Fakroddin - Kane County Superintendent • • I - AGREEMENT THIS AGREEMENT entered into this is day of lv 0 E A.D. 192V, by and between the STATE OF ILLINOIS, acting by and through its DEPART(IENT OF TRANSPORTA- TION, hereinafter called the STATE, and the CITY OF ELGIN, County of Kane, of the State of Illinois, hereinafter called the CITY. WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is desirous of improving approximately 4,820 lineal feet of Larkin Avenue (formerly U.S. Business Route 20) (F.A.P. Route 557, STATE Section 8WRS-1(82), CITY Section 84-00133-00-TL) from west of Airlite Street east to west of McLean Boulevard in the City of Elgin by widening and resurfacing the pavement-from its present typical pavement width of 24' , 36' , 48' and variable to a width of 36' edge to edge from Airlite Street to west of Lyle Avenue, to 55' edge to edge from west of Lyle Avenue to west of McLean Boulevard (providing for two 12' traffic lanes plus a 12' median lane from Airlite Street to west of Lyle Avenue and four 11' traffic lanes plus an 11' median lane from west of Lyle Avenue to west of McLean Boulevard), resurfacing and restriping Lyle Avenue north approach, 40' and variable to provide two 14' traffic lanes plus a 12' left-turn lane, south approach to 36' and variable to provide two 12' traffic lanes plus a 12' left-turn lane, con- structing combination concrete curb and gutter, storm sewers along Larkin Avenue with outlets via Maple Street and Second Street flowing southerly to proposed CITY construction of detention pond or outlet facility located west of Lyle Avenue and north of Erie Street (approximate distance of 1,150 lineal feet), removing exist- ing temporary signals and installing traffic control signals at the intersection • of Larkin Avenue and Lyle Avenue with emergency vehicle preemption system, and by performing all other work necessary to complete the improvement in accordance with the approved plans and specifications; and WHEREAS, with the completion of this improvement it will become part of the overall improvement of former U.S. Business Route 20 for future jurisdictional transfer to the CITY from east of Randall Road to west of Lovell Road and will in- clude the south frontage road from Airlite Street to the west CITY limit; and WHEREAS, the CITY is desirous of said improvement in that same will be of im- mediate benefit to the CITY residents and permanent in nature; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE agrees to make the surveys, obtain all necessary right of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improve- ment to be built in accordance with the plans, specifications and contract. 2. The STATE agrees to pay all right-of-way, construction and engineering costs, subject to reimbursement by the CITY as hereinafter stipulated. 3. It is mutually agreed by and between the parties hereto that the esti- mated cost of the improvement is as follows: ROADWAY Construction Costs 81,246,000.00 P & C Engineering Costs (15%) $ 186,900.00 Right of Way Costs $ 130,000.00 Total Estimated Cost $1,562,900.00 ROADWAY PARTICIPATION CITY Share 0% STATE Share 15% Federal Share 85% -2- • • TRAFFIC SIGNALS Installation of permanent signals - Lyle Avenue Construction Costs $ 100,000.00 P & C Engineering Costs (15%) $ 15,000.00 Total Estimated Cost $ 115,000.00 (Emergency vehicle preemption system $8,000.00) . TRAFFIC SIGNAL PARTICIPATION Installation of permanent signals - Lyle Avenue CITY Share 7.5% ($8,625.00) STATE Share 7.5% Federal Share 85.0% (Emergency vehicle preemption system 100% CITY $8,000.00) 4. The CITY agrees to reimburse the STATE in the amount of the above costs for installation of the traffic signals at Lyle Avenue plus the emergency - vehicle preemption system. The total cost to the CITY is estimated to be ' $16,625.00. 5. The CITY has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as Exhibit A and made a part hereof. Upon award of the contract for this improvement, the CITY will pay to the Department of Transportation of the State of Illinois in a lump sum, from any funds allotted to the CITY, an amount equal to 95% of its obligation incurred under this Agreement and will pay to said Department the remainder of its obligation (including any nonparticipating costs for FA projects) in.a lump sum upon completion of the project, based upon final costs. The CITY agrees to pass a supplemental resolution to provide the necessary funds for its share of the cost of this improvement if the amount appropriated herein proves to be insufficient to cover said cost. -3- • • 6. The CITY has adopted and will put into effect prior to the STATE adver- tising for the work to be performed hereunder, an ordinance requiring that parking be prohibited along Larkin Avenue within the limits of this improvement, within the CITY limits, a copy of which is attached hereto as Exhibit 6 and made a part hereof, and will in the future prohibit park- ing at such locations on or immediately adjacent to this improvement as may be determined by the STATE to be necessary from traffic capacity studies. 7. The CITY has adopted and will put into effect, prior to the STATE adver- tising for the work to be performed hereunder, an appropriate ordinance prohibiting the discharge of sanitary and industrial waste water into any storm sewer or drainage facility constructed as part of this improvment, a copy of which is attached hereto as Exhibit C and made a part hereof. 8. • Prior to the STATE advertising for the work to be performed hereunder, the disposition of encroachments will be cooperatively determined by repre- sentatives from the CITY and the STATE. The CITY has adopted and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordi- nance relative to the disposition of encroachments and prohibiting in the future any new encroachments within the limits of the improvement, a copy of which is attached as Exhibit D and made a part hereof. 9. The CITY agrees to adopt a resolution or send a letter, prior to the STATE advertising for the work to be performed hereunder, approving the plans and specifications as prepared. 10. The CITY agrees not to permit driveway entrance openings to be made in the curb as constructed, without the consent of the STATE. -4- . 11. The STATE will cause private utilities to be relocated at no expense to the STATE or CITY. Where a municipal utility has been installed (1) on right of way acquired by the STATE or (2) within defined limits of a route the STATE has accepted for maintenance responsibilities, subsequent to the date of such acceptance the municipality will bear all utility relo- cation or adjustment costs made necessary by the construction of this improvement. 12. Upon completion of the improvement and so long as Larkin Avenue is used as a STATE highway, the STATE agrees to maintain, or cause to be maintained, the median, the through traffic lanes, the left-turn and right-turn lanes, and the curb and gutter or stabilized shoulders and ditches adjacent to those lanes. The STATE will be responsible for the maintenance of lane line and median line markings. 13. Upon completion of the improvement the CITY agrees to maintain, or cause to be maintained, along Larkin Avenue those portions of the improvement which are not to be maintained by the STATE, including sidewalks, parkways, manholes, catch basins, storm sewers, utilities and appurtenances. The CITY will be responsible for maintenance of crosswalk and stopline markings. 14. Upon acceptance by the STATE of the traffic signal work included herein, the financial responsibility for the maintenance and energy shall continue to be as outlined in the Master Agreement executed by the STATE and the CITY on March 3, 1982. THIS AGREEMENT and the covenants contained herein shall become null and void in the event the contract covering the construction work contemplated herein is not awarded by July 1, 1987. -5- • t I THIS AGREEMENT shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns. A separate offense shall be deemed committed for each 278 t • Ordinance No. G38-84 AN ORDINANCE REGULATING ENCROACHMENT ON PUBLIC RIGHT OF WAY IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS WHEREAS, the City of Elgin, hereinafter known as the City, and the State of Illinois, acting by and through its Department of Transportation, Division of Highways, have entered into an agreement relative to the improvement of Larkin Avenue (formerly U.S. Business Route 20) known as F.A.P. Route 557, State Section 8WRS-1(82) , City Section 84-00133-00-TL; and WHEREAS, in order to facilitate said improvement it is necessary for the City to adopt an ordinance regulating encroachments on the right of way for said improvement in accordance with the following definitions: Roadway Right of Way is defined as those areas existing or acquired by dedication or by fee simple for highway purposes; also, the areas acquired by temporary easement during the time the easement is in effect. Project Right of Way is defined as those areas within the project right of way lines established jointly by the City and the State which will be free of encroachments except as hereinafter defined. • Encroachment is defined as any building, fence, sign or any other structure or object of any kind (with the exception of utilities and public road signs), which is placed, located or maintained in, on, under or over any portion of the project right of way or the roadway right of way where no project right of way line has been established. Upon award of the contract for this improvement, the CITY will pay to the Department of Transportation of the State of Illinois in a lump sum, from any funds allotted to the CITY, an amount equal to 95% of its obligation incurred under this agreement and will pay to said Department the remainder of its obligation in a lump sum upon completion of the project, based upon final costs. The CITY agrees to pass a supplemental resolution to provide necessary funds for its share of the cost of this improvement if the amount appropriated herein proves to be insufficient to cover said cost. 6. Upon completion of the project, final field inspection by the STATE and notification by the District Engineer, the,CITY will assume jurisdiction of 1) Chicago Street from Illinois Route 31 to Center Street, 2) Highland Avenue from Illinois Route 31 to Center Street, 3) Center Street from Chicago Street to Dundee Avenue, 4) Dundee Avenue from Center Street to Summit Street and 5) Summit Street from Dundee Avenue to Illinois Route 25 (Liberty Street). 7. The CITY will adopt and will put into effect prior to the STATE advertising for the work to be performed hereunder, an apprcoriate • resolution adding that portion of roadway described in paragraph 6 of this agreement to its municipal street system upon notification of acceptance of the improvement by the STATE, a copy of which will be attached hereto as Exhibit B and made a part hereof, 8. The STATE shall cause private utilities to be relocated at no expense to the STATE or CITY. Where a municipal utility has been installed (1) on right of way acquired by the STATE or (2) within defined limits of a route the STATE has accepted for maintenance responsibilities, subsequent to the date of such acceptance the municipality will bear all utility relocation or adjustment costs -;�_3 improvement. 9. The STATE and the CITY on March 3, 1982 entered into a Master Agreement covering maintenance and energy responsibilities for all signalized intersections along STATE highways in the CITY, Exhibit A which is attached hereto as Exhibit C. Upon acceptance by the STATE of the traffic signal work included herein and subsequent jurisdictional transfer, revisions shall be made in the Master Agreement for the intersections denoted below. Attached hereto and made a material part hereof is "Revised Exhibit A" which contains a comprehensive listing of all signals covered by the MASTER AGREEMENT and reflects the changes described hereinabove. A copy of the aforementioned "Revised Exhibit A" is attached hereto as Exhibit 0. The STATE agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The CITY agrees to pay this cost as billed by the local power company. 10. The CITY has adopted and will put into effect prior to the STATE advertising for the work to be performed hereunder, an ordinance requiring that parking be prohibited along Illinois Route 58• (east of Illinois Route 25) within the limits of this improvement, within the CITY limits, a copy of which is attached hereto as Exhibit E and made a part hereof, and will in the future prohibit parking at such locations on or immediately adjacent to this improvement as may be determined by the STATE to be necessary from traffic capacity studies. 11. The CITY has adopted and will put into effect,_ prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance prohibiting the discharge of sanitary and industrial waste water into any storm sewers or drainage facility constructed as part of this improvement, a copy of which is attached hereto as Exhibit F and made a part hereof. 12. Prior to the STATE advertising for the work to be performed hereunder, the disposition of encroachments will be cooperatively ♦1�r...'..-1i4.,�r... cy • The CITY will adopt- and will put into effect, prior to the 4,. The CITY agrees not to permit driveway entrance openings to be made in the curb (on Illinois Route 58 east of Illinois Route 25) as constructed without the consent of the STATE. THIS AGREEMENT and the covenants contained herein shall become null and void in the event the contract covering the construction work contemplated herein is not awarded by July 1, 1990.
