ACCEPTING THE LETTER OF ENGAGEMENT OF COLEMAN LAND COMPANY
FOR APPRAISAL SERVICES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, be and is hereby
authorized and directed to accept the letter of engagement on
behalf of the City of Elgin of Coleman Land Company for the
appraisal of five easements, a copy of which is attached
hereto and made a part hereof by reference.

RE: Letter of engagement
Dear Mr. Diebert:
This letter confirms our engagement by the City of Elgin to
complete the real estate services delineated in Veronica Bell 's
May 9th, 1991 letter, request for appraisal and negotiation
services.
The scope of our assignment will be to prepare fair market value
appraisals on the 5 identified parcels of real estate, including
easement valuations, followed by direct negotiations for the
acquisition of said easements.
The fee for the appraisal services will be $10, 500, and the fee
for the negotiation phase will be billed on an hourly basis, at
the rates of $100 per hour for a principal, $85 per hour for an
associate and $35 per hour for general staff. We agree to a
ceiling on negotiation fees of $2 , 500 per parcel, provided there
is an understanding that the City of Elgin is prepared to use
eminent domain powers, and that negotiation efforts will not be
unduly drawn out.
The completion time of the appraisal phase of the assignment
will be approximately 30-45 days based on our current backlog.
Negotiations will commence as soon as mutually agreed.

REQUEST FOR PROPOSAL
APPRAISAL AND NEGOTIATION SERVICES
INTRODUCTION
The City of Elgin is requesting a proposal for performing an
appraisal for five portions of land which are part of five
larger parcels of land located in Elgin Township, unincorporated
Kane County. Negotiation services for acquisition of the
partial takings will also be needed.
PROJECT DESCRIPTION
The scope of this project includes performing an appraisal for
and negotiating acquisition of five portions of land located
between Highland Avenue and U.S. Route 20 . The City of Elgin
requires a twenty foot wide strip of land to be utilized as an
easement for the future extension of City water lines. A
temporary fifty foot easement will be required for construction
purposes.
PROJECT LOCATION
The subject property is located west of Hidden Hills
Subdivision, and extends between Highland Avenue and U.S. Route
20 (see location map) .
SCOPE OF SERVICES
Provide appraisal and negotiation services for five (5) portions
of land which consist of a twenty foot wide strip for a
permanent easement. Negotiate for a fifty (50) foot temporary
easement for construction purposes. Base the appraisal upon
contributing value of its current use which is consistent with
Kane County Farming District.

FEES
The service fee for this project should be a firm-fixed lump
sum. The firm-fixed lumps sum should include all professional

-SUBJECT: Consideration of a Request for Professional Services
for Appraisals of Five Easements, Including Negotia-
tions for Acquisition for the Water Department
PURPOSE
This memorandum will provide the Mayor and City Council
with information to consider entering into an agreement for
(6"68 professional services for appraisals of five easements, in-
cluding negotiations for acquisition of property.
BACKGROUND
Water distribution system modeling as being performed by
the consulting engineering firm of Black & Veatch has indicat-
ed a major north-south transmission line to be located west
of Hidden Hills subdivision, extending between Highland Ave-
nue and U.S. Route 20. This main will be a significant link
in the distribution system connecting the one million gallon
elevated water tower at Alft Lane and a new west zone pres-
sure main from the Airlite Water Treatment Plant. As develop-
ment in this area is occurring at a rapid pace and without
any logical sequencing in a step-by-step pattern of the devel-
opers, the Department wishes to take a pro-active role in
acquiring rights-of-way for this transmission main, rather
than waiting for developers to annex to the City, providing
this step-by-step linkage.
City staff decided that to secure these services, a firm
well versed in both urban and rural setting should be contact-
ed. To accomplish this, the attached Request for Proposal
appraisal and negotiation services was sent to the firm of
Coleman Land Company. Also attached is their professional
(111k. services bid.

FINANCIAL IMPACT 411
The attached professional services bid from Coleman Land
Company placed a fee of $10,500 on the appraisal fees of this
work. The bid also references fees for the negotiation
stage. Funding for these services will be provided from the
Water Department's Contingency Fund.
RECOMMENDATION
It is recommended that the Water Department be directed
to proceed with the development of a contract with Coleman
Land Company to secure their services for the acquisition of
necessary ease ents.

Thank you for your invitation to bid on the above referenced
project. Your bid package was exceptionally detailed, taking
much of the uncertainty out of the process.
The ompletion time requirements appear to be essentially
realistic. The appraisal phase of the-assignment may take
somewhat longer, say 30-45 days based on our current backlog.

Quoting a flat tee fQr the negotiation stage involves risk. Row
many hours will be spent with legal staff? now accessible will
the property owners be? Mow any meetings will it take with each
owner? We would prefer to invoice on an hourly basis for
services relating to negotiations. Our hourly rates are $100 for
a principal, $85 for an associate and $35 for general staff. It
this poses a problem for the City, please let me know.
