HomeMy WebLinkAbout87-1014 Sherman Hospital Fire Lane AGREEMENT WHEREAS , SHERMAN HOSPITAL ASSOCIATION, an Illinois not-for-profit corporation, (hereinafter "SHERMAN HOSPITAL" ) owns and operates a general acute care hospital known as Sherman Hospital , located in the City of Elgin, Illinois , and WHEREAS , SHERMAN HOSPITAL owns and maintains an entrance way which is located on and near the vacated portion of the 900 Block of Center Street , Elgin, Illinois and is used as an approach to the main entrance of the Hospital and several auxiliary entrances and as an entrance to a parking lot and garage and a medical office building, and WHEREAS , SHERMAN HOSPITAL desires to empower the City of Elgin to regulate the parking of vehicles in designated areas , and the City of Elgin desires to promote the public safety and welfare through unobstructed access to a local hospital , and WHEREAS , Section 11-209 of Chapter 95 1/2 of the Illinois Revised Statutes authorizes corporate authorities of any municipality to enter into such a contract for such purposes . WITNESSETH: That for and in consideration of the utu_ll promises and covenants herein contained and by authority of the applicable State statutes , SHERMAN HOSPITAL, owner of the following described property located within the City of Elgin, County of Kane : Block 1 and 2 of Slades Addition and Block 4 of Congdon ' s 2nd Addition and, vacated Center Street between Slade Avenue and Cooper Avenue , in the City of Elgin, Kane County, Illinois . commonly known as 934 Center Street , Elgin, Illinois , and the City of Elgin, a municipal corporation, agree as follows : 1 . That fire lanes are hereby established within that portion of the SHERMAN HOSPITAL entrance way as indicated on Exhibit A attached hereto and made a part hereof . 2 . That SHERMAN HOSPITAL shall erect , install and maintain appropriate signs designating such fire lanes and reading "Fire Lane, No Parking, Violators Will Be Towed" . SHERMAN HOSPITAL shall cause that portion of the hospital entrance way designated as a fire lane to be painted bright yellow with lines extending 2-3 feet from the curb and the curb shall be painted red. 3 . That No Parking areas are hereby established within that portion of the SHERMAN HOSPITAL entrance way as indicated on said Exhibit A. 4 . That SHERMAN HOSPITAL shall erect , install and maintain appropriate signs designating No Parking areas and shall cause that portion of the entry way, designated as a No Parking area, to be painted bright yellow with lines extending 2-3 feet from the curb and the curb shall be painted bright yellow. 5 . That a patient drop-off area is hereby established within that portion of the SHERMAN HOSPITAL entrance way as indicated on said Exhibit A. 6 . That SHERMAN HOSPITAL shall erect , install and maintain appropriate signs designating such patient drop-off area and reading "Patient Drop-Off and Pick-up Area No Parking" . SHERMAN HOSPITAL shall cause that portion of the Hospital entrance way designated as a Patient Drop-Off area to be painted bright yellow with lines extending 2-3 feet from the curb and the curb shall be painted bright yellow. 7 . That the standing or parking of any vehicle in such a manner as to block or obstruct the fire lane is prohibited and the standing or parking of any vehicle in a no parking area is prohibited, and the standing or parking of a vehicle in the patient pick-up or drop-off area for a purpose other than temporary stopping for drop-off or pick-up of a patient is prohibited. 8 . That the City of Elgin shall patrol said area and ticket offending vehicles and SHERMAN HOSPITAL shall facilitate and cooperate with the City of Elgin and permit access to the subject property by Police Officers for said purpose. - 2 - 9 . That upon the expressed written consent of SHERMAN HOSPITAL , signed by its President , the City of Elgin shall cause vehicles violating the above regulations to be removed and stored pending payment by the registered owner of the cost of said removal and storage . 10 . That the City of Elgin agrees to adopt necessary ordinances to permit enforcement of the above regulations . 11 . That this Agreement may be terminated upon 30 days written notice by either party. 12 . That this Agreement shall be recorded in the Office of the Recorder of Deeds of Kane County, Illinois , in accordance with the statute made and provided . Cook, City Manager SUBJECT Sherman Hospita Fire Lane Agreement PURPOSE: The purpose of this memo is to transmit the request of Sherman Hospital that the City enter into a formal agreement with the hospital to regulate fire lanes on hospital properties. BACKGROUND: Pursuant to Illinois State Law, the City of Elgin is authorized to enter into agreements with the owners of private property to regulate parking within designated fire lanes on such private property. The City has in the past entered into such fire lane agreements on properties such as shopping center and public housing complex. The attached letter from Mr. Douglas Scheflow requests that the City consider entering into such a fire lane agreement with Sherman Hospital. Should the Council indicate a tentative approval of this request, the City staff would work with the hospital to develop a formal agreement which would be presented to the Council for approval at a later date. FINANCIAL IMPACT: Not applicable. RECOMMENDATION: It is recommended that the staff work with Sherman Hospital to prepare a formal agreement authorizing regulation of fire lanes upon hospital properties and that such formal agreement be presented to the City Council at some future time. Blondin : I am writing to follow up on our recent telephone conversation regarding the Hospital ' s concerns regarding this matter . I have viewed the subject area and believe it to be adequately marked . Also , Ill Rev . Stat . Chap . 95 1/2 Section 11-209 seems very broad in its grant of authority , so that I believe I could draft an agreement that would meet the Hospital ' s needs under the existing signage and that would be acceptable to the City . The area under discussion covers the main entrance to the Hospital facilities , which is that part of the now vacated Center Street running North from Slade Avenue approximately one-half of a block to the main entrance of Sherman Hospital . Three traffic islands have been constructed in the center of the area creating a long U-shaped roadway . All of the curbing in this area is colored yellow , indicating no parking areas , or red indicating a fire lane . The Northern half of the curbing on the U-shaped drive is painted red . Six signs are present which state : Fire Lane , No Parking , Violators Will Be Towed . All of the gutters along the curbing and traffic islands are painted with a yellow cross hatch extending 2-3 feet from the curb . Additionally , there is a small area designated by two signs to be for patient drop off , which is within the no parking area . I believe that 95 1 /2-11 -209 could be used to regulate the entire area described above . As you indicated , you will have someone from the City Street Department inspect this area and report to you regarding the adequacy of the markings . Once this is completed and if the area meets with your approval , please contact me and I will draft an agreement for your review . Mr .
