RESOLUTION
APPROVING CHANGE ORDER NO. 2 IN THE CONTRACT WITH
AINLAY TANK TESTING AND REPAIR, INC. FOR THE
REMOVAL OF UNDERGROUND STORAGE TANKS
WHEREAS, the City of Elgin has heretofore entered into a
contract with Ainlay Tank Testing and Repair, Inc. for the
removal of underground storage tanks; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 2,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be
and is hereby authorized and directed to execute Change Order
No. 2, a copy of which is attached hereto and made a part
hereof by reference.

REMOVAL OF UNDERGROUND STORAGE TANKS
CHANGE ORDER NO. 2
SCOPE: This Change Order No. 2 covers additional work re-
quired by the Office of Illinois State Fire Marshal
and the Illinois Environmental Protection Agency for
the proper Removal of underground storage tanks,
contaminated product, and contaminated soils for the
City of Elgin.
The contractor for this project is Ainley Tank Test-
ing & repair Inc. , Algonquin, IL.
REASONS FOR CHANGE: This change order is required for the costs
associated with the additional work required by the Office of
the Illinois State Fire Marshal and the Illinois Environmental
Protection Agency - Division of Land Pollution Control, for the
corrective action needed for the proper removal and disposal of
underground storage tanks and contaminated soils from the Lords
Park Pavilion property site. The magnitude of these changes in
the scope of work were not anticipated under the original con-
tract.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount of the con-
tract will be revised as follows :

Soil Borings 400 . 00
Excavating and disposal of contaminated soil

The present contract with Ainley Tank Testing & Repair Inc. is
for $720, 609 . 50 . By reason of Change Order No. 2, the contract
for the removal of underground storage tanks will be increased
in the amount of $ 47 ,400 . 00, thereby making the total contract
value to be $768, 009 . 50.
All other contract provisions shall remain the same.

MEMORANDUM
TO: Mayor and Members of City Council
FROM: City Manager
SUBJECT: Change Order No. 2 - Underground Storage Tank Removal
PURPOSE: The purpose of this memorandum is to provide Council
with information to consider Change Order No. 2 to the subject
contract.
em. BACKGROUND: At your July 11th meeting, Council awarded a
contract for the removal of underground storage tanks at various
locations throughout the City to Ainley Tank Testing & Repair
Inc. , of Algonquin.
At your September 11th and 25th Committee of the Whole and regu-
lar meeting, Council reviewed and approved Change Order No. 1,
which dealt with the problems that were encountered in the South
Grove Redevelopment District.
During this same time frame, Ainley began work at the Lord's
Park Pavilion; while the initial work indicated only a minimal
amount of soil contamination, following the actual removal of
the heating fuel tank, a relatively large vein of contaminated
soil was discovered directly under the tank to a depth of about
12-15 feet below the asphalt driveway immediately east of the
pavilion. Because of its closeness to the structure and the
fact that the building renovations have begun, staff has had a
number of meetings with the architect, the general contractor,
Ainley, and the IEPA in order to develop the appropriate plan
for the removal of the contaminated soil without interfering to
any great degree with the on-going renovations.
Following our most recent meeting with the IEPA on Monday, Octo-
ber 21, and the taking of additional soil samples by Ainley
dita yesterday, it is now our collective best judgment that the con-
tamination can be removed through additional soil excavations
without adversely affecting the renovation project. To that
end, the attached Change Order #2 has been developed for Coun-
cil 's consideration.

FINANCIAL IMPACT: The City will begin the application process
with the IEPA in order to access the State's Leaking Underground
Storage Tank (LUST) fund for this site. Because this tank was
less than 1100 gallon capacity and contained only heating fuel,
it is believed that only a $10,000 deductible would apply.
The LUST application process is on a reimbursement basis and is
expected to take several months. In the interim, funds need to
be established to complete the tank removal and soil clean-up at
the Lords Park Pavilion.
Our earlier analysis of the General Fund found the following:
Monies could be made available for these costs before
State LUST funds or other possible recovery sources are
received. At this late point in the year, there have
been no major unforeseen expenses other than Change
Order #1 that have impacted the General Fund' s contin-
gencies, and there is approximately $700,000 unexpended
between Non-departmental 's Special Projects Account
(Approp. #190-959 ) and Non-departmental 's Capital Ac-
counts (Approp. #190-978 & #190-991) .
RECOMMENDATION: The recommendation is that the City Council411
approve Change Order No. 2 for the removal of underground tanks
in the amount of $47,400. 00.
