HomeMy WebLinkAbout86-0211 Guillou and Associates Tyler Creek Detention _ r • AGREEMENT FOR ENGINEERING SERVICES COVERING ENGINEERING DESIGN AND CONSTRUCTION TYLER CREEK DETENTION BASIN 114 THIS AGREEMENT, made and entered this //---day of February , 1986, by and between the City of Elgin , whose address is 150 Dexter Court , Elgin, Illinois, 60120, hereinafter called PUBLIC AGENCY; and by Guillou & Associates , Inc . , whose address is 124 Maple Grove Lane, Springfield , Illinois , 62707 , and hereinafter called ENGINEER; covers certain professional , engineering , and consulting services , and direct costs in conjunction therewith, all in connection with the proposed completion of the Tyler Creek Detention Basin , which is to be located on Tyler Creek west of Randall Road in Kane County, Illinois. • WHEREAS, previous work has been performed by ENGINEER, in cooperation with the PUBLIC AGENCY , including preparation of the report entitled "Hydrologic Inventory , Tyler Creek Watershed , Kane County , Illinois", dated October 1976 ; and including calculations and information relative to the acquisition of real estate for the project ; and including preparation of the environmental report which is ready for submittal to the Chicago District of the U. S . Army , Corps of Engineers , in conjunction with the application for permit under Section 404 of the Clean Waters Act ; and including computations and services in support of activites related to efforts to enhance the contribution of funds of the State of Illinois toward the design and construction of the project ; and with the understanding that all information gained from the described work and other studies shall be made available to the work of this AGREEMENT without cost , and WHEREAS , the work of this AGREEMENT is intended to carry the development of the Tyler Creek Detention Project from its present degree of planning to completion of final construction , the work of this AGREEMENT is divided into three phases, as : Phase I - Preparation of the design report as required by the State of Illinois, submittal of the application for permit to construct to the Division of Water Resources , and preparation of responses to inquiries regarding the Section 404 permit for which application is to be made. Costs of the Phase I work amount to $29 ,800. Phase II - Responses to questions arising from the application for permit to construct ; design, construction and testing of a hydraulic model of the principal spillway and outlet system; preparation of working drawings, design plans and specifications. The work of Phase II is to be accomplished for the lump sum amount of $31 ,715. Phase III - Includes supervision of construction and progress reports to the PUBLIC AGENCY. An average of about 10 hours per • week of engineering technician services will be provided by PUBLIC AGENCY to supplement regular inspections of the work by ENGINEER during the construction phase of the project. The project will be inspected on an as-needed basis by the structural consultant. Construction surveys are to be provided by the contractor , and it shall be the responsibility of the ENGINEER to check these surveys. The Phase III work will be completed for the lump sum cost of $12,950, not including the services of the engineering technician. The anticipated schedule for project completion is as follows: 1 . Authorization to proceed issued by PUBLIC AGENCY -February 15, 1986 . 2 . ENGINEER file environmental assessment report and application for permit under Section 404 - February 25 , 1986 . 3. ENGINEER file design report and application for construction with the Illinois Divison of Water Resources - June 15 , 1986. 4. Advertise for construction bids - August 15, 1986. 5 . Open bids - September 15 , 1986. • 6. Begin construction - October 1 , 1986. 7 . Complete construction - October 1 , 1987 . • WITNESSETH THAT, in consideration of the premises and mutual covenants herein set forth, THE ENGINEER AGREES , 1 . To be responsible for supplying additional information •which may be required , and to meet with the Chicago District of the Corps of Engineers and with other agencies , all in support of the application for permit under Section 404 of the Clean Waters Act. 2. To prepare and submit to the Division of Water Resources of the Illinois Department of Transportation , application for permit for the construction of the said project , and to be responsible for the preparation and submission of the required design report in support of said application , which shall include but not be limited to the following topics : A. Hydrologic and Hydraulic Investigations 1 . Maximum water surface elevation with the 100-year event . 2 . Maximum water surface elevation with the spillway design flood . 3. Evaluation of upstream flood hazards . 4. Provisions for emergency and normal drawdown of the pool. 5. Freeboard design. 6 . Energy dissipator analysis 7. Dam breach wave analysis. B. Structural and Geotechnical Investigations and Design 1 . Geotechnical investigations. 2 . Earth embankments. 3. Seepage computations. 4. Conduit design. -1- r 5. Concrete design for spillway and pump station. 6. Steel design for spillway and pump station and spillway gates. 7 . Energy dissipation. structures. 8. Design of filters and drains. • 9. Riprap computations and locations. C. Plan of Operation • D. Project Maintenance Plan 3. To attend conferences to be held at the request of PUBLIC AGENCY in addition to the normal vists for supervision and work of this AGREEMENT. 4. The basic survey notes , sketches, charts , computations and other data prepared or obtained by ENGINEER pursuant to this AGREEMENT will be made available, upon request , to the PUBLIC AGENCY at cost and without restrictions or limitations as to their use. 5. All plans and other public documents furnished by ENGINEER pursuant to this AGREEMENT will be endorsed and will show the appropriate professional seal where such is required by law or is requested by the PUBLIC AGENCY. THE PUBLIC AGENCY AGREES 1 . To pay for the costs of Phase I of this AGREEMENT on the basis of a lump sum contract with amount of $29 ,800. Payment shall be on the basis of monthly billings to be submitted by the ENGINEER which shall describe the completed work and shall state the estimated degree of . completion of the total Phase I program. Ten percent of the amount of each monthly billing shall be withheld for payment at the completion of the Phase I work. 2. To pay for the work of Phases II and III of this AGREEMENT in fashion similar to Phase I. • 3. That, should the project be abandoned at any time after the ENGINEER has performed any part of the services provided for in this AGREEMENT and prior to the completion of such services, the PUBLIC AGENCY shall reimburse the ENGINEER for actual costs incurred up to the time he is notified in writing of such abandonment - "actual cost" being defined as material costs plus actual payrolls , insurances, social security, vacation and retirement deductions. • 4. That, should PUBLIC AGENCY extend the term of this AGREEMENT beyond two calendar years from the date hereof , the PUBLIC AGENCY will pay the ENGINEER, in addition to the fees provided herein, actual costs incurred beyond the stated fees and beyo94 the stated time limit - "actual costs" being defined as in Item V, herein. IT IS MUTUALLY AGREED, • -3- t • 1 . That ENGINEER shall evaluate the bids received for the work, shall be responsible for recommendations as to the bidder who is to perform the construction work, and shall keep records and make recommendations for payments to the Contractor as the work progresses. 2 . That time is of the essence and the schedule of progress contained herein is the minimum schedule, and both parties to this AGREEMENT will endeavor to advance the dates of the schedule to the maximum ' degree possible. 3. This AGREEMENT may be terminated by PUBLIC AGENCY up6n giving notice in writing to the ENGINEER at his last known post office address. Upon such termination the ENGINEER shall cause to be delivered to the PUBLIC AGENCY, all drawings , partial and completed estimates , and data from soil surveys or subsurface investigations, with the understanding that all such information shall become the property of the PUBLIC AGENCY. The ENGINEER shall be paid for any services completed or partially completed in accordance with Paragraph of "THE PUBLIC AGENCY AGREES". IN WITNESS WHEREOF, the parties have caused this AGREEMENT to be executed in quadruplicate counterparts , each of which shall be considered to be an original , by their duly authorized officers as of the dates below indicated . BACKGROUND: The City has been advised that the Build Illinois program for 1986 includes funds for the Tyler Creek Detention Facility. We are presently trying to determine the schedule for release of those funds. We have been advised that if we are able to proceed to construction this year, that the funds will probably be able to be released immediately, which would allow us to have a bond issue of reduced size. Mr. Guillou, who has done the engineering work on this project up to this date, has proposed an Engineering Agreement in three phases. The project can be stopped between these phases and the City will incur the liability of only the amount in that phase. Schedule would permit opening of bids by mid-September and beginning construction this fall, which is of importance. It is recommended that the City proceed immediately with the award of this so that no time will be lost and we are able to meet the schedule . Funds can be advanced from the Tyler Creek revenues and reimbursed at the time of the bond issue, which will probably take place by early summer. Should we be notified that the state is unable to release the funds and proceed, we can stop the engineering and delay the bond issue until later in the year, or even into 1987 , and have the construction fall at that time. RECOMMENDATION: It is recommended that the Council approve the resolution authorizing the Engineering Agreement with John Guillou & Associates , Inc. *//1"-P1J s mes J. FOR THE TYLER CREEK DETENTION FACILITY BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that James J. Cook, City Manager, and Marie Yearman, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Guillou & Associates, Inc. for certain engineering and consulting services for the Tyler Creek Detention Facility, a copy of which is attached hereto and made a part hereof by reference.
