U.S. Route 20. Appraisals for the property owned by three principal owners were completed by November 19, 1991, and, subsequently, Mark Coleman was directed to proceed with discussions with the owners for land acquisition. These negotiations are proceeding well. The owners have been sent proposed contracts, and adjustments to terms are currently underway. No major problems are foreseen. As the City is in position to construct the entire northwest corridor water main during 1992, it behooves the City to move in a timely fashion to acquire remaining easements north from Highland Avenue to the water tower at Alft Lane. Initially, the contract with Mr. Coleman was only for a segment of this entire length as City staff was eager to see how effective this procedure would be. At this point, it appears to be working well. r Page 2 To keep this project on schedule, it is suggested the contract with Mr. Coleman for acquisition of easements north of Highland Avenue be extended. The attached proposal addresses his fees to acquire all remaining easements necessary to complete this length of water main. FINANCIAL IMPACT: The Water Department's 1992 budget contains $25,000 for land acquisition services . RECOMMENDATION: It is recommended that the Public Works Department be directed to enter into an agreement with Coleman Land Co. that would extend their services for acquisition of easements for the properties north of Highland Avenue to the Alft Lane water tower. The scope of this work would be focused on securing land easements through negotiations on behalf of the City, holding in abeyance the potential for land appraisal services if so required by any property owners . Billing for these services shall not exc- ==1,25,000. Dear Larry: In response to your January 6th letter, I would be pleased to extend our working arrangement whereby I would assist In procuring easements north from Highland Ave. to Alit Lane and the new water tower. I have determined that there are approximately 10 parcels involved in this phase. As we discussed, appraisals will not be done unless it becomes necessary in the acquisition process. Acquisition activities will include analysis of the affected parcels, analysis of the larger parcel if applicable, initial contact with property owners and other related services including initial contract generation through attending the closing. The fee will be based on time spent on the above activities at the rate of $100 per hour, and billing will be monthly- The City has not provided exact locations for the desired easement path. However, according to the SidweR Aerials it appears that there may be as many as 10 affected parcels. In Phase I the agreed fee proposal was capped at$2,500 per parcel and I am willing to do the same in Phase II.
