KNOW ALL MEN BY THESE PRESENTS, that SAFETY-KLEEN CORP. , 655 Big Timber Road, Elgin, Illinois doing business as SAFETY-KLEEN CORP. as principals, and THE TRAVELERS INDEMNITY COMPANY, 175 W. Jackson Blvd. . Chicago, Illinois y , as suretisma, are held and firmly bound unto the CITY OF ELGIN, a municipal corporation, in the principal sum of TWENTY-FOUR THOUSAND FIVE HUNDRED AND NO/100 DOLLARS ($ 24,500,00 ) to the payment of which sum well and truly to be made, the said Principals and the said sureties bind themselves and their respective heirs, administrators, executors and assigns, jointly and severally, firmly by these presents. WHEREAS, the principals have applied to the Council of the City of Elgin for the final approval of a certain plat of subdivision to be known as Schroeder Industrial Park. , and WHEREAS, the City Code of the City of Elgin, (Chapter till requires that before any sub- division is finally approved by the said Council certain improvements, including streets, sidewalks, curbs and gutters, sewers, water supply and street drainage facilities must be installed and provided by the subdivider in strict compliance with the requirements of said ordinance and the specifications of the City of Elgin, and WHEREAS, the principals herein have agreed to construct said improvements in accord with the ordinances and specifications of the City of Elgin applicable thereto in the said subdivision and have further agreed to complete such construction not later than two years after the date hereof. NOW THEREFORE, THE CONDITION of this obligation is such that if the said principals shall fail to satisfactorily complete the said improvements as aforesaid not later than two years after the date hereof, then in that event the City of Elgin may, at its' option, immediately proceed with the construction of said improvements and hold the Principals and sureties jointly liable for the cost thereof, or the City of Elgin may elect to demand cash payment of the cost of completing the construction of such improvements. . , • - • • ' . , • THE FURTHER CONDITION of this obligation is such that if the Principals shall fully indemnify and re-imburse the City of Elgin for any loss the City of Elgin may suffer through the failure of said Principals to construct said improvements in accord with the ordinances and specifications of the City of Elgin, then this obligation to be void, otherwise to remain in full force and effect. PROVIDED HOWEVER, that no action, suit or proceeding shall be had or maintained on this instrument unless the same be brought or instituted within four years after the execution of this instrument.
