A RESOLUTION AUTHORIZING THE PRESIDENT
AND THE VILLAGE CLERK TO SIGN A SECOND RIDER
TO THE CONTRACT WITH THE CITY OF ELGIN
FOR THE PURCHASE OF WATER
BE IT RESOLVED, by the President and Board of Trustees of
the Village of Sleepy Hollow, Kane County, Illinois as follows:
SECTION 1: That the President and Board of Trustees of
the Village of Sleepy Hollow hereby authorize the Village President
and Village Clerk to execute the Second Rider to a contract for sale
of water by the City of Elgin to the Village of Sleepy Hollow, a copy
of which is attached hereto and made a part hereof.
SECTION 2: That this Resolution shall be in full force and
effect from and after its passage and approval according to law.

SECOND RIDER TO CONTRACT FOR SALE
OF WATER BY THE CITY OF ELGIN TO
THE VILLAGE OF SLEEPY HOLLOW
This Second Rider made and entered into this 7 day of
, 1981, by and between the City of Elgin
(hereinafter referred to as Elgin) , an Illinois Municipal Corporation and
the Village of Sleepy Hollow (hereinafter referred to as Sleepy Hollow) ,
an Illinois Municipal Corporation;
WITNESSETH:
WHEREAS, Sleepy Hollow and Elgin have entered into a contract for
sale of water by the City of Elgin to the Village of Sleepy Hollow, said
contract being dated June 11, 1980; and
WHEREAS, the parties hereto agree it is necessary to amend said
contract by adding thereto the provisions of this Second Rider, which pro-
visions are fully set forth hereinafter;
NOW, THEREFORE, in consideration of the mutual covenants and
agreements herein contained, Elgin and Sleepy Hollow agree to amend said
contract as hereinafter set forth:
1. That Paragraph 1, of said contract be amended by adding there-
to the following:
During the period of this contract, prior to the completion of the
expansion of the Elgin water treatment system including construction of a new
treatment plant and associated facilities including lime residue storage and
a river intake facility which will increase the capacity of the Elgin system
to 16 million gallons per day, Elgin will tender and make available to Sleepy
Hollow, for its own use and at delivery points as specified, water in the
volume required by Sleepy Hollow or which the Sleepy Hollow water system may
be capable of taking at a normal operating pressure of the Elgin water system
at certain points of delivery to serve the entire area of Sleepy Hollow includ-
ing water consumers on both the east side and west side of Sleepy Hollow Road.
It is understood by Sleepy Hollow that Elgin must give primary con-
sideration to the Elgin customers and if in the event of a water shortage,

either due to unusual heavy demand for water in Elgin and/or Sleepy Hollow,
or due to malfunction of equipment in Elgin and/or Sleepy Hollow, Elgin
may ask and Sleepy Hollow shall comply to discontinue usage of water from
Elgin for customers that are east of Sleepy Hollow Road. Elgin agrees to
give twelve (12) hours notice of such discontinuance of service east of
Sleepy Hollow Road. Sleepy Hollow agrees to maintain the existing well system
on a standby basis in operable condition. Sleepy Hollow further agrees to
pay Elgin for such service in accordance with the provisions as set forth in
this agreement.
IN WITNESS WHEREOF, the parties hereto acting under authority of
their respective governing bodies have caused this contract to be duly executed
in several counterparts, each of which shall be constituted an original, all
as of the date and year first above written.

Dear Mr. Nelson,
Enclosed please find a Resolution and Rider Number Two to the
contract which the Village has with the City of Elgin concerning purchase
of water from Elgin.
We hope the City Council will look favorably on our request to
supply the East side of the Village with Elgin water.
