AUTHORIZING EXECUTION OF AN ENGINEERING SERVICES CONTRACT
AMENDMENT #4 FOR THE SLADE AVENUE FACILITIES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to
execute an Engineering Services Contract Amendment #4 on
behalf of the City of Elgin with Clark Dietz, Inc . for the
Slade Avenue Facilities, a copy of which is attached hereto
and made a part hereof by reference.

SUBJECT: ENGINEERING SERVICES CONTRACT AMENDMENT #4 WITH
CLARK DIETZ, INC.
PURPOSE:
This memorandum will provide the Mayor and Council with
information to consider in awarding a contract amendment to
Clark Dietz, Inc.
BACKGROUND:
ri.' On September 14, 1989, the City entered into a contract with
the engineering firm of Clark Dietz, Inc. , for the design and
engineering services of the Slade Avenue facility. Part of this
project included the design and inspection services for the
installation of a 24-inch gravity replenishment line from the
Riverside Water Treatment Plant to the Slade Avenue reservoirs.
On September 17, 1991, the City received two bids for the
construction of this gravity replenishment line. The engineer's
estimate for this contract was $330,000, while the low of the
two bids received was for $575,725. Therefore, the City
rejected those bids and proceeded to rebid this project. Five
bids were received on March 3, 1992, with the award to be made
at the March 11, 1992, Council meeting.

As this process delayed inspection of the actual construction,
Clark Dietz is asking for recovery of additional expenses. This
falls into two areas : first, for expenses involved in rebidding
the project and second, for fees to cover engineering services
anticipated to take place at the same time the Slade Avenue
facility was being built (see the attached engineering services
contract amendment #4 for additional information) .
FINANCIAL IMPACT:
The cost for these additional services is estimated to be
$35, 100. The Water Department's operating fund has sufficient
revenue to provide for this service.
RECOMMENDATION:
It is recommended that the Council approve amendment #4 to the
engineering services contract with Clark Dietz, Inc. , for the
cost of $ 5, 10'. rich is not be exceeded without the written

Slade Avenue Facilities
The CONTRACT AMENDMENT #4, made as of the fx)bEAday of /11 (L LL of 1992,
by and between the City of Elgin, Illinois (hereinafter called the CLIENT)
and Clark Dietz, Inc. , Champaign, Illinois (hereinafter called CDI) .
WITNESSETH, THAT WHEREAS, the CLIENT and CDI have previously entered into
an Engineering Service Agreement dated the 14th day of September, 1989 and
Contract Amendment #1 dated the 31st day of October, 1990 and Contract
Amendment #2 dated the 22nd day of May, 1991 and Contract Amendment #3
dated the 24th day of January, 1992 for professional services on the
design and construction of the Slade Avenue Facilities (hereinafter called
the PROJECT) for a lump sum of Four Hundred Forty-Four Thousand Thirteen
and No/100 Dollars ($444,013) .
Whereas, the Engineering Services Contract includes Sections covering
Additional Services of CDI and the Client's Responsibilities and whereas
CDI has identified the following additional services and associated costs:
Additional Project Scope
1. Due to circumstances beyond the control of
either the City or the Engineer, the bid
prices received for the Gravity Replenishment
Line were higher than expected. It was in the
best interest of the City to reject the bids
and rebid the project at a time when the bids
are likely to be more reasonable. Since the
Engineering Services Agreement was based on
bidding the Gravity Replenishment Line once,
the Engineering Services Agreement is modified
to compensate the Engineer for the costs of
rebidding. $2,048.00
2. The Engineering Services Agreement anticipated
the concurrent construction of the Slade
Avenue Facility and the Gravity Replenishment
Line, allowing the inspection by the same
person. Since the Slade Avenue Project is
nearing completion, additional inspection
services are required $33,052.00
Total Engineering Increase $35, 100.00
The circumstances making these changes necessary were not reasonably
foreseeable at the time the contract was signed.
Therefore, the City of Elgin and Clark Dietz, Inc. mutually agree to
increase the total contract lump sum amount by $35,100.00 to Four
Hundred Seventy-Nine Thousand One Hundred Thirteen and No/100 Dollars
(479,113.00) .
In witness whereof, the parties hereto have caused this AMENDMENT to be
executed as of the day and year hereinabove set forth.
