HomeMy WebLinkAbout91-0814 NHS PURCHASE OF SERVICE AGREEMENT between Neighborhood Housing Services and the City of Elgin WHEREAS, the City of Elgin is committed to the revitalization and redevelopment of certain areas within the city limits; WHEREAS, Neighborhood Housing Services of Elgin, is incorporated to provide revitalization assistance to certain areas within the city limits; WHEREAS, the City of Elgin and Neighborhood Housing Services of Elgin wish to work cooperatively to revitalize target neighborhoods as delineated by Neighborhood Housing Services. NOW, THEREFORE it is agreed by the City of Elgin and Neighborhood Housing Services that: The City of Elgin, will contribute $25,300 to the Neighborhood Housing Services during the 1992 calendar year based upon the following performance criteria: 1) For the continued development and stabilization of the SOS (Save Our Streets) neighborhood organization composed of residents of the Neighborhood Housing Services target neighborhood, the City of Elgin shall pay Neighborhood Housing Services the lesser of $25,300 or actual expenses related to the development of said organization. Such payment will be compensation for the activities outlined in the Strategic Plan for Self-Reliance for 1992. These activities would include but would not be limited to: Model Block initiatives, area clean-up activities, neighborhood identification initiatives, seasonal projects, monthly meetings, identification and training of neighborhood leaders, membership recruitment which includes organizational newsletter, mailing/postage, development and distribution of informational materials, children's activities, coordination of City services to maximize neighborhood involvement and support (i.e. tree trimming, street cleaning, trash pick-up,. 2) In order to continue to be eligible for payment, NHS will submit to the City quarterly performance reports which will summarize neighborhood organizational efforts, housing rehabilitation work, loan production and other NHS activities. Payments to be made within 30 days of billing date (quarter end). Rice, City Manager SUBJECT: NHS Purchase of Service Agreement PURPOSE The purpose of this memorandum is to forward to the Mayor and City Council a purchase of service agreement (PSA) with Neighborhood Housing Services of Elgin (NHS) . BACKGROUND Last year the City Council agreed to contribute $27,100 to NHS for various community development activities as well as neighborhood projects and programs. In the 1992 budget process, NHS requested a contribution of $25,300 for this year. A proposed PSA with NHS for the use of these funds is attached. To be eligible for payment NHS will submit to the City Council quarterly performance reports which will summarize neighborhood organizational efforts, housing reha- bilitation work, loan production, and other community develop- ment activities. FINANCIAL IMPACT There is $25,300 budgeted in the Non-Departmental sec- tion of the budget for the NHS contribution. RECOMMENDATION The staff recommendation is for the City Council to approve the agreement with NHS and authorize its execution. Rice, City Manager SUBJECT: 414 Hill PURPOSE The purpose of this memorandum is to forward to the Mayor and City Council a proposed Purchase of Service/Devel- opment Agreement with Neighborhood Housing Services (NHS) . BACKGROUND Last November, the City acquired the property commonly known as 414 Hill from Kane County for $575. The property is improved with a two story frame house which has been vacant for several years and is in a state of disrepair. The proper- ty is zoned R-4 but would be suitable for only a single or two family residence because of limited lot size (66 'x104 .3' ) . In February, 1991, the City Council decided to sell the property to NHS and staff was directed to negotiate a develop- ment agreement. Subsequently, NHS retained the services of an architect who prepared the specifications for the build- ing's rehabilitation. Contractor bids for the repair work have been received by NHS. The above work was done prior to finalizing an agreement with the City to ensure the project was financially feasible. Attached is the proposed draft agreement between NHS and the City. It is staff's understanding this agreement is consistent with the City Council 's direction in selling and improving this property. Moreover, the agreement provides that if NHS fails to perform, the City at its discretion may purchase the premises from NHS for $1. 00. However, in seek- ing this remedy, the City Council should be reminded the property will be encumbered with a construction loan of $60,000 to $66,000. o .. AND THE CITY OF ELGIN Neighborhood Housing Services of Elgin proposes to purchase the property identified in the Attachment A, commonly known as 414 Hill Avenue, from the City of Elgin for the purposes of rehabilitating the property for use as a single family home according to the following terms: A. Neighborhood Housing Services agrees to rehabili- tate the property in accordance with the work out- lined in Attachment B (Bid for Construction) . B. Neighborhood Housing Services agrees that upon completion of the rehabilitation the premises will comply with all requirements of the City of Elgin building code. C. Neighborhood Housing Services agrees to the place- ment of a covenant upon the property which will state that the property will only be used, improved and occupied for single family residential purposes . D. Neighborhood Housing Services agrees that the prop- erty will comply with the City of Elgin building code standards within twelve ( 12) months from the date of this agreement. In the event the property does not achieve this compliance, the City of Elgin, in its discretion, may purchase the premises from Neighborhood Housing Services for $1 .00, and plus any and all liens, obligations and encumbranc- es related to subject property. E. Neighborhood Housing Services agrees to pay all closing costs, including but not limited to, cost of title and survey. F. Neighborhood Housing Services agrees that it ac- cepts the premises subject to the existence of a joint driveway over the northerly side of the land for the benefit of the land and premises northerly and adjoining. G. Neighborhood Housing Services agrees to present to the City of Elgin a contract for the purchase of the premises, which is acceptable to the City of Elgin in its entirety, on or before August 31, 1991 . Said contract incorporates, but not be limit- ed to, all the terms of this agreement.
