HomeMy WebLinkAbout88-138 Zoning t r . -/6 STATE OF ILLINOIS COUNTY OF KANE RESOLUTION NO. 88 431 AMENDING PROCEDURES FOR SCHEDULING OF ZONING PETITION SPEAKERS AND FOR FILING OF FORMAL PROTESTS WHEREAS, The County Board by Resolution 481-18 adopted on March 10, 1981 amended procedures for scheduling of zoning petition speakers at County Board meetings and the filing of formal written protests against rezoning petitions, and WHEREAS, Ill . Rev . Statutes, Chap. 34, Par . 3158(b) "Amendments of regulations and districts - Protests - Service" has been revised significantly, and it is necessary to incorporate these revisions into the Kane County procedures; NOW, THEREFORE, BE IT RESOLVED that the above-mentioned procedures be amended to read as follows : "As described in the Illinois State Statutes, Chap. 34, 3158(b) , a 3/4 majority vote by the Kane County Board will be required in the case of written protest against any proposed map amendment that is either (A) signed by the owner or owners of 20€ of the land to be rezoned, or (B) signed by the owner or owners of 20% of land immediately touching or immediately across a street, alley or public right-of-way from land to be rezoned, or by resolution of the corporate authorities of a zoned municipality where land affected lies within 1-1/2 miles of said zoned municipality . Said protest shall be served by the protestor or protestors on the applicant and the applicant ' s attorney, if any, by certified mail at the address of such applicant and attorney shown in the application for the proposed amendment . A copy of the written protest shall also be filed with the Kane County Clerk, Building B, Kane County Government Center, 719 Batavia Avenue, Geneva, Illinois, by noon the workday preceding the County Board meeting . It is recommended that this written protest be acknowledged by a notary public.
