RESOLUTION
AUTHORIZING A COOPERATIVE AGREEMENT WITH
THE ILLINOIS DEPARTMENT OF PUBLIC HEALTH
FOR LEAD POISONING PREVENTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that Leo Nelson, City Manager, be and is hereby authorized and directed
to execute on behalf of the City of Elgin a cooperative agreement with
the Illinois Department of Public Health for the administration of a
lead dontrol program, a copy of which is attached hereto and made a part
hereof by reference.

COOPERATIVE AGREEMENT
FOR THE ADMINISTRATION OF THE
ILLINOIS LEAD POISONING PREVENTION ACT AND
RULES AND REGULATIONS
It is mutually agreed by and between the Illinois Department of Public
Health, hereinafter referred to as the "Department", and the City of
Win, hereinafter referred to as the "City" that:
The purpose of this Agreement is to establish authority for the City to
administer a Lead Control Program within its jurisdiction in accordance
with the Illinois Lead Poisoning Prevention Act (Ch. 111 1/2, par. 1301
through 1317, Ill. Rev. Stat.) hereinafter referred to as the "Act" and
the Rules and Regulations pertaining thereto.
Effective this date, the City is authorized by the Department to make
inspections and investigations under Sections 8 and 9 of the Act and all
Rules and Regulations promulgated thereunder, as follows:
The following activities shall be performed by the City and by the Depart-
ment in carrying out this program:
1. The City, acting through representatives approved by the Depart
ment, shall perform inspections and investigations under Sec-
tion 8 of the Act for the purpose of ascertaining that all
surfaces accessible to children are intact and in good repair
and to identify the existence of lead bearing substances and
shall exercise the authority conferred by Section 8 to remove
samples or objects for laboratory analysis.
2. Upon determination by the City that there are lead bearing
substances in or upon any dwelling or dwelling unit which may
be hazardous to children, the City shall take appropriate
action as described in Section 9 (1 through 4) of the Act.
Notification to the owner as defined by the Lead Poisoning
Prevention Act of the dwelling unit described in Section 9(4)
shall be made by the City in writing with a copy sent to the
Department.
3. Upon failure of the owner to comply with instructions to remedy
within the prescribed time period, City shall report the viola-
tion to the State's Attorney of the County in which the dwelling
is located. A copy of said report shall also be forwarded to
the Department for appropriate action.
4. The Department shall provide adequate training to designated
City representatives in the use of the x-ray fluorescence (XRF)
portable lead paint analyzer. All representatives of the City
engaged in inspections and investigations under the authority
of the Act shall be notified in writing by the Department that
they are certified in the use of the instruments and in investi-
gation techniques for this program.
5. Department shall provide and maintain the following equip-
ment for use in making tests and analyses under the Lead
Poisoning Prevention Act: x-ray fluorescence (XRF) portable
lead paint analyzer. It is understood that such equipment
will be provided on an "as available" basis, and that the
Department shall make every reasonable effort to make an
XRF unit available as soon as possible after a request for
equipment is received from the City, and that the City shall
-t promptly complete its inspection(s) and return the XRF unit
upon completion of the inspection(s).
This agreement may be terminated by either party by giving thirty (30)
days written notice of intent to terminate.
